of Travis and Williamson, State of Texas ("Releasor"),with mailing address of221 East Main Street, Round
Rock, Texas 78664, for and inconsideration of the sum of Ten and Not] 00 Dollars ($10.00) and other good
and valuable consideration paid by FORESTAR (USA) REAL ESTATE GROUP, INC., a Delaware
corporation, whose address is 10700 Pecan Park Boulevard, Suite 150, Austin, Texas 78750, the receipt
and sufficiency of which is hereby acknowledged, does hereby ABANDON, RELEASE and DISCHARGE
a Storm Sewer and Drainage Easement recorded as Document No. 2022097846 of the Official Public
Records of Williamson County, Texas, encumbering the below -described property, to -wit:
Being for a 0.093 acre (4,048 square feet) tract of land situated in the Willis Donaho, Jr_
Survey, Abstract No. 173, Williamson County, Texas and being a portion of Lot 19, Block
D, Avery Centre East Phase 1, Sections 4 & 5, a subdivision recorded in Document No.
2021190845 of the Official Public Records of Williamson County, Texas; said 0.093 acre
tract of land being more particularly described by Field Notes and sketch in Exhibit "A"
incorporated herein for all purposes.
This instrument is given specifically to release said easement to the extent Releasor is Grantee of
said easement, which easement is terminated by abandonment, termination, vacation, and cessation of
purpose, and which easement will be of no further effect, whether legal or equitable.

WILLIS DONAHO, JR. SURVEY, ABSTRACT NO. 173, WILLIAMSON COUNTY, TEXAS
AND BEING A PORTION OF LOT 19, BLOCK D, AVERY CENTRE EAST PHASE 1,
SECTIONS 4 8 5, A SUBDIVISION RECORDED IN DOCUMENT NO. 2021190845 OF
THE OFFICIAL PUBLIC RECORDS OF WILLIAMSON COUNTY, TEXAS. SAID 0.093
ACRE TRACT OF LAND BEING MORE PARTICULARLY DESCRIBED BY METES AND
BOUNDS AS FOLLOWS:
COMMENCING at a 112" iron rod found monumenting the northeast comer of the called
4.9958 acre tract of land conveyed to Zoe's Place, Ltd., recorded in Document No.
2012045015 of the Official Public Records of Williamson County, Texas, same being on
an angle point in the west right-of-way line of County Road 117, same being on the south
boundary tine of the remnant portion of the called 260.659 acre tract of land (Property 5 —
Tract 2), conveyed to Marta C. Avery, as Trustee of the Marta C. Avery Exempt Trust, a
Sub -Trust of the Charles N. Avery III Exempt Trust under LSA Trust Agreement, Effective
December 24, 1992, recorded in Document No. 2021038922 of the Official Public
Records of Williamson County, Texas, from which a cotton gin spindle found
monumenting the southeast comer of said remnant portion of the 250.559 acre Avery
tract, same being on an angle point in said west right-of-way line of County Road 117,
bears N 67°13'48" E for a distance of 8.78 feet;
THENCE, S 68°17'44" W with the north boundary line of said 4.9958 acre Zoe's Place,
Ltd. tract, in part with the south boundary line of said remnant portion of the 250.559 acre
Avery tract and in part with the south boundary line of said Lot 19, Block D, for a distance
of 160.92 feet to a calculated point for the southeast corner and POINT OF BEGINNING
hereof;
THENCE, S 68.171"" W continuing with said north boundary line of the 4.9958 acre
Zoe's Place, Ltd, tract and said south boundary line of Lot 19, Block D, for a distance of
71.79 feet to a calculated point for the southwest corner hereof from which a 518" iron rod
found monumenting the northwest corner of said 4.9958 acre Zoe's Place, Ltd. tract,

distance of 504.14 feet;

This is a release of an existing City storm sewer and drainage easement that was erroneously recorded as
such when it should have been a wastewater easement. A new easement, with the same boundaries and
location, that corrects this error will be dedicated to the City to replace the easement being released. The
City Utilities Director is agreeable to this release. The project name is the Avery Centre East Phase 1,
sections 4 & 5.
