R-2023-177 - 6/8/2023 RESOLUTION NO. R-2023-177 WHEREAS, Zoning and Development Code, Chapter 8, Article III, Sec. 8.18, Code of Ordinances (2018 Edition), designates certain trees in the City as Monarch Trees, and WHEREAS, Monarch Trees are protected and may not be removed unless the monarch designation is removed by the City Council, and WHEREAS, Kimley-Horn and Associates, Inc. has submitted a request to remove the monarch designation for a tree located on the proposed development site at 901 N. Red Bud Lane, as shown on Exhibit"A", Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,TEXAS, That the monarch designation for a tree located on the proposed development site at 901 N. Red Bud Lane, as shown on Exhibit"A", is hereby removed. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Bagdad, Suite 210 Round Rock, TX 78664 RE: Monarch Tree Removal Request Red Bud Industrial-901 Red Bud Lane Round Rock, Texas Dear Mr. Wiseman, Please accept this monarch tree removal request for the Red Bud Industrial site plan per Section 8-18 (c) of the City of Round Rock Code of Ordinances. Red Bud Industrial is a proposed industrial development located on the southeast corner of Red Bud Lane and Dawson Road. The site plan is currently under review with city staff under case number SDP2303-0002. The site falls within the limits of the Red Bud CIP project and is governed by a PUD with base industrial zoning. Two monarch trees (#3488 and #3491)fall within the limits of the proposed Red Bud expansion and are shown to remain on our drawings. The northern driveway for the proposed development was located to preserve Heritage trees#3488 and#3491. The plans have been reviewed and deemed acceptable by Round Rock transportation department and as a result of this coordination with the City both Monarchs will be preserved. We request that Monarch tree#3456 be removed due to its poor condition. The 38" Pecan was thoroughly inspected by a certified master arborist and was found to suffer numerous, extensive decay cavities, including in its primary leader, which has been rendered a hollow decay cavity extending over 7' up the stem. The tree's compromised structure is further evidenced by the several large branches have previously failed, making the tree a hazard to the property. Please reference the included arborist report, summarizing the master arborist's inspection of the decaying tree.
