BCRUA_08-07-29-6A RESOLUTION NO. 0�- d 7-2cl,Le P WHEREAS, the Brushy Creek Regional Utility Authority ("BCRUA"), on behalf of the cities of Cedar Park, Leander and Round Rock, is planning a regional water utility system ("System"), and WHEREAS, the System requires the use of easements across a tract of public land designated and used as a park, namely Veterans Memorial Park in Cedar Park, and WHEREAS, §26.001 of the Texas Parks and Wildlife Code requires that prior to the BCRUA approving the use of the easements across the aforesaid public land, the BCRUA must determine that (1) there is no feasible and prudent alternative to the use of such land and (2) the System includes all reasonable planning to minimize harm to the land, and WHEREAS, in accordance with §26.001 of the Texas Parks and Wildlife Code, after due notice and publication, a public hearing on the aforesaid proposed easements was held on the 191h day of February, 2008, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BRUSHY CREEK REGIONAL UTILITY AUTHORITY, INC., 1) That there is no feasible and prudent alternative to the use of easements across Veterans Memorial Park, and 2) That the plans for the System include all reasonable planning to minimize any harm to said parks. The Board of Directors hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. 00129854 RESOLVED this of 'qday of July, 2008.
