BOUNDARY LIMITS OF THE CITY OF ROUND ROCK, TEXAS, AND
THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 9.00
ACRES OF LAND OUT OF THE J.M. HARRELL SURVEY, ABSTRACT
284, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE
PRESENT BOUNDARY LIMITS OF THE CITY OF ROUND ROCK, TEXAS;
PROVIDING FOR A SAVINGS CLAUSE AND REPEALING
CONFLICTING ORDINANCES OR RESOLUTIONS.
WHEREAS, in accordance with Section 43.028 of the Local Government Code,
the owners of the property described in Exhibit "A" attached hereto and made a part
hereof petitioned the City Council annex the property, and
WHEREAS, the City Council has determined that the property (1) is one -half
mile or less in width, (2) is contiguous to the residents or on which fewer than three
qualified voters reside, and
WHEREAS, the City Council has heard the petition and the arguments for and
against the annexation, and
WHEREAS, the City council has determined to grant the petition and to annex
the property, and
WHEREAS, all requirements of the laws of the State of Texas and the Home
Rule Charter of the City of Round Rock, Texas have complied with, Now Therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,

That all of the above premises are found to be true and correct and are
incorporated into the body of this Ordinance as if copied in their entirety_
II.
That the property described in Exhibit "A ", which exhibit is attached hereto and
incorporated herein for all purposes, be and is hereby annexed and brought within the
corporate limits of the City of Round Rock, Williamson County, Texas, and same is
hereby made an integral part hereof.
The service plan submitted in accordance with the Municipal Annexation Act is
hereby approved as part of this Ordinance, made a part hereof and attached hereto as
Exhibit 'B ".

That the owners and inhabitants of the area herein annexed be entitled to all of
the rights and privileges of other citizens and property owners of said City and are

That the official map and boundaries of the City, heretofore adopted and

amended be and is hereby amended so as to include the aforementioned territory as
part of the City of Round Rock, Texas.
VI.
That the City Manager is hereby directed and authorized to perform or cause to
be performed all acts necessary to correct the official map of the City to add the territory
hereby annexed as required by law.
VII.
That this Ordinance shall be come effective after its passage.
VIII.
That the City Secretary is hereby directed and authorized to file a certified copy of
this Ordinance in the Office of the County Clerk of Williamson County, Texas.
IX.
If any section, subsection, sentence, phrase, or word of this Ordinance be found to
be illegal, invalid or unconstitutional or if any portion of said property is incapable of
being annexed by the City, for any reason whatsoever, the adjudication shall not affect
any other section, sentence, phrase, work, paragraph or provision of this Ordinance or
the application of any other section, sentence, phrase, work, paragraph or provision of
any other Ordinance of the City. The City Council declares that it would have adopted
the valid portions and applications of this Ordinance and would have annexed the
valid property without the invalid part, and to this end the provisions of this
Ordinance are declared to be severable.

A. All ordinances, parts of ordinances, or resolutions in conflict herewith are
expressly repealed.
B. The invalidity of any section or provision of this ordinance shall not
invalidate other sections or provisions thereof.

Council members present, the requirement for reading this ordinance on two separate

The City of Round Rock, Texas will provide for the extension of municipal services
into the territory to be annexed in compliance with Chapter 43, Subchapter C,
Annexation Procedures, of the Texas Local Government Code, 1992 Edition, and in
accordance with the following schedule:
1. Water Service: Water service is currently provided.
2. Wastewater Service: Wastewater service is currently provided.
3. Fire Protection: Provided by the Round Rock Fire Department
immediately upon annexation.
4. Police Protection: Provided by the Round Rock Police Department
immediately upon annexation.
Unless specified under other contracts, plat notes, or
separate instrument, all maintenance of public
facilities is covered by normally budgeted city -wide
maintenance funds.
Municipal services shall be provided to a level equivalent to similar land uses
throughout the city. All required capital improvements shall be extended to a point
accessible by the annexed tract. All line extensions to on -site buildings shall be borne by

RECOMMENDATION: Approval
This voluntary annexation consists of a 9 acre tract of land which is adjacent to the
Round Rock Hospital. The purpose of the annexation is to expand the existing
medical center. This development tract was recommended for C -1 (General
Commercial) original zoning by the Planning and Zoning Commission on February
18, 1993.
ECONOMIC IMPACT: Construction on the new medical center tentatively
scheduled to start in the latter part of 1993.
