STATE OF TEXAS § COUNTY OF WILLIAMSON § SUPPLEMENTAL CONTRACT NO.5 TO CONTRACT FOR ENGINEERING SERVICES FIRM: K FRIESE & ASSOCIATES, INC. ("Engineer") ADDRESS: 1120 S. Capital of Texas Highway, Building 2, Suite 100, Austin, TX 78746 PROJECT: Kenney Fort Boulevard Extension This Supplemental Contract No. 5 to Contract for Engineering Services is made by and between the City of Round Rock, Texas, hereinafter called the "City" and K Friese & Associates, Inc., hereinafter called the "Engineer". WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter called the "Contract," on the 9th day of April, 2015 for the Kenney Fort Boulevard Extension Project in the amount of $450,961.00; and WHEREAS, the City and Engineer executed Supplemental Contract No. 1 on February 11, 2016 to amend the scope of services and to increase the compensation by $79,745.00 to a total of $530,706.00; and WHEREAS, the City and Engineer executed Supplemental Contract No. 2 on August 22, 2019, to amend the scope of services and to increase the compensation by $505,778.00 to a total of $1,036,484.00; and WHEREAS, the City and Engineer executed Supplemental Contract No. 3 on May 7, 2021, to amend the Contract to modify the provisions for the scope of services and to increase the compensation by $34,206.00 to a total of $1,070,690.00; and WHEREAS, the City and Engineer executed Supplemental Contract No. 4 on May 12, 2022, to amend the Contract to modify the provisions for the scope of services and to increase the compensation by $87,967.00 to a total of $1,158,657.00; and WHEREAS, it has become necessary to amend the Contract to modify the provisions for the scope of services and to increase the compensation by $19,525.00 to a total of $1,178,182.00; NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract is amended as follows: eICl/ZaZ�3-a-a ,pplemental Contract 0199 1511,4870-6725-1034 Rev,06; 16 842'r x Article 1, City Services and Exhibit A, City Services shall be amended as set forth in the attached Addendum To Exhibit A. Exhibit C, Work Schedule shall be amended as set forth in the attached Addendum to Exhibit C. Article 4, Compensation and Exhibit D, Fee Schedule shall be amended by increasing by $19,525.00 the lump sum amount payable under the Contract for a total of $1,178,182.00, as shown by the attached Addendum to Exhibit D. Sandre, City �Attor=ey Rev.06/ 16 84275 ADDENDUM TO EXHIBIT A City Services The City of Round Rock (City) will provide the following information and other assistance to K Friese & Associates (Engineer) that the City deems appropriate and necessary. No, specific items or services are expected. ADDENDUM TO EXHIBIT B Engineering Services UNDERSTANDING K Friese & Associates, Inc. (KFA) will extend the contract time through the end of construction and include additional time for construction progress meetings throughout the remaining schedule. KFA's understanding of the needs consists of the following assumptions: • Weekly progress meetings are schedule through the first eight (8) months • Bi-weekly for the next two (2) months of the project schedule • Monthly for the remaining time of the contract (estimated two (2) months). SCOPE OF SERVICES TASK 3 — CONSTRUCTION PHASE 1. Construction Phase Services — KFA will assist the City of Round Rock with contract administration during the construction phase of the project. We understand the City of Round Rock will provide the required construction inspection services, and have assumed that the construction duration will be approximately 6 months. KFA's services will include: a. Pre -Construction Conference — KFA will attend a pre -construction conference with the City, Contractor, and other parties as appropriate, and prepare the meeting minutes. b. Progress Meetings and Site Visits — KFA will attend regular construction meetings with the City, Contractor, and other parties as appropriate, including preparing the meeting minutes. KFA will visit the site and conduct construction meetings Weekly progress meetings are schedule through the first eight (8) months, bi-weekly for the next two (2) months of the project schedule, and monthly for the remaining time of the contract (estimated two (2) months) when construction is in progress to verify that the work is generally in conformance with the plans and specifications. For budgeting purposes, we have assumed an additional twenty-two (22) meetings/site visits. c. Submittal Review — KFA will maintain a log of all Contractor submittals, track review progress, review and approve submittals, and distribute submittals to the appropriate parties. d. Pay Estimate Review — KFA will review the Contractor's pay estimates after approval by the City of Round Rock's on -site Inspector and make recommendations for payment. e. Preparation of Change Orders — KFA will review all Contractor's requests for Change Orders and prepare Change Orders as appropriate. For budgeting purposes we have assumed five (5) change orders. f. Requests for Information (RFIs) — KFA will provide answers to requests for information (RFI's) from Contractor as related to possible conflicts and B-1 of 2 ADDENDUM TO EXHIBIT B Engineering Services clarifications needed between plans and specifications. An additional five (5) RFI's have been assumed. g. Contract Close-out. KFA will attend a final project walk-thru, document "punch list items," and issue an Engineer's Concurrence for Project Acceptance letter. h. Record Drawings. KFA will use the Contractor's redline as -built drawings to document as -built conditions in the final record drawings. KFA will supply the City of Round Rock with one set of reproducible record drawings and provide one set of record drawings in .pdf format. The first segment of Kenney Fort Boulevard between Joe DiMaggio Boulevard and Forest Creek Drive was completed during the summer of 2013, Future planning for the southern and northern sections of Kenney Fort Boulevard are ongoing. City Staff has been mindful of the future right-of-way needs for this roadway as development progresses and the City plans for future growth. The original contract with K Friese & Associates prepared a preliminary roadway schematic and identified the additional required right-of-way corridor location and configuration of Kenney Fort Boulevard from US79 to Old Settlers Boulevard. The amount of the contract was $450,961.00. Supplemental Contract No. 1 with K Friese & Associates provided Plans, Specifications, and Construction Phase Services for a 24-inch water transmission main to be constructed along Kenney Fort Boulevard from Old Settlers Boulevard to Chandler Creek Blvd. Supplemental Agreement No. 1 was for $79,745. Supplement Agreement #2 allows for the development of 3 separate PS&E packages to allow for the completion of this segment of roadway in multiple phases. Segment 4A, Segment 4B and Segment 4C as described in the Exhibit B document. The final result will be a 6-lane divided arterial section from Joe DiMaggio Blvd to Old Settlers Blvd supplemental agreement No. 2 was for $505,778.00. City of Round Rock Page 1 of 2 Agenda Item Summary Continued CM-2023-070 Supplemental Agreement No. 3 with K Friese & Associates increased the overall length of the proposed 24-inch waterline that will be constructed with the Kenney Fort Boulevard North Extension project. The increased waterline length allows the waterline to be aligned with the proposed project shown in the City's 2020 Water Master plan update. The change required additional waterline design and subsurface utility investigations at two locations. Supplemental Agreement No. 3 was for $34,206. Supplemental Agreement No. 4 with K Friese & Associates is for additional waterline design and the surveying to acquire two parcels to enable the construction of the roadway. The amount for the additional services is $87,967. Utilities portion is in the amount of $ 29,005.00. The remainder is for Surveying in the amount of $58,962.00 and that is a Transportation cost. Supplemental # 5 is for further contract administration, attendance of field meetings and site visits and for preparation of Change Orders. The amount of the additional services is $19,525.00.
