AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE
CITY OF ROUND ROCK, TEXAS ADOPTED IN SECTION
11.305(2), CODE OF ORDINANCES (1990 EDITION), CITY OF
ROUND ROCK, TEXAS, AND MAKING THIS AMENDMENT A PART
OF THE SAID OFFICIAL ZONING MAP, TO WIT: TO CHANGE
LOT 5, ROUND ROCK WEST SECTION 3 REVISED, FROM
DISTRICT I -1 (GENERAL INDUSTRIAL) TO DISTRICT C -1
(GENERAL COMMERCIAL) .
WHEREAS, an application has been made to the City Council
of the City of Round Rock, Texas to amend the Official Zoning
Map to change the zoning classification of the property
described in Exhibit "A ", attached hereto and incorporated in,
from District I -1 (General Industrial) to District C -1 (General
Commercial) ;
WHEREAS, the City Council has submitted the requested
change in the Official Zoning Map to the Planning and Zoning
Commission for its recommendation and report, and
WHEREAS, the Planning and Zoning Commission held a public
hearing concerning the requested change on the 1st day of
September, 1994, following lawful publication of the notice of
said public hearing, and
WHEREAS, after considering the public testimony received at
such hearing, the Planning and Zoning Commission has recommended
that the Official Zoning Map be amended so that the zoning
classification of the property described in Exhibit "A" be
changed to District C -1 (General Commercial); and,
WHEREAS, on the 22nd day of September, 1994, after proper
notification, the City Council held a public hearing on the
requested change, and
WHEREAS, the City Council has determined that substantial
changes in conditions have occurred which justify the zoning
classification change provided for herein, and
WHEREAS, each and every requirement set forth in Chapter
211, Subchapter A, Texas Local Government Code, and Chapter 11,
Code of Ordinances (1990 Edition), City of Round Rock, Texas,
concerning public notices, hearings, and other procedural
matters has been fully complied with,
ROUND ROCK, TEXAS:
That the Official Zoning Map adopted in Section 11.305(2),
Code of Ordinances (1990 Edition) City of Round Rock, Texas, is
hereby amended so that the zoning classification of the property
described in Exhibit A is hereby changed from District I -1
(General Industrial) to District C -1 (General Commercial).

NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF

A. All ordinances, parts of ordinances, or resolutions in
conflict herewith are expressly repealed.

B. The invalidity of any section or provision of this
ordinance shall not invalidate other sections or provisions
thereof.
Alternative 1.
By motion duly made, seconded and passed with an affirmative
vote of all the Council members present, the requirement for
reading this ordinance on two separate days was dispensed with.

ALL OF THAT CERTAIN TRACT OR PARCEL OF LAND BEING A PORTION OF
LOT 5, ROUND ROCK WEST SECTION THREE REVISED, A SUBDIVISION IN
THE CITY OF ROUND ROCK, WILLIAMSON COUNTY, TEXAS, AS RECORDED IN
CABINET C, SLIDES 173 AND 174 OF THE PLAT RECORDS OF WILLIAMSON
COUNTY, TEXAS, THE HEREIN DESCRIBED TRACT BEING MORE PARTICULARLY
DESCRIBED BY METES AND BOUNDS AS FOLLOWS:
BEGINNING FOR REFERENCE at an iron pin found at the Southeast
corner of the said Lot 5, being at the Northeast corner of that
certain 2.82 acre tract of land as conveyed to Brath Inc. by deed
recorded in Volume 1109, Page 466 of the Official Records of
Williamson County, Texas, being in the West r.o.w. line of
Interstate Highway No. 35;
THENCE along the East line of the said Lot 5, being the West
r.o.w. line of Interstate Highway No. 35, along a curve to the
right whose radius is 7954.75 feet, whose arc is 373.78 feet and
whose chord bears N 22 °49'47" W for a distance of 373.74 feet to
an iron pin set for the Southeast corner and PLACE OF BEGINNING
hereof;
THENCE along the South line of the herein described tract,
S 69 ° 12'34" W for a distance of 405.11 feet to an iron pin set in
the West line of the said Lot 5, being in the East line of the
Missouri - Pacific Railroad, Georgetown Branch Right -of -Way, for
the Southwest corner hereof;
THENCE along the West line of the said Lot 5, being the East
line of the said railroad right -of -way, N 18 ° 58'10" w at a
distance of 550.26 feet passing an iron pin set and continuing
for a total distance of 1110.75 feet to an inundated point in the
waters of Lake Creek, being at the Southwest corner of that
certain 0.30 acre tract of land conveyed to the City of Round
Rock by deed recorded in Volume 699, Page 486 of the Official
Records of Williamson County, Texas, for the Northwest corner
hereof;

S 83° 34' E for a distance of 67.36 feet to an inundated point
and N 77° 04' E for a distance of 354.36 feet to an inundated

Staff Recommendation: Approval
On September 1, 1994 the Planning and Zoning Commission recommended
approval of the zoning change from District I -1 (General Industrial) to District
C -1 (General Commercial). A public hearing was held by the Council on
September 22, 1994. At that time the ordinance was withdrawn because of a
discrepancy in the field notes.
