SURVEY, ABSTRACT NO. 130, ROUND ROCK, WILLIAMSON
COUNTY, TEXAS, FROM DISTRICT MF (MULTIFAMILY) TO
DISTRICT C -1 (GENERAL COMMERCIAL).
the City of Round Rock, Texas to amend the Official Zoning Map to
rezone 17.549 acres of land situated in the David Curry Survey,
Abstract No. 130, Round Rock, Williamson County, Texas, being more
fully described in Exhibit "A ", attached hereto and incorporated
herein, from District MF (Multifamily) to District C -1 (General
Commercial), and
WHEREAS, the City Council has submitted the requested change
in the Official Zoning Map to the Planning and Zoning Commission
for its recommendation and report, and
WHEREAS, the Planning and Zoning Commission held a public
hearing concerning the requested change on the 20th day of August,
1997, following lawful publication of the notice of said public
hearing, and
WHEREAS, after considering the public testimony received at
such hearing, the Planning and Zoning Commission has recommended
that the Official Zoning Map be amended so that the zoning
classification of the property described in Exhibit "A" be changed
to District C -1 (General Commercial), and

WHEREAS, on the llth day of September, 1997, after proper
notification, the City Council held a public hearing on the
requested amendment, and
WHEREAS, the City Council has determined that substantial
changes in conditions have occurred which justify the zoning
classification change provided for herein, and
WHEREAS, the City Council determines that the zoning
provided for herein promotes the health, safety, morals and
protects and preserves the general welfare of the community, and
WHEREAS, each and every requirement set forth in Chapter
211, Sub - Chapter A., Texas Local Government Code, and Section
11.300, Code of Ordinances (1995 Edition), City of Round Rock,
Texas concerning public notices, hearings, and other procedural
matters has been fully complied with, Now Therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS, THAT:
I.
That the Official Zoning Map adopted in Section 11.305(2),
Code of Ordinances (1995 Edition), City of Round Rock, Texas, is
hereby amended so that the zoning classification of the property
described in Exhibit "A" is hereby changed from District MF
(Multifamily) to District C -1 (General Commercial).
R.
A. All ordinances, parts of ordinances, or resolutions in
conflict herewith are expressly repealed.
2.
B. The invalidity of any section or provision of this
ordinance shall not invalidate other sections or provisions
thereof.

By motion duly made, seconded and passed with an affirmative
vote of all the Council members present, the requirement for
reading this ordinance on two separate days was dispensed with.

FOR A 17.549 ACRE TRACT OF LAND SITUATED IN THE DAVID CURRY SURVEY,
ABSTRACT No. 130 IN WILLIAMSON COUNTY, TEXAS BE A REMNANT PORTION OF
A 28 ACRE TRACT OF LAND CONVEYED BY WAYNE T. DAYTON, JR. TO DAYTON
AND HAYDEN BY INSTRUMENT RECORDED IN VOLUME 1089 PAGE 330 OF THE
OFFICIAL RECORDS OF SAID COUNTY, SAID 17.549 ACRE TRACT OF LAND BEING
MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS:
BEGINNING on an iron rod previously set by Baker - Aicklen &
Associates, Inc. found on a point in the westerly right -of -way line
of Sunrise Road, also known as County Road 115, being the
southwesterly corner of a tract of land dedicated for public right -
of -way (20 foot width), said point being in the common boundary line
of a partitioned tract of land in the name of Bessie Lee Schroeder,
Kenneth K. Schroeder and Virginia Vera Michalik as descibed by
instrument recorded as Document #9557382 of said Official Records and
the above referenced 28 acre tract of land, being the southeast
corner and POINT OF BEGINNING hereof, and from which, a point being
the southeast corner of a large flat rock previously recovered by
Baker - Aicklen & Associates, Inc. bears N70 ° 49'23 "E a distance of 25.66
feet (this rock determined to be same as described in parent tract
deed recorded in Volume 459 Page 482 of the Deed Records of said
County);
THENCE departing said right -of -way line with the common boundary line
of said partitioned tract and said 28 acre tract S70 ° 49'23 "W for a
distance of 1299.00 feet to an iron rod previously set by Baker -
Aicklen & Associate, Inc. found on the southeasterly corner of a
10.5257 acre tract of land conveyed as parkland to the City of Round
Rock by instrument recorded in Volume 1235 Page 627 of said Official
Records (document contains incorrect Exhibit A), being the
southwesterly corner hereof;
THENCE departing said common boundary line, through the interior of
said 28 acre tract of land, with the easterly boundary line of said
Parkland, N77 ° 29'33 "W for a distance of 877.08 feet to an iron rod
previously set by Baker - Aicklen & Associate, Inc. found on the
northeasterly corner of said Parkland tract, said corner being a
point in the southerly boundary line of a tract of land conveyed to
the Y.M.C.A. by instrument recorded in Volume 1292 Page 472 of said
Official Records, said point being also in the northerly boundary
line of said 28 acre tract of land, being the most westerly corner
hereof;
THENCE with the northerly boundary line of said 28 acre tract, same
