TO CONTRACT FOR ENGINEERING SERVICES
FIRM: K FRIESE & ASSOCIATES, INC. ("Engineer")

PROJECT: Sam Bass Road 48-inch Water Transmission Main
This Supplemental Contract No. 3 to Contract for Engineering Services is made by and between
the City of Round Rock, Texas, hereinafter called the "City" and K Friese & Associates, Inc.,
hereinafter called the "Engineer".
WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter
called the "Contract," on the 5th day of December, 2019 for the Sam Bass Road 48-Inch Water
Transmission Main Project in the amount of$73,671.00; and
WHEREAS, the City and Engineer executed Supplemental Contract No. 1 on September 24,
2020 to amend the scope of services and to increase the compensation by $318,092.00 to a total
of$391,763.00; and
WHEREAS, the City and Engineer executed Supplemental Contract No. 2 on February 5, 2021
to amend the scope of services and to increase the compensation by $22,503.25 to a total of
$414,266.25; and
WHEREAS, it has become necessary to amend the Contract to modify the provisions for the
scope of services and to increase the compensation by $102,400.00 to a total of$516,666.25;
NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract
is amended as follows:
I.
Article 1, City Services and Exhibit A, City Services shall be amended as set forth in the
attached Addendum To Exhibit A.
II.
Article 2, Engineering Services and Exhibit B, En in>? eering Services shall be amended as set
forth in the attached Addendum to Exhibit B. Exhibit C, Work Schedule shall be amended as set
forth in the attached Addendum to Exhibit C.

III.
Article 4, Compensation and Exhibit D, Fee Schedule shall be amended by increasing by
$102,400.00 the lump sum amount payable under the Contract for a total of $516,666.25, as
shown by the attached Addendum to Exhibit D.
IN WITNESS WHEREOF, the City and the Engineer have executed this Supplemental
Contract in duplicate.

ADDENDUM TO EXHIBIT A
City Services
The City of Round Rock (City) will provide the following information and other
assistance to K Friese & Associates, (Engineer) that the City deems appropriate
and necessary.
1 . Any readily available pertinent existing information relating to the services
to be performed by the Engineer; the City will provide one copy of such
information in a format chosen by the City.
2. Clear direction and/or response to questions or requests made by the
Engineer in the course of the Engineer's performance of services.
3. Timely review of deliverables that have been properly completed and
submitted by the Engineer, and timely provision of comments, if any, to
the Engineer resulting from said reviews.
4. The Owner will perform bid advertising and printing/distribution of bid
documents.
5. The Owner will provide required construction administration and
inspection services outside of the services listed in this Scope of Work.
6. The Owner will provide materials testing and sampling during construction.
ADDENDUM TO EXHIBIT B
Engineering Services
SUPPLEMENTAL SERVICES DESCRIPTION
These Supplemental Services include assisting with easement condemnation hearings and
performing bid, construction, and post construction phase services.
SCOPE OF WORK
Easement Condemnation Hearings Assistance
1. Preparation and Exhibit Creation — KFA will meet with the condemnation attorney to
prepare for the hearings and prepare exhibits for two (2) easements.
2. Condemnation Hearing Attendance - KFA will attend two (2) condemnation hearings
for each of the two (2) easements that have gone to condemnation. It is assumed that
both easements will be settled outside of court and time for trials is not included. If
either of the easements is not settled, an additional Supplemental Services may be
required.
Bid Phase
1. Project Management - This task includes routine communication with the City;
managing manpower, budgets, and schedules; invoicing; and other activities
associated with managing the project.
2. Prebid Conference - KFA will assist the City in conducting one (1) pre-bid conference.
KFA will attend the pre-bid and present the project and assist in answering questions.
3. Bidder Questions - KFA will assist the City in responding to technical questions
received from bidders during the bid phase of the project.
4. Addenda - KFA will assist the City in preparing and issuing required Addenda to the
bidders. Preparation and issuance of two (2) Addenda has been assumed for
budgeting purposes.
5. Bid Opening - KFA will attend the bid opening and will perform all bid tabulation, review
of bids, reference checks, and make an award recommendation.

Construction Phase
1. Project Management - This task includes routine communication with the City;
managing manpower, budgets, and schedules; invoicing; and other activities
associated with managing the project. It is assumed that the construction phase will
be 24 months in duration from Notice to Proceed (NTP) to final completion.
2. Issue "For Construction" Documents - KFA will incorporate addenda items into the
drawings and reissue them as "For Construction" to the City via electronic PDF format.
KFA will also provide the City with four (4) hard copies of half-size conformed plans,
two (2) hard copies of full-size conformed plans, and two (2) hard copies of conformed
specifications.
3. Pre-construction Conference - KFA will attend a pre-construction conference with the
City, Contractor, and other parties as appropriate, and prepare the meeting minutes.
4. Construction Meetings - KFA will attend monthly construction meetings with the City,
Contractor, and other parties as appropriate. For budgeting purposes, we have
assumed 24 meetings.
5. Site Visits - KFA will visit the site to check the progress of the work and verify general
conformance with the project plans and technical specifications. For budgeting
purposes, we have assumed 12 trips separate from site visits made concurrent with
project meetings.
6. Submittal/Shop Drawing Review - KFA will review technical submittals and provide
responses to the Contractor. For budgeting purposes, we have assumed twenty (20)
submittals will be reviewed by KFA.
7. Change Orders - KFA will prepare drawing modifications for Change Orders. The City
will maintain a log of all Change Order items, review all Contractor's requests for
Change Orders. For budgeting purposes, we have assumed four (4) change orders
with a portion requiring minor drawing revisions.
8. Requests for Information - KFA will log and respond to all requests for information
(RFIs) from the Contractor related to possible clarifications of plans and technical
specifications. Twenty (20) RFIs have been assumed.
9. Contract Closeout- KFA will participate in one site visit to determine outstanding items
and document "punch list items". KFA will issue a concurrence letter stating project
acceptance when the contract requirements have been met. When the project is ready

for final inspection and acceptance, KFA will make a second site visit to verify
completion of punch list items and if acceptable, sign the final pay application.
Post Construction Phase
1. Record Drawings — KFA will review the Contractor's and City Inspector's redline as-
built drawings and incorporate any modifications from field directives and change
orders into a complete Record Drawings set. One full size original and one digital copy
(PDF and AutoCAD formats) will be submitted to the City.
