AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE
CITY OF ROUND ROCK, TEXAS ADOPTED IN SECTION 11.305(2),
CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK,
TEXAS, AND MAKING THIS AMENDMENT A PART OF THE SAID
OFFICIAL ZONING MAP, TO WIT: TO REZONE 3.824 ACRES OF
LAND OUT OF THE DAVID CURRY SURVEY, ABSTRACT NO. 130,
IN ROUND ROCK, WILLIAMSON COUNTY, TEXAS, FROM
PLANNED UNIT DEVELOPMENT (PUD) DISTRICT NO. 29 TO
DISTRICT OS (OPEN SPACE).
WHEREAS, an application has been made to the City Council of
the City of Round Rock, Texas to amend the Official Zoning Map to
to rezone 3.824 acres of land out of the David Curry Survey,
Abstract No. 130, in Round Rock, Williamson County, Texas, being
more fully described in Exhibit "A ", attached hereto and
incorporated herein, from Planned Unit Development (PUD) District
No. 29 to District OS (Open Space), and
WHEREAS, the City Council has submitted the requested change
in the Official Zoning Map to the Planning and Zoning Commission
for its recommendation and report, and
WHEREAS, the Planning and Zoning Commission held a public
hearing concerning the requested change on the 2nd day of February,
2000, following lawful publication of the notice of said public
hearing, and
WHEREAS, after considering the public testimony received at
such hearing, the Planning and Zoning Commission has recommended
that the Official Zoning Map be amended so that the property
described in Exhibit "A" be zoned as District OS (Open Space), and
WHEREAS, on the 24th day of February, 2000, after proper
notification, the City Council held a public hearing on the
requested amendment, and
WHEREAS, the City Council determines that the zoning provided
for herein promotes the health, safety, morals and protects and
preserves the general welfare of the community, and
WHEREAS, each and every requirement set forth in Chapter 211,
Sub - Chapter A., Texas Local Government Code, and Section 11.300,
Code of Ordinances (1995 Edition), City of Round Rock, Texas
concerning public notices, hearings, and other procedural matters
has been fully complied with, Now Therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS, THAT:

That the Official Zoning Map adopted in Section 11.305(2),
Code of Ordinances (1995 Edition), City of Round Rock, Texas, is
hereby amended so that the zoning classification of the property
described in Exhibit "A" is hereafter designated as District OS
(Open Space).

A. All ordinances, parts of ordinances, or resolutions in
conflict herewith are expressly repealed.
B. The invalidity of any section or provision of this
ordinance shall not invalidate other sections or provisions
thereof.
C. The City Council hereby finds and declares that written
notice of the date, hour, place and subject of the meeting at which
this Ordinance was adopted was posted and that such meeting was
open to the public as required by law at all times during which
this Ordinance and the subject matter hereof were discussed,
considered and formally acted upon, all as required by the Open
Meetings Act, Chapter 551, Texas Government Code, as amended, and
the Act.
Alternative 1.
By motion duly made, seconded and passed with an affirmative
vote of all the Council members present, the requirement for
reading this ordinance on two separate days was dispensed with.

FIELD NOTES FOR 3.824 ACRES OF LAND OUT OF THE DAVID CURRY
SURVEY, ABSTRACT 130, N WILLIAMSON COUNTY, TEXAS, BEING
OUT OF THAT CERTAIN TRACT OF LAND DESCRIBED IN DEED TO
3406 LTD. OF RECORD IN VOLUME 2607, PAGE 500, OFFICIAL
RECORDS OF WILLIAMSON COUNTY, TEXAS; SAID 3.824 ACRES OF
LAND BEING MORE PARTICULARLY DESCRIBED BY METES AND
BOUNDS AS FOLLOWS:
BEGINNING at a ''Vs" iron rod found at the northwest corner of said 3406 Ltd. Tract and the
northwest corner of the herein described tract, same being the most easterly northeast corner of
that certain tract of land described as Tract I in a deed to Robert H. Behrens, Trustee for the
Kimberlee Dawn Behrens Trust, of record in Volume 2107, Page 134, Official Records of
Williamson County, Texas, said corner also being in the south line of Tract II as described in said
Behrens deed;
THENCE with a north line of said 3406 Ltd. Tract, the north line of the herein described tract and
the south line of said Behrens Tract II, N 70°11'35" E a distance of 487.29 feet to a '/:" iron rod
with cap set at the northeast corner of the herein described tract, same being the northwest corner
of that certain tract of land described in Street Deed to the City of Round Rock, recorded in
Document No. 199944222, Official Records of Williamson County, Texas, said tract now known
as Creek Bend Boulevard, from which point a '/2" iron rod found in the south line of said Behrens
Tract II and the north line of said 3406 Ltd. Tract, for the northwest corner of Lot 1, Block E,
Wood Glen Section I, Phase II, a subdivision of record in Cabinet N, Slides 327 -329, Plat
Records of Williamson County, Texas, bears N 70 °1115" E a distance of 150.41 feet;
THENCE over and across said 3406 Ltd. Tract, with the east line of the herein described tract and
the west line of said City of Round Rock tract and Creek Bend Boulevard, the following two (2)
courses:
1) S 15 °41'23" W a distance of 765.24 feet to a %:" iron rod with cap set at the point of
curvature of a curve to the left;
2) with said curve to the left having a radius of 855.00 feet, an arc length of 79.29 feet, and a
chord bearing and distance of S 13 °01'30" W 79.26 feet to a 'A" iron rod found at the most
southerly corner of the herein described tract, same being in the west line of said 3406 Ltd.
Tract and an east line of said Behrens Tract I, from which point a V:" iron rod found bears S
19°54'11" E a distance of 20.05 feet;
THENCE with the west line of said 3406 Ltd. Tract and of the herein described tract, same being
an east line of said Behrens Tract I, N 19°48'18" W a distance of 689.62 feet to the POINT OF
BEGINNING and containing 3.824 acres of land within these metes and bounds.
