J' AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF ROUND ROCK, TEXAS ADOPTED IN SECTION 11.401(2)(a), CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS, AND MAKING THIS AMENDMENT A PART OF THE SAID OFFICIAL ZONING MAP, TO WIT: TO REZONE 20.073 ACRES OF LAND, OUT OF THE DAVID CURRY SURVEY, ABSTRACT NO. 130, IN ROUND ROCK, WILLIAMSON COUNTY, TEXAS, FROM DISTRICT OS (OPEN SPACE) TO DISTRICT SF -2 (SINGLE FAMILY - STANDARD LOT). WHEREAS, an application has been made to the City Council of the City of Round Rock, Texas to amend the Official Zoning Map to rezone 20.073 acres of land, out of the David Curry Survey, Abstract No. 130, in Round Rock, Williamson County, Texas, being more fully described in Exhibit "A" attached hereto, from District OS (Open Space) to District SF -2 (Single Family- Standard Lot), and WHEREAS, the City Council has submitted the requested change in the Official Zoning Map to the Planning and Zoning Commission for its recommendation and report, and WHEREAS, the Planning and Zoning Commission held a public hearing concerning the requested change on the 23rd day of March 2005, following lawful publication of the notice of said public hearing, and WHEREAS, after considering the public testimony received at such hearing, the Planning and Zoning Commission has recommended that the Official Zoning Map be amended so that the property described in Exhibit "A" be zoned District SF -2 (Single Family - Standard Lot), and @PFDe,ktop \:: COMP/ WORLDOX/ 0; /WDOX /ORD'NANC /050906C1.WPD/, WHEREAS, on the 9th day of June, 2005, after proper notification, the City Council held a public hearing on the requested amendment, and WHEREAS, the City Council determines that the zoning provided for herein promotes the health, safety, morals and protects and preserves the general welfare of the community, and WHEREAS, each and every requirement set forth in Chapter 211, Sub- Chapter A., Texas Local Government Code, and Section 11.300 and Section 11.400, Code of Ordinances (1995 Edition), City of Round Rock, Texas concerning public notices, hearings, and other procedural matters has been fully complied with, Now Therefore BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: That the Official Zoning Map adopted in Section 11.401(2)(a), Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended so that the zoning classification of the property described in Exhibit "A" is hereafter designated as District SF -2 (Single Family- Standard Lot). II. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. 2. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Consider an ordinance rezoning 20.073 acres of land from District OS (Open Space) to District SF -2 (Single Family- Standard Lot). (9500 Wyoming Springs Drive) (First Reading) Department: Planning and Community Development Staff Person: Jim Stendebach, Planning and Community Development Director Justification: The developer is requesting that 20.073 acres of land currently zoned OS (Open Space) District be rezoned to the SF -2 (Single Family- Standard Lot) District. This tract is abutting Wyoming Springs Rd to the west and Behrens Ranch Parkway to the north. Both the developer and the HOA have held several meetings with the neighbors to secure support of the rezoning. The developer is proposing to rezone the tract and subdivide 82 single - family lots. These lots are similar in size to the surrounding existing sections of the Behrens Ranch Subdivision. Historically, the land was zoned single family. The proposed rezoning back to single family complies with the City's land use policies. Funding: Cost: N/A Source of funds: N/A Outside Resources: Jim Meredith, President of Behrens Subdivision. Ltd. Background Information: A rezoning request for 240 acres of land was approved by City Council on February 24, 2000 from SF -1 District (July 1986 Ordinance #881) and SF -2 District (September 1999 Ordinance #Z- 99- 23 -9D1) to OS District for the specific use of a Golf Course. However, the developer has determined that due to financial issues, a golf course will riot be feasible. He therefore applied for a zoning change in February 2004 and received a recommendation for disapproval by the Planning and Zoning Commission due to neighborhood opposition. Since that time, the developer has settled a lawsuit with a number of the neighboring property owners who are now in support of the rezoning. The remaining 240 acres of OS will be deeded to the City and maintained as parkland. The zoning change request was again presented to the Planning and Zoning Commission in March 2005 and received a favorable recommendation. Public Comment: Public Notice and a public hearing were held in accordance with the City of Round Rock's Zoning Ordinance. Notification was sent out to neighboring property owners and a public hearing was held on March 23, 2005, at the regular meeting of the Planning and Zoning Commission.
