WHEREAS, Government Code, Chapter 2269 allows governmental entities to use
certain methods other than competitive bidding in entering into contracts for construction of
facilities, and
WHEREAS, pursuant to Government Code, §2269.056(a) the City Council adopted
Resolution No. 2022-247 whereby the Council determined that "Construction Manager at Risk"
is the method which provides the best value for the City for the Griffith Remodel and Paseo
Project at 216 East Main Street (the "Project'), and
WHEREAS, pursuant to Government Code, §2269.253, the City has duly prepared a
request for proposals for the selection of a construction manager at risk and it is the
recommendation of City staff that Braun & Butler Construction, Inc. offers the best value to the
City for the construction of the Project, and
WHEREAS, the Council wishes to accept the recommendation of City staff, Now
Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS,
That Braun & Butler Construction, Inc. is hereby accepted as the construction manager at
risk which offers the best value for the City.
BE IT FURTHER RESOLVED,
That the Mayor is hereby authorized and directed to execute on behalf of the City a
Construction Manager at Risk Agreement with Braun & Butler Construction, Inc. for the Griffith
Remodel and Paseo Project at 216 East Main Street.
The City Council hereby finds and declares that written notice of the date, hour, place
and subject of the meeting at which this Resolution was adopted was posted and that such

meeting was open to the public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted upon, all as required by
the Open Meetings Act, Chapter 551,Texas Government Code, as amended.
