WHEREAS, the Brushy Creek Regional Utility Authority, Inc. ("BCRUA") has
previously determined in Resolution No. R-23-03-22-6A that "Competitive Sealed Proposal" is
the delivery method which provides the best value for the Underwater Pipeline Improvements
Project, and
WHEREAS, after advertising for and receiving proposals from offerors, the BCRUA
determines that Thalle Construction Company, Inc. is the offeror which offers the best value for
the BCRUA for the Underwater Pipeline Improvements Project, and
WHEREAS, the Board of Directors of the BCRUA now wish to enter into a construction
contract with Thalle Construction Company, Inc., Now Therefore
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BRUSHY
CREEK REGIONAL UTILITY AUTHORITY:
That, after advertising for and receiving proposals from offerors, the BCRUA hereby
finds that Thalle Construction Company, Inc. is the offeror which offers the best value for the
BCRUA.
BE IT FURTHER RESOLVED,
That, subject to the approval of the Participating Cities, the Board President is hereby
authorized and directed to execute on behalf of the BCRUA a construction contract with Thalle
Construction Company, Inc. for the Underwater Pipeline Improvements Project.
The Board of Directors hereby finds and declares that written notice of the date, hour,
place and subject of the meeting at which this Resolution was adopted was posted and that such
meeting was open to the public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted upon, all as required by
the Open Meetings Act, Chapter 551,Texas Government Code,as amended.

Dear Ms. Bondy:
On August 2, 2023, Walker Partners assisted the BCRUA in opening competitive sealed proposals for the above referenced
project. Two responsive, competitive sealed proposals were submitted by Thalle Construction Company, Inc. (Thalle) of
Hillsborough,NC and CAYO, LLC(CAYO)of Fort Worth,TX. Neither of the proposals included any deviations from the contract
documents.The proposals were evaluated and ranked based on the following selection criteria:30%for Contractor Relevant
Experience and References, 60%for Cost Proposal, and 10%for Proposed Schedule. Based on evaluation of the proposals,
Thalle is the highest ranked proposer offering the best value,as determined by the selection criteria and ranking assessment.
Evaluation of Thalle's proposal included a review of their technical qualifications and experience, including major
subcontractors.A background check was performed based on feedback from owners and engineering firms for similar projects
the Thalle team has completed and is in the process of completing. The overall impression from this review is that Thalle
provides quality work in a timely and professional manner.Also,our Walker Partners/BCRUA team has recently completed a
successful BCRUA Underwater Pipeline Emergency Repairs with the Thalle team,who have direct knowledge and experience
working on the existing underwater pipeline.
Based on the information presented and evaluation of the proposals,Walker Partners recommends that the BCRUA award a
contract to Thalle for the total Base plus Allowance Proposal amount of $6,710,000.00 for the Underwater Pipeline
Improvements.We will prepare the Notice of Intent to Award Letter and other contract documents for transmittal to Thalle,
pending final acceptance and direction from the BCRUA.

ITEM: 6D. Consider a resolution authorizing the President to execute a
Construction Contract with Thalle Construction Co. for the Underwater
Pipeline Improvements Project.

BACKGROUND:
BCRUA is replacing approximately 1,400 feet of a 36-inch underwater pipeline that conveys raw water
from the floating intake barge, This project also repairs several large raw water valves.To expedite the
project, BCRUA pre-purchased the pipe materials in April.
Proposals were opened for this project on August 2, 2023. Responsive Competitive Sealed Proposals
(bids) were received from Thalle Construction Co, Inc and CAYO, LLC(see attached).The rank order of
the Base plus Allowance Proposal amounts was as follows:
Thane Construction Co, Inc. $ 6,710,000.00
CAYO, LLC $12,034,580.00
Based on the recommendation of our design engineer,Walker Partners, the lowest responsive bid was
from Thalle Construction Co, Inc.
Staff,the Operating Committee (OC), and Walker Partners met on August 9, 2023 and agreed
unanimously to recommend award of this contract to Thalle Construction Co, Inc. in the amount of
$6,710,000.00.
FUNDING:
BCRUA obtained$5 million American Rescue Plan Act Funds from Williamson County.The remainder of
the project cost will be funded by local funds from each city, $499,000 for Leander and $285,000 each
for Cedar Park and Round Rock.
Since the contract award will exceed the BCRUA's authorized maximum of$500,000, per the Master
Agreement, Board approval of this contract will need to be contingent on approval by all three BCRUA
member city councils.
Staff, OC representatives, and representatives of Walker Partners will be available to answer any Board
questions.
