Z 1 s- ro -aa `98a AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF ROUND ROCK, TEXAS ADOPTED IN SECTION 11.305(2), CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS, AND MAKING THIS AMENDMENT A PART OF THE SAID OFFICIAL ZONING MAP, TO WIT: TO ZONE 40.00 ACRES OF LAND OUT OF THE J.M. HARRELL SURVEY, ABSTRACT 284, IN ROUND ROCK, WILLIAMSON COUNTY, TEXAS, AS DISTRICT C -1 (GENERAL COMMERCIAL). WHEREAS, an application has been made to the City Council of the City of Round Rock, Texas to amend the Official Zoning Map to zone 40.00 acres of land out of the J.M. Harrell Survey, Abstract 284, in Round Rock, Williamson County, Texas, being more fully described in Exhibit "A ", attached hereto and incorporated herein, as C -1 (General Commercial), and WHEREAS, the City Council has submitted the requested change in the Official Zoning Map to the Planning and Zoning Commission for its recommendation and report, and WHEREAS, the Planning and Zoning Commission held a public hearing concerning the requested change on the 16th day of September, 1998, following lawful publication of the notice of said public hearing, and WHEREAS, after considering the public testimony received at such hearing, the Planning and Zoning Commission has recommended that the Official Zoning Map be amended so that the property described in Exhibit "A" be zoned as C -1 (General Commercial), and WHEREAS, on the 8th day of October, 1998, after proper notification, the City Council held a public hearing on the requested amendment, and WHEREAS, the City Council determines that the zoning provided for herein promotes the health, safety, morals and protects and preserves the general welfare of the community, and WHEREAS, each and every requirement set forth in Chapter 211, Sub - Chapter A., Texas Local Government Code, and Section 11.300, Code of Ordinances (1995 Edition), City of Round Rock, Texas concerning public notices, hearings, and other procedural matters has been fully complied with, Now Therefore BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, THAT: I. That the Official Zoning Map adopted in Section 11.305(2), Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended so that the zoning classification of the property described in Exhibit "A" is hereafter designated as C -1 (General Commercial). H. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which 2. this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended, and the Act. FIELD NOTES FIELD NOTES FOR A 40.0000 ACRE TRACT OUT OF THE J.M. HARRELL SURVEY ABSTRACT NO. 284IN WILIIAMSONCOUNTY, TEXAS BEING A PORTION OF TRACT DESCRIBED IN VOLUME 614 PAGE 244. SAID TRACT BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS: BEGINNING at a 5/8' pipe found on the West R.O.W. of Interstate Highway No. 35 at the Southeast corner of Lot 2, Resubdivision of Chisholm Valley South Section Five, a subdivision recorded in Cab. G Slide 178 of the Williamson County, Texas Plat Records being the Northeast corner of said tract recorded in Vol. 614 Pg. 244 said point being the East end of a boundary line agreement recorded in Vol. 862 Pg. 939 of the Williamson County, Texas Deed Records, for the Northeast corner of this tract and the POINT OF BEGINNING. THENCE with the West line of Interstate Highway No. 35 also being the East line of this tract the following three (3) courses. 1) S 20° 34' 11' E, 720.67 feet to a 12' rebar set. 2) S 18° 54' 11" E, 12.71 feet to a concrete highway monument found. 3) S 14° 04' 05' E, 427.64 feet to an 12" rebar set for the Southeast corner of this tract. THENCE through the interior of said tract recorded in VoL 614 Pg. 244 the following five courses: 1) S 86° 58' 16' W, 192.66 feet to a 1/2' rebar set. 2) S 86° 54' 41" W, 112.97 feet to a 1/2" rebar set. 3) S 14° 04' 05" E, 47.88 feet to a 1/2" rebar set. 4) S 86° 54' 41" W, 1519.34 feet to a 1/2" rebar set for the Southwest corner of this tract. 5) N 15° 00' 00" E, 1244.45 feet to a 1/2" rebar set on the North line of said tract recorded in Vol. 614 Pg. 244, also being on the old common line of a 128.665 acre tract recorded in Vol. 717 Pg. 684 of the Williamson County, Texas Deed Records for the Northwest corner of this tract. THENCE N 87° 45' 38' E with the North line of this tract also being the South line of said 128.665 acre tract at 62.29, N 02° 14' 22" W 5.63 feet left a 12" rebar found at the Southeast corner of Lot 4 of Chisohn Valley South Section 10, Resub of Lots 1, 2, 3, 4 and 5, a subdivision recorded in Cab. B Slide 359 of the Williamson County, Texas Deed Records also being the South terminus of the West R.O.W. of Rawhide Drive for a total distance of 122.08 feet to a 12' pin set. THENCE N 02° 14' 22" W, 4.68 feet to a 12' rebar found at the Southeast terminus of Rawhide Drive and the Southwest corner of Resubdivision Chisholm Valley South Section Five as recorded in Cabinet G Slide 178 Plat Records of Williamson County, Texas also being the beginning of a line defined by a boundary line agreement recorded in Volume 862 Page 939 Deed Records of Williamson County, Texas. THENCE N 88° or 38" E with the South line of Resubdivision Chisholm Valley South Section Five also being the North line of this tract and the line defined by said boundary line agreement 1006.13 feet to the POINT OF BEGINNING and containing 40.0000 acres more or less.
