AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE
CITY OF ROUND ROCK, TEXAS ADOPTED IN SECTION 11.401(2)(a),
CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK,
TEXAS, AND MAKING THIS AMENDMENT A PART OF THE SAID
OFFICIAL ZONING MAP, TO WIT: TO REZONE 6.49 ACRES OF
LAND, MORE OR LESS, OUT OF THE P.A. HOLDER SURVEY,
ABSTRACT NO. 297, IN ROUND ROCK, WILLIAMSON COUNTY,
TEXAS, FROM DISTRICT SF -2 (SINGLE FAMILY - STANDARD LOT)
TO DISTRICT MF (MULTI- FAMILY).
WHEREAS, an application has been made to the City Council of
the City of Round Rock, Texas to amend the Official Zoning Map to
rezone 6.49 acres of land, more or less, out of the P.A. Holder
Survey, Abstract No. 297, in Round Rock, Williamson County, Texas,
being more fully described in Exhibit "A ", attached hereto and
incorporated herein, from District SF -2 (Single Family- Standard
Lot) to District MF (Multi - Family), and
WHEREAS, the City Council has submitted the requested change
in the Official Zoning Map to the Planning and Zoning Commission
for its recommendation and report, and
WHEREAS, the Planning and Zoning Commission held a public
hearing concerning the requested change on the 18th day of
December, 2002, following lawful publication of the notice of said
public hearing, and
WHEREAS, after considering the public testimony received at
such hearing, the Planning and Zoning Commission has recommended
that the Official Zoning Map be amended so that the property
described in Exhibit "A" be zoned as District MF (Multi - Family),
and
WHEREAS, on the 23rd day of January, 2003, after proper
notification, the City Council held a public hearing on the
requested amendment, and
WHEREAS, the City Council determines that the zoning provided
for herein promotes the health, safety, morals and protects and
preserves the general welfare of the community, and
WHEREAS, each and every requirement set forth in Chapter 211,
Sub - Chapter A., Texas Local Government Code, and Section 11.300 and
Section 11.400, Code of Ordinances (1995 Edition), City of Round
Rock, Texas concerning public notices, hearings, and other
procedural matters has been fully complied with, Now Therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS:
That the Official Zoning Map adopted in Section 11.401(2) (a),
Code of Ordinances (1995 Edition), City of Round Rock, Texas, is
hereby amended so that the zoning classification of the property
described in Exhibit "A" is hereafter designated as District MF
(Multi - Family).
2.
A. All ordinances, parts of ordinances, or resolutions in
conflict herewith are expressly repealed.
B. The invalidity of any section or provision of this
ordinance shall not invalidate other sections or provisions
thereof.
C. The City Council hereby finds and declares that written
notice of the date, hour, place and subject of the meeting at which
this Ordinance was adopted was posted and that such meeting was
open to the public as required by law at all times during which
this Ordinance and the subject matter hereof were discussed,
considered and formally acted upon, all as required by the Open
Meetings Act, Chapter 551, Texas Government Code, as amended.

vote of all the Council members present, the requirement for
reading this ordinance on two separate days was dispensed with.

TRACT OF LAND AS DESCRIBED IN THAT DEED TO SYCAMORE TRAIL, LTD. BY
INSTRUMENT RECORDED IN DOCUMENT NO. 2001007251 OF THE OFFICIAL
RECORDS OF SAID COUNTY, SAID 6.49 ACRE TRACT BEING MORE PARTICULARLY
DESCRIBED BY METES AND BOUNDS AS FOLLOWS:
BEGINNING at the northwesterly corner of said 6.591 Acre Tract, same being on the easterly
line of a called 16'/4 acre tract of land of land as described in that deed to C. Elmer Johnson by
instrument recorded in Volume 439, Page 438 of the Deed Records of said County, same being
the southerly right -of -way line of Missouri Pacific Railroad, same being the northwesterly corner
hereof, from which a 60D nail found for the northeasterly corner of said 16'/4 Acre Tract bears,
N 01° 56' 50" W for a distance of 35.23 feet and a 1" O.D. iron pipe found bears,

This rezoning parcel, already owned by Sycamore
Trail, Ltd., the developer, is a portion of the 32.95
acre multifamily tract. The entire multi family
development tract consists of four contiguous
ownership parcels and is bounded by the Missouri
Pacific Railroad to the north, A.W. Grimes Boulevard
to the east, and Lake Creek to the south. This
arrangement harmonizes especially well with the
neighboring Turtle Creek development across Lake
Creek to the south and will further establish Lake
1. This development resolves one of the few
remaining large infill properties, and the General
Plan provides for the use of multifamily zoning in
such applications.
2. This proposal, given its mixed -use context,
represents a timely opportunity to make use of the
District Multifamily classification as opposed to
Planned Unit Development as a zoning means to
a planning end.
3. Adoption of this proposal will mean that this
property will bear at least a fair share of the ad
valorem tax burden.
Creek as a natural and visual amenity since the
multifamily development will utilize this feature as
opposed to fencing it off. In relation to roadway
access this site is likewise well situated by its reliance
on the A.W. Grimes arterial for public access and by
its location on the west side of this arterial, further
distancing the multifamily from the established South
Creek single - family development. The applicant will
highlight these and related concerns in the
presentation at the meeting.
In summary the staff is recommending in favor of this
proposal based mainly on the following
considerations:

District SF -2 (Single Family Standard Lot) to District MF (Multi -

History: This tract was originally zoned SF -2 (Single Family - Standard Lot) on the original
Zoning Map of November 1969. The applicant proposes to rezone 6.49 acres of
land to District MF (Multifamily), being that certain portion of the 32.95 acres
proposed multifamily tract. Previously, the applicant requested that the Planning
and Zoning Commission table this item on November 6, 2002. The applicant has
since requested to proceed with his request of rezoning. The proposed land use
complies with the adopted General Plan. On December 18, 2002, a public hearing
was held before the Planning and Zoning Commission for the rezoning of District
MF on 6.49 acres and at that time the commission recommended adoption of MF
rezoning.
