DATE: SUBJECT: ITEM: November 20, 2003 City Council Meeting — November 25, 2003 11.B.1. Resource: Joe Vining, Planning Director History: Funding: Cost: Source of Funds: Outside Resources: Impact/ Benefit: Public Comment: Sponsor: Consider an ordinance rezoning 11.74 acres of land from District SF -2 (Single Family- Standard Lot) to District PF (Public Facilities). (Westside Church of Christ of Williamson County, Inc.) (First Reading) The zoning ordinance requires church facilities in excess of 2,500 square feet of accessory uses to be zoned PF (public facilities). The intent behind this regulation is to ensure greater compatibility between large church complexes and adjacent residential uses. The church's location along FM 1431, a major arterial, qualifies the tract for Public Facilities zoning. Under the current zoning ordinance, all requests for rezoning must be accompanied by an approved Traffic Impact Analysis (TIA). The TIA is prepared under the assumption that the tract will be developed according to its highest and best use. The highest and best use in the current PF district is "office medical ". Because the church has no immediate plans to change its existing use, the City has agreed to allow the Church to attach a restrictive covenant to its property. The covenant restricts the current use of the tract to church uses only. A copy of the revised restrictive covenant is attached for your review. The covenant restricts total building square footage on the site to 27,500 sq. feet. This allows for an expansion of approximately 6,000 square feet beyond the existing square footage. Should the Church wish to expand its square footage beyond the 27,500 square feet specified in the covenant, the city will not accept a site plan nor issue a building permit until a TIA is approved. The restriction of total square footage accomplishes the goal of limiting traffic impacts without expressly stating each permitted accessory use. Staff is currently reviewing the uses contained in the PF district. Staff may consider dividing the district into two zones (PF -1, PF -2) in order to minimize the TIA requirements for smaller PF uses such as churches and community service organizations. To require churches to prepare a TIA to meet the demands of an office medical building or hospital is impractical and onerous since churches consistently generate off -peak traffic. N/A N/A Mr. Lineal Click, Elder, Westside Church of Christ Approval of the rezoning ensures compliance with the Zoning Ordinance. Public Notice and a public hearing were held in accordance with City of Round Rock's Zoning Ordinance. Planning and Community Development Department. Westside Church of Christ 03- 019 -ZC REQUEST: Approval of the zoning change from SF -2 (Single Family Standard Lot) to PF (Public Facilities). HISTORY: This tract was originally zoned SF -2 with annexation. DATE OF REVIEW: 10/29/03 OWNER: Westside Church of Christ of Williamson County, Inc. CONSULTING ENGINEER: Fisher Hagood, Inc. DESCRIPTION: 11.74 acres, Ephraim Evans Survey, Abstract #212 PRESENT ZONING: SF -2 PRESENT LAND USE: Church and portable buildings for religious education. LOCATION: North of FM 1431 and west of Mayfield Ranch Boulevard. ADJACENT LAND USE: GENERAL PLAN POLICY: Residential STAFF COMMENTS: Planner: Susan Brennan North: Residential (Vista Oaks) South: FM 1431 East: Residential (Vista Oaks) West: Vacant PROPOSED LAND USE: Expanded church facilities with greater than 2,500 square feet of accessory use. UTILITIES: The development proposes standard municipal services. The zoning ordinance requires church facilities in excess of 2,500 square feet of accessory uses to be zoned PF (public facilities). The highest RECOMMENDATION: Staff recommends approval of the rezoning request. 11.74 acres of land: Public Facility lot and best use in the current PF district is "office medical ". Because the church has no immediate plans to change its existing use, the City has agreed to allow the Church to attach a restrictive covenant to its property. The covenant restricts the current use of the tract to church uses only. Per the Commission's request, a revised restrictive covenant has been prepared. The covenant restricts total building square footage on the site to 27,500 sq. feet. This allows for an expansion of approximately 6,000 square feet beyond the existing square footage. Should the Church wish to expand its square footage beyond the 27,500 square feet specified in the covenant, the city will not accept a site plan nor issue a building permit until a TIA is approved and associated improvements completed. Staff will prepare its recommendation for a revised PF district later this Fall. A copy of the revised restrictive covenant is attached for your review.
