3 AN ORDINANCE AMENDING ZONING AND DEVELOPMENT CODE,
4 CHAPTER 2, ARTICLE VIII, SECTION 2-91 REGARDING MU-1
5 DISTRICT BAR REQUIREMENTS, CODE OF ORDINANCES (2018
6 EDITION), CITY OF ROUND ROCK, TEXAS, AND PROVIDING FOR A
7 SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES
8 AND RESOLUTIONS.

10 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK,
11 TEXAS:
12 I.
13 That Zoning and Development Code, Chapter 2, Article VIII, Section 2-91
14 (dd)(5)(b) of the Code of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby
15 amended as follows:
16 CHAPTER 2. ZONING DISTRICTS AND REGULATIONS
17 Sec. 2-91. —Supplementary use standards.
18 (dd) Restaurants/bars.
19 (5) Requirements for MU-1. Bars in the MU-1 district shall be subject to the following requirements:
20 a. For the purposes of this section, the following terms are defined:
21 1. Bar shall be defined as an establishment which:
22 i. Sells alcoholic beverages for on-site consumption;
23 ii. Does not have a commercial kitchen; and
24 iii. Does not meet the definition of a"restaurant/bar" as defined in Sec. 1.50.
25 2. Block shall be defined as a group of properties bound on all sides adjacent to public streets.
26 b. No more than eleven bars may operate in the MU-1 zoning district.
27 c. No more than four bars may operate within any single block.
28 d. No greater than two bars may operate on the same side of any single block.
29 e. Establishments whose primary fagade, including building and patio areas, exceeds 100 feet
30 in length shall be counted as two bars.
31 f. The owner of an establishment counting as two bars according to subsection e. above shall
32 not be issued a building permit that will expand the premises.
33 g. When the limit in subsections b., c., or d. above is reached, any further prospective bars shall
34 be placed on a waiting list maintained by city staff.
35 1. The owner of a property occupied by a bar which ceases operation shall be entitled to
36 resume bar use for up to six months after the closing of the previous bar. If no building

1 permit application is filed with the city or application for an alcoholic beverage license
2 filed with the Texas Alcoholic Beverage Commission (TABC) seeing to open a new bar
3 on the property before the end of the six-month period, city staff will notify the longest-
4 tenured waiting list applicant of his/her right to proceed.
5 2. The waiting list applicant will have 90 days to file an application for a building permit
6 with the city, or, if no building permit is required, an application for an alcoholic beverage
7 license with TABC. If neither action has occurred at the end of the 90-day period, staff
8 will notify the next waiting list applicant.

11 A. All ordinances, parts of ordinances, or resolutions in conflict herewith are
12 expressly repealed.
13 B. The invalidity of any section or provision of this ordinance shall not
14 invalidate other sections or provisions thereof.
15 C. The City Council hereby finds and declares that written notice of the date,
16 hour, place and subject of the meeting at which this Ordinance was adopted was posted
17 and that such meeting was open to the public as required by law at all times during which
18 this Ordinance and the subject matter hereof were discussed, considered and formally
19 acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government
20 Code, as amended.

22 By motion duly made, seconded and passed with an affirmative vote of all the
23 Council members present, the requirement for reading this ordinance on two separate
24 days was dispensed with.
