WHEREAS, the City of Round Rock has previously entered into an Interlocal Agreement
("Agreement") with the Williamson County Water, Sewer, Irrigation and Drainage District No. 3 for
emergency water supply, and
WHEREAS, the City now desires to enter into Amendment Number One to the Interlocal
Agreement with Williamson County Water, Sewer, Irrigation and Drainage District No. 3 to amend the
volumetric rate and extend the term of the Agreement,Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,TEXAS,
That the Mayor is hereby authorized and directed to execute on behalf of the City Amendment
Number One to the Interlocal Agreement with Williamson County Water, Sewer, Irrigation and
Drainage District No. 3, a copy of same being attached hereto as Exhibit "A" and incorporated herein
for all purposes.
The City Council hereby finds and declares that written notice of the date, hour, place and
subject of the meeting at which this Resolution was adopted was posted and that such meeting was
open to the public as required by law at all times during which this Resolution and the subject matter
hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act,
Chapter 551, Texas Government Code, as amended.

AMENDMENT NUMBER ONE
TO INTERLOCAL AGREEMENT
FOR EMERGENCY WATER SUPPLY
This AMENDMENT NUMBER ONE TO INTERLOCAL AGREEMENT FOR EMERGENCY
WATER SUPPLY(this "Amendment") is by and between the City of Round Rock,Texas, a home
rule municipality (the "City") and Williamson County water, Sewer, Irrigation and Drainage
District No. 3, a Texas water conservation district (the "District"). The City and District are
collectively referred to herein as the "Parties."
RECITALS
WHEREAS, on the 24`h day of April, 2014, the Parties entered into that one certain
Interlocal Agreement for Emergency Water Supply(the"ILA"); and
WHEREAS, the Parties now wish to amend the ILA;
NOW THEREFORE, in consideration of the mutual covenants and agreements herein
contained,the sufficiency of which is hereby conclusively acknowledged, and subject to the terms
and conditions hereinafter set forth, the Parties mutually agree as follows:
ARTICLE I
DEFINITIONS
Section 1.1 All terms used herein shall have the meanings assigned to them in the ILA unless
the context clearly requires otherwise.
ARTICLE II
AMENDMENTS
Section 2.1 Section 2.05 of the ILA is hereby amended to read as follows:
2.05 Volumetric Rate. The District shall pay to the City the Volumetric Rate which is
equal to twice the lowest residential in-City rate for non-peak billing periods as adopted
and amended by the City Council from time to time. In addition, for each time Emergency
Service is initiated, District shall pay an additional fee of$1,500.00.
Section 2.2 Section 3.01 of the ILA is hereby amended to read as follows:
3.01 Term of Agreement. Unless terminated sooner in accordance with the provisions
herein, this Agreement shall expire on April 23, 2034.
Section 2.2 The contact information for Crossroads Utility Services set forth in Section 3.12 of
the ILA is hereby amended as follows:

ARTICLE III
MISCELLANEOUS
Section 3.1 To the extent necessary to effectuate the terms and provisions of this Amendment,
the ILA is hereby amended and modified. In all other respects,the aforesaid ILA is hereby ratified
and confirmed.
Section 3.2 This Amendment may be executed in counterparts, each of which shall be an
original and all of which together shall constitute but one and the same instrument.
IN WITNESS WHEREOF,the Parties hereto acting under the authority of their respective
governing bodies have caused this Amendment to be duly executed as the _ day of ,
