Z- 43- 10-8 - '8G AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF ROUND ROCK, TEXAS ADOPTED IN SECTION 11.305(2), CODE OF ORDINANCES (1990 EDMON), CITY OF ROUND ROCK, TEXAS, AND MAKING THIS AMENDMENT A PART OF THE SAID OFFICIAL ZONING MAP, TO WIT: TO CHANGE .42 ACRES OF LAND OUT OF THE J.M. HARRELL SURVEY, ABSTRACT NO. 284, ROUND ROCK, TEXAS, FROM DISTRICT SF -2 (SINGLE FAMILY - STANDARD LOT) TO I -1 (GENERAL INDUSTRIAL). WHEREAS, an application has been made to the City Council of the City of Round Rock, Texas to amend the Official Zoning Map to change the zoning classification of the property described in Exhibit "A" from District SF -2 (Single Family - Standard Lot) to District I -1 (General Industrial); WHEREAS, the City Council has submitted the requested change in the Official Zoning Map to the Planning and Zoning Commission for its recommendation and report, and WHEREAS, the Planning and Zoning Commission held a public hearing concerning the requested change on the 21st day of October, 1993, following lawful publication of the notice of said public hearing, and WHEREAS, after considering the public testimony received at such hearing, the Planning and Zoning Commission has recommended that the Official Zoning Map be amended so that the zoning classification of the above described property be changed from District SF -2 (Single Family- Standard Lot) to District I -1 (General Industrial) and, WHEREAS, on the 28th day of October, 1993, after proper notification, the City Council held a public hearing on the requested change, and WHEREAS, the City Council has determined that substantial changes in conditions have occurred which justify the zoning classification change provided for herein, and WHEREAS, each and every requirement set forth in Chapter 211, Subchapter A, Texas Local Government Code, and Section 11.305(2), Code of Ordinances (1990 1 Alternative 1. Rezone SF-2 to 1 -1 (P&CD) L II. 2 Rezone .42 Acres SF -2 to I -1 Capital Aggregates Edition), City of Round Rock, Texas, concerning public notices, hearings, and other procedural matters has been fully complied with, NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: That the Official Zoning Map adopted in Section 11.305 (2), code of Ordinances (1990 Edition) City of Round Rock, Texas, is hereby amended so that the zoning classification of the property described in Exhibit A, attached hereto and incorporated herein shall be and is hereby changed from District SF -2 (Single Family - Standard Lot) to District I -1 (General Industrial). A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. By motion duly made, seconded and passed with an affirmative vote of all the Council members present, the requirement for reading this ordinance on two separate days was dispensed with. MAYNARD BEING 0.42 of an acre of land, situated in the Jim Harrell Survey, Abstract No. 284, in Williamson County, Texas, said land being that certain tract of land as conveyed to Albert L. Maynard by deed as recorded in Volume 842, Page 239, of the Deed Records of Williamson County, Texas. Surveyed on the ground in the month of September, 1993, under the supervision of Don H. Bizzell, Registered Professional Land Surveyor, and being more particularly described as follows; BEGINNING at an iron pin found on the east line of the Missouri- Pacific Railroad marking the Northwest corner of the above - referenced Maynard tract, for the Northwest corner hereof, THENCE, N 71° 37' E, 156.72 feet to an iron pin set for the Northeast corner of the said Maynard tract, for the Northeast corner hereof; THENCE, with an old fence, S15° 10' E, 137.11 feet to an iron pin found marking the Southeast corner of the said Maynard tract, for the Southeast corner hereof; THENCE, N 69° 10' W, 2.29 feet to an iron pin found at a fence corner and S 72° 05' W, at 83.30 feet past an iron pin found at a fence corner for a total distance of 110.27 feet, in all to an iron pin set on the said east line of the Missouri - Pacific Railroad for the Southwest corner of the said Maynard tract, for the Southwest corner hereof; THENCE, along the said east line of the Missouri - Pacific Railroad, N 33° 45' W, 139.54 feet to the place of BEGINNING and containing 0.42 of an acre of land.
