Z-05-04-14-13B2 - 4/14/2005 (2)WHEREAS, an application has been made to the City Council of the City of Round Rock, Texas to amend the Official Zoning Map to rezone 8.873 acres of land, out of the Wiley Harris Survey, Abstract No. 298, in Round Rock, Williamson County, Texas, being more fully described in Exhibit "A" attached hereto, from District PUD No. 16 (Planned Unit Development) to District TH (Townhouse), and AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF ROUND ROCK, TEXAS ADOPTED IN SECTION 11.4O1(2)(a), CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS, AND MAKING THIS AMENDMENT A PART OF THE SAID OFFICIAL ZONING MAP, TO WIT: TO REZONE 8.873 ACRES OF LAND, OUT OF THE WILEY HARRIS SURVEY, ABSTRACT NO. 298, IN ROUND ROCK, WILLIAMSON COUNTY, TEXAS, FROM DISTRICT PUD NO. 16 (PLANNED UNIT DEVELOPMENT) TO DISTRICT TH (TOWNHOUSE). WHEREAS, the City Council has submitted the requested change in the Official Zoning Map to the Planning and Zoning Commission for its recommendation and report, and WHEREAS, the Planning and Zoning Commission held a public hearing concerning the requested change on the 1st day of December 2004, and on the 23rd day of March 2005, following lawful publication of the notice of said public hearing, and WHEREAS, after considering the public testimony received at such hearing, the Planning and Zoning Commission has recommended that the Official Zoning Map be amended so that the property described in Exhibit "A" be zoned as District TH (Townhouse), and @ PFD esktoF\ ,OD MA/ WORLDO%/ 0 : /NDO% /ORDINANC /050414D2.WPC /sc ORDINANCE NO. 2 - Db`DA-1-11-1-1362} WHEREAS, on the 14th day of April, 2005, after proper notification, the City Council held a public hearing on the requested amendment, and WHEREAS, the City Council determines that the zoning provided for herein promotes the health, safety, morals and protects and preserves the general welfare of the community, and WHEREAS, each and every requirement set forth in Chapter 211, Sub- Chapter A., Texas Local Government Code, and Section 11.300 and Section 11.400, Code of Ordinances (1995 Edition), City of Round Rock, Texas concerning public notices, hearings, and other procedural matters has been fully complied with, Now Therefore BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That the Official Zoning Map adopted in Section 11.401(2)(a), Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended so that the zoning classification of the property described in Exhibit "A" is hereafter designated as District TH (Townhouse). II. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. 2. C. Consider an ordinance rezoning 8.873 acres of land from District PUD No. 16 (Planned Unit Development) to District TH (Townhouse). (451 School Days Lane) (First Reading) Department: Planning and Community Development Staff Person: Jim Stendebach, Planning Director Justification: This 8.873 acre tract is part of a larger 22acre tract that was zoned C -2 (Local Commercial) in 1986 and rezoned to PUD (Planned Unit Development) in 1994. The PUD zoning was adopted in order to accommodate a large multi -use church facility. This facility is no longer financially feasible, and therefore the property owner (Sweet Home Baptist Church) has opted to sell the majority of the 22acre tract for residential and commercial development, while retaining a smaller parcel for a future church facility. The property is located in a residential area comprised of a mixture of multi- family and single - family units. A low- density condominium community would be consistent with this mix of single - family and multi - family residences, particularly since the condominiums will include both attached and detached units. The proximity to Gattis School Road, Mays Street and Voight Elementary School, not to mention the church and local commercial center associated with the overall project, make this location more appropriate for a denser residential use than single - family houses. A condominium community complies with the General Plan and is consistent with City land use policies. In addition, the overall development will include the extension of Surrey Drive from Gattis School Road north to School Days Lane. This will not only improve access to Voight Elementary School just north of the subject property, but it will also help warrant the installation of a traffic signal at the intersection of Gattis School Road and Surrey Drive. Currently, the traffic at that intersection is in a failing condition. Replacing the existing stop sign with a traffic signal will greatly improve the flow of traffic along Gattis School Road, particularly since the developer of Sagebrush has agreed to donate twenty feet of ROW to allow for a dedicated left turn lane at the signal. The applicant returned to the Planning and Zoning Commission on March 23, 2005, and presented information from a Traffic Impact Analysis (TIA) regarding the impact of the project on the traffic situation along Gattis School Road. The applicant also presented a letter of support from the Kensington Neighborhood Association on the south side of Gattis School Road across from the subject property. The Commission rendered a favorable recommendation to change the zoning as requested. Public Comment: Public Notice and a public hearing were held in accordance with the City of Round Rock's Zoning Ordinance. Notification was sent out to neighboring property owners and public hearings were held on both December 1, 2004, and on March 23, 2005, at the regular meetings of the Planning and Zoning Commission.
