TO CONTRACT FOR ENGINEERING SERVICES

PROJECT: BCRWWS East WWTP TPDES Permit Renewal
This Supplemental Contract No. 2 to Contract for Engineering Services is made by and between
the City of Round Rock, Texas, hereinafter called the "City" and Plummer Associates, Inc.,
hereinafter called the"Engineer".
WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter
called the "Contract," on the 4th day of March, 2022 for the BCRWWS East WWTP TPDES
Permit Renewal Project in the amount of$23,000.00; and
WHEREAS, the City and Engineer executed Supplemental Contract No. 1 on April 22, 2022 to
amend the scope of services and to increase the compensation by $3,150.00 to a total of
$26,150.00; and
WHEREAS, it has become necessary to amend the Contract to modify the provisions for the
scope of services and to increase the compensation by $24,960.00 to a total of$51,110.00;
NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract
is amended as follows:
I.
Article 1. City Services and Exhibit A. City Services shall be amended as set forth in the
attached Addendum To Exhibit A.
II.
Article 2. Engineering Services and Exhibit B. Engineering Services shall be amended as set
forth in the attached Addendum to Exhibit B. Exhibit C, Work Schedule shall be amended as set
forth in the attached Addendum to Exhibit C.
III.
Article 4. Compensation and Exhibit D. Fee Schedule shall be amended by increasing by
$24,960.00 the maximum amount payable under the Contract for a total of$51,110.00, as shown
by the attached Addendum to Exhibit D.

ADDENDUM TO EXHIBIT A
City Services
Per the scope of work documented in Exhibit B — Engineering Service, the City of Round Rock (OWNER)
responsibilities will include the following for the BASIC SERVICES:
• Review water quality data tables provide comments as requested.
• As available, OWNER will provide the ENGINEER any water quality data collected by the OWNER.
ADDENDUM TO EXHIBIT B
Engineering Services
The City of Round Rock(OWNER) has requested Plummer Associates, Inc., (ENGINEER)to assist in securing
Texas Pollutant Discharge Elimination System (TPDES) permit renewal for the Brushy Creek Regional East
Wastewater Treatment Facility (WWTF) Permit No. WQ0010264002. A contract for Engineering Services
to assist the City was signed by the City Manager, Laurie Hadley, on March 4, 2021.
The Brushy Creek Regional East WWTF permit renewal application was submitted to the Texas
Commission on Environmental Quality (TCEQ) on November 14, 2022. The permit renewal application is
currently under administrative review. The OWNER expects comments or protests to the permit
application by the public. This expectation is based on the previous permit application process and the
current public interest in the facility's operation. Additionally, the OWNER has requested a review of
publicly available water quality data collected in Brushy Creek Segment No. 1244, the segment to which
the Brushy Creek Regional East WWTF discharges. These requests are considered Additional Services to
the TPDES permit renewal Engineering Services contract.
ADDITIONAL SERVICE SCOPE
ENGINEER will provide technical or procedural support if the draft permit is protested by the public. This
includes attending meetings with TCEQ, responding to TCEQ's requests for information, and supporting
the OWNER during the permitting process. Should the TCEQ determine that a contested case hearing is
appropriate for the project, ENGINEER will assist in initial strategy discussions with the OWNER to identify
technical and regulatory issues with presenting the case. Contested case assistance beyond initial strategy
is not anticipated to be able to be accommodated in the proposed Additional Services budget. ENGINEER
assumes approximately 92 hours for this task.
Additionally, ENGINEER will prepare a review of available flow and water quality data of Brushy Creek
Segment No. 1244, the segment to which the Brushy Creek Regional East WWTF discharges. This data
review includes accessing data from the United States Geological Survey (USGS) stream gages, Surface
Water Quality Monitoring (SWAM) stations along Brushy Creek, EPA ECHO data for other WWTF
discharges quality to Brushy Creek, and available Receiving Water Assessments completed by TCEQ. If the
OWNER has collected water quality data, ENGINEER will compile and collate the data into the database.
ENGINEER will prepare data tables that include the information from the available flow and water quality
data review. Data will be summarized in the tables using descriptive statistics.
ENGINEER will conduct a visual survey of the upstream and downstream portions of Brushy Creek
Segment No. 1244. The visual survey will provide recommendations for Brushy Creek environmental
improvements, such as bank stabilization, aquatic habitat, or riparian areas. ENGINEER will submit field
notes and a list of areas where stream improvements could be warranted. ENGINEER assumes
approximately 56 hours for this task.

ADDITIONAL SERVICES BUDGET
The Not-to-Exceed budget without prior approval for the Additional Services is $24,960. ENGINEER will
complete the above Additional Service on a time-and-materials basis.

ADDENDUM TO EXHIBIT C
Work Schedule
ENGINEER will initiate work on ADDITIONAL SERVICES upon verbal authorization to proceed from the
OWNER. There will be no change to the existing schedule for the TPDES Permit Renewal application and
the draft permitting process. This timeline for this work is dependent on the TCEQs schedule. The
following deliverables and schedule are anticipated for the water quality data review:
• Prepare a review of publicly available flow and water quality data of Brushy Creek Segment No.
1244, the segment to which the Brushy Creek Regional East WWTF discharges. This data review
includes accessing data from the United States Geological Survey (USGS) stream gages, Surface
Water Quality Monitoring (SWAM) stations along Brushy Creek, EPA ECHO data for other WWTF
discharges quality to Brushy Creek, and available Receiving Water Assessments completed by
TCEQ. ENGINEER will prepare data tables that include the information from the available flow and
water quality data review. ENGINEER will provide water quality data tables to OWNER. This work
will be initiated within four weeks of OWNER approval.
