§ KNOW ALL BY THESE PRESENTS:
COUNTY OF WILLIAMSON §
That the CITY OF ROUND ROCK, a Texas home -rule municipal corporation
(hereinafter called the "Declarant") has executed this Declaration of Right of Way for the
purpose of establishing the location of a portion of Declarant's property to be used for
construction, reconstruction, widening, and maintaining proposed Wyoming Springs Extension
roadway improvements and related drainage and utility relocations in, across and under the
following described property in Williamson County, Texas, to -wit:
All of that certain 0.219 acre (9,532 Sq. Ft.) tract of land in the William Dugan
Survey, Abstract No. 190 and the David Curry Survey Section A, Abstract No.
130, Williamson County, Texas; being more fully described by metes and
bounds in Exhibit "A", attached hereto and incorporated herein; and
All of that certain 0.055 acre (2,387 Sq. Ft.) tract of land in the William Dugan
Survey, Abstract No. 190 and the David Curry Survey Section A, Abstract No,
130, Williamson County, Texas; being more fully described by metes and
bounds in Exhibit "B", attached hereto and incorporated herein.
The aforementioned described property is hereinafter referred to as the "Right of Way".
The Right of Way is subject to any easements, restrictions, reservations, covenants, conditions,
oil and gas leases, mineral severances, and encumbrances for taxes and assepsments (other than
liens and conveyances) presently of record in the Official Public Records of Williamson County,
Texas, that affect the property, but only to the extent that said items are still valid and in force
and effect at this time.
The Right of Way parcel hereby designated shall be used for the purpose of placing,
constructing, operating, repairing, maintaining, rebuilding, replacing, relocating, and removing
Wyoming Springs Extension roadway improvements and related appurtenances, together with all
necessary drainage, utility or any other public uses and purposes as further designated or desired
by Declarant.
Except as otherwise stated, the Right of Way and other rights and privileges hereby
created shall be perpetual. However, it is expressly provided that this Declaration may be
modified, amended, or terminated by Declarant at any time, and without any condition,
requirement or prerequisite to same.
The benefits and obligations of the Right of Way created herein shall constitute benefits
and servitudes running with the land.

A portion of the proposed Wyoming Springs roadway extension near the intersection with Sam Bass Road
will be located on slivers of City property currently used for Fire Station #9. The proposed document will
designate the 0.219 acre and 0.055 acre slivers for right of way use for future Transportation facility
tracking. The designated r.o.w. areas do not conflict with or otherwise impair the continued Fire Station
use or operation.
