R-2023-049 - 2/9/2023 RESOLUTION NO. R-2023-049 WHEREAS, Zoning and Development Code, Chapter 8, Article III, Sec. 8.18, Code of Ordinances (2018 Edition), designates certain trees in the City as Monarch Trees, and WHEREAS, Monarch Trees are protected and may not be removed unless the monarch designation is removed by the City Council, and WHEREAS, William Templeton has submitted a request to remove the monarch designation for a tree located on the proposed development site at 611 Spring Street, as shown on Exhibit "A", Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,TEXAS, That the monarch designation for a tree located on the proposed development site at 611 Spring Street, as shown on Exhibit "A", is hereby removed. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551,Texas Government Code, as amended. Brad Wiseman 301 W. Bagdad Avenue Round Rock, Texas 78664 October 3, 2022 Dear Mr. Wiseman, My name is William Templeton, and I am a resident of Round Rock. My wife and I purchased 611 Spring Street last year in the downtown Round Rock area . The reason for this letter is to request removal of a tree to allow us to build our home. We have three children, one of whom is in her first year of high school in Round Rock, one in college and the other serving in the Army. We would like to build a home that will accommodate all three of our children as well as our mothers in-law, when the time comes. Our goal is to build a five bedroom home approximately 4,000 square feet, but the tree on the property is creating a hindrance. The home is limited to a width of 60ft to oblige the required setbacks, which means our home will have to be deeper. The critical root zone of the tree expands too far to the front of the property where the home must be built, per the MU-2 zone. Additionally, there are utility lines at the front of the property, so our home will need to be pushed back farther than the loft maximum front setback. To overcome these obstacles, we are requesting permission to remove the tree. I appreciate that this will take time and further necessary steps to reach a decision, but we are hoping to move forward with our house plans before year end.
