The Engineer is hereby directed to make the following changes in the Contract: 1. Continued construction phase services ADD OR DEDUCT$40,000.00 TOTAL(Items 1 -2) ADD OR DEDUCT$ 40,000.00 NOTE: This Change Order increases the Not To Exceed Amount of LAN's Construction Phase Services Contract. It does not increase the scope of work nor the time. The increase in the NTE amount is due to the additional engineering work to resolve the Gann Ranch Tunnel Grout issue. The cost of this engineering work is expected to be reimbursed to BCRUA by the construction contractor. All work under this contract remains Time and Materials. However, due to this additional work - the current NTE amount may be exceed by LAN as reflected in their current contract; consequently BCRUA needs to increase the NTE amount of the Contract even though BCRUA will be reimbursed for this additional work caused by the construction contractor error. A LEO A DALY COMPANY February 14, 2012 Mr. Michael Thuss, PE BCRUA 1906 Hur Industrial Boulevard Cedar Park, TX 78613 RE: Treated Transmission Main Segment 1 SA3 —Additional Construction Phase Services for Contractor Variances Mr. Thuss: The above referenced project has experienced two distinct issues that have caused LAN to perform above outside our initial scope of services for construction phase. These issues are described below: Cathodic Protection System. Initial Field Testing of the CP system and subsequent CP report did not provide adequate information to verify the CP system was functioning and providing Cathodic Protection as defined by the NACE Standards. Initial testing did reveal that the liner at Lakeline was shorted to the carrier pipe. Due to the inadequate or ambiguous data, a second round of field testing was performed. This testing confirmed that the liner is shorted to the carrier pipe. The Contractor performed additional testing and provided a proposed resolution to the shorted casing. LAN/V&A approved the proposed resolution in concept, however, we did identify what appeared to be a calculation error which impacted the number and size of additional anodes needed. Our recommendation to SJ Louis was to verify Corrpro's design, revise as required and proceed with the proposed solution, with the understanding that final testing would be required to verify the additional anodes are providing adequate CP per NACE standards. Items that are considered additional effort include: 1. Second round of field testing—This was required because SJ Louis/Corrpro did not provide the adequate test data during the first field testing to verify cathode protection. In addition,they performed much of the testing prior to V&A's arrival. 2. Review of 2 proposed resolution for shorted casing. 3. Anticipated third round of field testing to verify cathodic protection of shorted casing Gann Ranch Tunnel Grout Issue. After confirming that the annular grout installed at the Gann Ranch tunnel was deficient, LAN and Brierley reviewed the liner design and existing soil conditions and provided an opinion regarding the potential for settlement and failure of the roadway due to the deficient grout. Mitigation options were developed and estimated costs associated with the mitigation provided. LAN coordinated with COCP and BCRUA to determine the acceptable mitigation. Upon receipt of the Contractor's formal response to the deficiency, LAN prepared a response and recommended monetary restitution in an amount equal to 1) Additional Engineering Costs and 2) Estimated Cost of the acceptable mitigation as determined by BCRUA and COCP. Currently the Contractor is performing their own analysis and it is anticipated they will provide an alternative resolution. Based on these additional efforts and anticipated effort remaining, LAN is requesting an additional $40,000, time and materials not to exceed, to see these issues through their conclusion.
