This memorandum briefly summarizes the amendments. The amendments attempt to resolve a number of recurring issues staff has encountered since the adoption of the Zoning Ordinance in May 2002. This is the second round of amendments staff has recommended to the Council since adoption. Proposed Amendment I • Add Vehicle Repair Facilities and Body Shops as a permitted use with conditions in the Light Industrial (LI) district Vehicle Repair Facilities are permitted in the I (Industrial) district and as a Special Exception in the C -1 (General Commercial) District. Since Ordinance adoption, staff has received requests to locate new vehicle repair and body shops within the LI district. Because the LI district has more stringent development standards than the I district, staff feels confident that the inclusion of vehicle repair and body shops in the LI district will not have a detrimental effect on overall City appearance. In addition, several development standards specific to vehicle repair and body shops are already included in the Zoning Ordinance and will apply to those shops that locate in the LI district. For example, vehicle repair and body shops must operate within an enclosed building; and bay doors may not face any lots in residential districts. Proposed Amendment II Break existing definition of Accessory Building /Structure into 2 categories to more easily distinguish between residential and non - residential accessory uses. The existing definition has created confusion during the site planning process, since the development standards for accessory buildings in residential districts are different from those in non - residential districts. For example, accessory buildings in single family residential districts cannot exceed 150 square feet. Accessory Building/ Structure - Non - Residential Includes but is not limited to storage facilities, detached garages, parking structures or enclosures, and other similar buildings or structures, and is subordinate to and services a principal non - residential building on the same or abutting lot. Said accessory building or structure shall meet the requirements of the zoning district in which it is located. Accessory Building/ Structure - Residential Includes but is not limited to swimming pools, decks, storage sheds, barbeque structures, detached garages, playscapes, tree houses and other similar buildings or structures and is subordinate to and services a principal residential building on the same lot. Said accessory building or structure shall meet the requirements of the zoning district in which it is located. Proposed Amendment III Expand existing definition of Place of Worship to more clearly distinguish between what facilities are considered to be part of the principle permitted use and what facilities are considered to be accessory uses. Expansions in excess of 2,500 sq. feet of "accessory use" are required to meet specific development standards and may require a rezoning to the PF (Public Facilities) zoning district. Places of Worship, in and of themselves, are protected with federal legislation and cannot be regulated. Uses accessory to the Place of Worship can be regulated. Proposed Amendment V Expand the definition of "temporary building" to differentiate between the types of temporary buildings permitted in the Zoning Ordinance. Section 11.425 (2) of the Zoning Ordinance permits temporary buildings for classroom space and Section 11.425 (4) permits temporary contractors' offices and equipment sheds. Temporary Building An enclosed building which complies with the provisions of Section 11.435 (2) of this Chapter or an enclosed building, the use of which is incidental to construction work on the premises, which enclosed building shall be removed upon the completion or abandonment of construction work and which complies with the provisions of Section 11.425 (4) of this Chapter. Proposed Amendment VI Amend the Summary Use Table (Appendix A) to accomplish the following: • Remove note explaining that the Appendix is not adopted by ordinance. It was, indeed, adopted by Ordinance in May 2002 since it was part of the adoption exhibit presented to Council. • Add "Vehicle Repair Facilities and Body Shops" as a use permitted with standards in the LI (Light Industrial) District. • Add Waste Related Service as a use permitted with standards in the LI (Light Industrial) District and remove it from the I (Industrial) District. This addition & deletion was approved with the last round of amendments; it related directly to the rezoning case for the Round Rock Industrial Park along Chisholm Trail. While the amendment was approved in the main body of the ordinance, the changes had not been made to the Summary Use Table. Alternative 1. By motion duly made, seconded and passed with an affirmative vote of all the Council members present, the requirement for reading this ordinance on two separate days was dispensed with.
