O-2023-036 - 2/9/2023 I ORDINANCE NO. 0-2023-036 2 3 AN ORDINANCE AMENDING CHAPTER 2, ARTICLE V, CODE OF 4 ORDINANCES (2018 EDITION), CITY OF ROUND ROCK TEXAS, BY 5 AMENDING SECTION 2-326 REGARDING AUTHORITY TO 6 CONTRACT FOR EXPENDITURES; REPEALING ALL OTHER 7 ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT 8 THEREWITH; AND PROVIDING FOR A SAVINGS CLAUSE. 9 10 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, 11 TEXAS: 12 13 I. 14 15 That Chapter 2, Article V, Section 2-326, Code of Ordinances (2018 Edition), City 16 of Round Rock, Texas, is hereby amended to read as follows: 17 ARTICLE V.—FINANCE 18 Sec. 2-326. General authority to contract for expenditures and approve certain change orders. 19 (a) General authority to contract for expenditures. Pursuant to section 4.01(f) of the City Charter, 20 the city manager is hereby authorized to execute contracts and/or to expend funds for budgeted 21 items in the maximum amount of $100,000.00, provided that all such contracts and 22 expenditures are in compliance with state laws requiring competitive bids. All contracts and/or 23 expenditures in excess of$100,000.00 must be approved in advance by the city council. 24 (b) Authority to contract for prior approved expenditures. Pursuant to section 4.01(f) of the City 25 Charter, the city manager is hereby authorized to execute contracts and/or to expend funds in 26 the maximum amount of$200,000.00 for items specifically approved in advance by the council. 27 The council may approve the aforesaid items in an exhibit attached to the annual budget or by 28 resolution adopted by the council. 29 (c) Contract change order. The city manager or his designee may approve change orders under 30 the following conditions: 31 (1) Any change involving a decrease or increase in cost of$50,000.00 or less; and 32 (2) Provided, however, that the original contract price may not be increased by more than 25 33 percent or decreased by more than 25 percent without the consent of the contractor to 34 such decrease. 35 36 II. 37 38 A. All ordinances, parts of ordinances, or resolutions in conflict herewith are 39 expressly repealed. 40 41 0112.20232;4871-8969-0461/ss2 1 B. The invalidity of any section or provision of this ordinance shall not 2 invalidate other sections or provisions thereof. 3 C.
