AN ORDINANCE AMENDING CHAPTER 11, SECTIONS 11.304,
11.317(3)(a), and 11.317(7), CODE OF ORDINANCES (1995 EDITION),
CITY OF ROUND ROCK, TEXAS, TO RE- DEFINE SIDE - LOADING
GARAGE, AND TO RESTRICT HEIGHT OF CERTAIN MULTI-
FAMILY UNITS; PROVIDING FOR A SAVINGS CLAUSE AND
REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
Section 11.317 (3) (a) , Code of Ordinances, 1995 Edition, City
of Round Rock, Texas, is hereby deleted in full and amended to read
as follows:
(a) A side - loading garage, meaning a garage which opens to an interior side lot line; or

Section 11.317(7), HEIGHT AND PLACEMENT REQUIREMENT TABLE,
Code of Ordinances, 1995 Edition, City of Round Rock, Texas, is
hereby amended by adding a new footnote 6, which shall read as
follows:
6. This thirty (30') foot height requirement applies to four (4) or fewer multi - family dwelling
units on a single lot. The height requirements for five (5) or more multi - family units shall
be established by Site Plan approval, but in any event shall not exceed three (3) stories.

Twenty -five (25) feet for one (1) story buildings plus ten (10) additional feet for each story thereafter.
Buildings located on properties abutting Interstate Highway 35 frontage roads may be up to ninety feet (90')
in height.
A 25 foot (25') setback shall be provided along all side lot lines which abut any highway frontage road.
This requirement may be waived by Site Plan Approval.

ordinance shall not invalidate other sections or provisions
thereof.
C. The City Council hereby finds and declares that written
notice of the date, hour, place and subject of the meeting at which
this Ordinance was adopted was posted and that such meeting was
open to the public as required by law at all times during which
this Ordinance and the subject matter hereof were discussed,
considered and formally acted upon, all as required by the Open
Meetings Act, Chapter 551, Texas Government Code, as amended, and
the Act.

Subject: City Council Meeting — April 27, 2000
Item: 11.A.1. Consider an ordinance amending Chapter 11, Sections
11.317(3)(a), and 11.317(7), Code of Ordinances (1995 Edition),
City of Round Rock, Texas, to re-define side- loading garage
and to clarify the height restriction for multi family units.
(First Reading) The Planning and Zoning Commission
recommended adoption of this text amendment on March 10,
1999. Staff Resource Person: Joe Vining, Planning Director.
This text amendment entails the following changes:
1. Modification of the side loading garage definition. Currently this definition
(as noted in the attached page 499) includes the words "or a side street" The
term "side street" is not only redundant but erroneous. This change omits
that particularly misleading term.
2. Restatement of the multi- family height restriction. Under this change a new
foot note no. 6 would be added to the Height and Placement Requirement
Table (page 500, enclosed), and the current zoning District MF Height Limit
entry "30 would be changed to "30
The significance of the new footnote no. 6 is to clarify that the 30 ft. MF height
restriction applies only to single - family units, duplexes, threeplexes, and
fourplexes. The height limit of multifamily development containing more than
four dwelling units shall be established by the Development Review Board site
approval and shall not exceed three stories.
