O-2023-196 - 6/22/2023 1 ORDINANCE NO. 0-2023-196 2 3 AN ORDINANCE AMENDING CHAPTER 18, CODE OF ORDINANCES 4 (2018 EDITION), CITY OF ROUND ROCK, TEXAS, BY AMENDING 5 SECTIONS 18-1 AND 18-2 REGARDING FOOD ESTABLISHMENTS; 6 REPEALING ALL OTHER ORDINANCES AND PARTS OF 7 ORDINANCES IN CONFLICT THEREWITH; AND PROVIDING FOR A 8 SAVINGS CLAUSE. 9 10 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, 11 TEXAS: 12 I. 13 That Chapter 18, Section 18-1, Code of Ordinances (2018 Edition), City of Round 14 Rock is hereby amended to read as follows: 15 CHAPTER 18 - FOOD ESTABLISHMENTS 16 Sec. 18-1. -Texas Food Establishment and Retail Food Establishment Rules adopted. 17 Regulations of food service establishments, retail food stores and mobile food establishments, 18 V.T.C.A., Health and Safety Code ch. 437; and the Texas Administrative Code, title 25, part 1; Department 19 of State Health Services, chapter 229 Food and Drug, subchapter K; Texas Food Establishments, and 20 chapter 228 Retail Food Establishments are hereby adopted by the city. Penalties, conditions and terms of 21 the said Texas Food Establishment and Retail Food Establishment Rules are hereby adopted, and made 22 a part hereof, as if fully set out in this chapter, with the additions, insertions, deletions and changes as set 23 forth in this chapter. 24 25 II. 26 That Chapter 18, Section 18-2, Code of Ordinances (2018 Edition), City of Round 27 Rock is amended to revise the definition of "temporary food establishment"as follows: 28 CHAPTER 18 - FOOD ESTABLISHMENTS 29 Sec. 18-2. — Definitions. 30 Temporary food establishment means a food establishment that operates for a period of no more than 31 14 consecutive days in conjunction with a single event or celebration. 32 1 III. 2 A. All ordinances, parts of ordinances, or resolutions in conflict herewith are 3 expressly repealed. 4 B. The invalidity of any section or provision of this ordinance shall not 5 invalidate other sections or provisions thereof. 6 C. The City Council hereby finds and declares that written notice of the date, 7 hour, place and subject of the meeting at which this Ordinance was adopted was posted s and that such meeting was open to the public as required by law at all times during which 9 this Ordinance and the subject matter hereof were discussed, considered and formally 10 acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government 11 Code, as amended. 12 Alternative 1. 13 By motion duly made, seconded and passed with an affirmative vote of all the 14 Council members present, the requirement for reading this ordinance on two separate 15 days was dispensed with.
