GM-12-03-30-040RIGHT OF ENTRY AGREEMENT Owner: Gary L. Gross and Cathy L. Gross 16613 Jackson Street Volente, TX 78641 Property: Travis County Appraisal District Property 10 176511 (REF 100172550107), Legal Description: Lots 11 and 12, Lake Travis Subdivision No. 2 and part of Lot 1, Lake Travis Subdivision No.6, more fully described in Deed recorded in Volume 11546, Page 1498 of the Official Public Records of Travis County, Texas In consideration of $2000.00, which will be credited to the final purchase price at closing if the property is acquired, and other good and valuable consideration from the Brushy Creek Regional Utility Authority (BCRUA) to the Owner, Owner grants a Right of Entry upon the Property to the BCRUA, its agents and contactors, upon the following terms and conditions: 1. The undersigned acknowledges that the BCRUA is conducting studies in preparation for construction of a deep water intake facility and necessary appurtenances. 2. BCRUA, its employees, agents and contractors, may enter upon the Property from and after the date of execution of this document for a period not to exceed eleven (11) months for the purposes of boundary (ground) surveying, tree surveying, environmental site assessment, archaeological surveying and geo-technical analysis and testing. 3. BCRUA agrees that it will limit removal and/or trimming of any trees on the property and will coordinate with Owner prior to this occurring. 4. BCRUA agrees to notify the owner by phone at least 48 hours prior to entering onto the property. 5. BCRUA agrees to restore the Property, as far as practical, to its previous condition upon the completion of activities under this agreement, and the BCRUA agrees to indemnify the Owner for any damages caused by its employees, agents or contractors. 6. The right of entry is not revocable for the term herein granted. 7.
