WHEREAS, the City of Round Rock ("City") desires to purchase a modular office building
for the Brushy Creek East Regional Wastewater Treatment Plant; and
WHEREAS, Chapter 271, Subchapter F of the Texas Local Government Code allows for local
governments to participate in cooperative purchasing programs with other local governments; and
WHEREAS, the Buy Board Cooperative Purchasing Program ("Buy Board") is a cooperative
purchasing program administered by the Texas Association of School Boards for the purpose of
procuring goods and services for its members; and
WHEREAS, the City is a member of Buy Board; and
WHEREAS, Palomar Modular Buildings LLC is an approved vendor of the Buy Board; and
WHEREAS, the City wishes to issue a purchase order to Palomar Modular Buildings LLC to
purchase said goods through Buy Board, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the City Manager is hereby authorized and directed to issue a purchase order to Palomar
Modular Buildings LLC for the purchase of a modular office building.
The City Council hereby finds and declares that written notice of the date, hour, place and
subject of the meeting at which this Resolution was adopted was posted and that such meeting was
open to the public as required by law at all times during which this Resolution and the subject matter
hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act,
Chapter 551, Texas Government Code, as amended.

Office Buildings (nominal dimensions), manufactured, delivered, and set in Round Rock, TX is based on the
attached specifications and floor plan. BuyBoard Contract 637-21
1. The purchase price for the office without restrooms as specified is $178,503. The price does not include poured
concrete footers, canopies, handicap ramps, steps, gutters, appliances, self-contained fire alarm, low voltage
equipment, utility hookups, site work, taxes or permits. It is assumed that the site can support the building, is
relatively level and easily accessible.

2. The building will be built in compliance with the International Building, Plumbing and mechanical codes,
Americans with Disabilities Act, and the National Electric Code. The building will be engineered to meet local floor
and roof load requirements and will have electrical, heating and cooling loads sized in accordance with code. Cost
to comply with local codes beyond the attached floor plan and specifications is the responsibility of the owner.
3. Due to the volatility in lumber and other commodity markets we can only honor prices for 30 days.
4. Our payment terms are 50% due upon execution on PO or Contract, 40% due upon completion of
manufacturing at PMB and 10%when the building is accepted or occupied, whichever comes first.
