Phase 2 Deep Water Intake Preliminary Design
Dear Mr. Gallier,
HDR Engineering, Inc. (HDR)and the Brushy Creek Regional Utility Authority(BCRUA)entered
into a professional services agreement approved by the BCRUA Board on November 19, 2014 for
preliminary design of the Phase 2 Deep Water Intake. The purpose of Supplemental Amendment
No. 3 is to prepare easements for two monitoring wells installed on private property during the
geotechnical data collection program. The easements will require metes and bounds surveys.
HDR's services will include the tasks described in the accompanying Exhibits. The total
compensation for the scope of services will not exceed $27,000. Supplemental Amendment No. 3
increases the total compensation amount of Task 3.0—Right-of-Way and Land Acquisition to
$76,100 and Task 11.0—Surveying and Mapping to$131,800 thereby increasing the total
compensation amount of the Agreement to$6,393,600. If it becomes apparent that the
compensation amount will be exceeded, HDR will give written notice of thereof for BCRUA's
consideration.

ADDENDUM TO EXHIBIT B
ENGINEERING SERVICES
GENERAL
The purposes of Supplemental Amendment No. 3 negotiate, survey, and obtain two
easements for monitoring wells.
BASIC SCOPE OF SERVICES
Task 3.0— Right-of-Way and Land Acquisition
Insert Task 3.4 as follows:
3.4 Monitoring Well Easements. Obtain two monitoring well easements at the
locations of borings LB-1 (Attwood) and 1-13-7 (Trails End Road Homeowners
Association).
3.4.1 Negotiate terms of conveyance, provide comparative market analysis
for BCRUA approval as needed, and maintain a log of contract with the
property owners.
3.4.2 Obtain services of Title Company to provide lien reports, review the
reports, restrictive covenants, and other land restrictions, remove non-
pertinent abstracts of judgment and M&M liens, if any.
3.4.3 Prepare request for and delivery of funds for the conveyance.
3.4.4 Record conveyance instruments with the County Clerk.
Task 11.0—Surveying and Mapping
Insert Task 11.5 as follows.
11.5 Easement Descriptions for LB-1 and LB-7. Survey two easements and prepare
final survey documents signed and sealed by a Registered Professional Land
Surveyor.
11.5.1 Recover project survey control and establish two additional project
control points (5/8" iron rods) and tie to the primary project control.
11.5.2 Draft plats for two easement descriptions. The plats will be prepared on
8.5" x 11: pages at scales to be determined based on the easement size.
A closure computation will be prepared for the plats.
11.5.3 Prepare a field note (metes and bounds) description for the proposed
easements. A closure computation will be prepared for the descriptions.

WORK SCHEDULE
No changes to the overall Work Schedule are required. Task 3.4 and 11.5 will be
completed with 60 days of Notice-to-Proceed.

FEE SCHEDULE
The total compensation for services under Supplemental Agreement No. 3 is estimated
to be $27,000. Total compensation for the Phase 2 Deep Water Intake Preliminary
Design shall be adjusted to be$6,393,600.
Total compensation for Task 3.0— Right-of-Way and Land Acquisition shall be increased
by an amount of $15,500. Total compensation for Task 3.0 — Right-of-Way and Land
Acquisition (Paragraph D1.01.A.3) shall be adjusted to be$76,100.
Total compensation for Task 11.0 — Surveying and Mapping shall be increased by an
amount of $11,500. Total compensation for Task 11.0 — Surveying and Mapping
(Paragraph D1.01.A.11) shall be adjusted to be$131,800.

Please see below, and the attached Addendum for Supplemental Amendment#3 from HDR for out of scope
assistance that was needed by LAN to provide surveying, mapping and easement development/negotiations
for monitoring well easements LB-1 (owner: Attwood), and LB-& (owner: Trails End Road Homeowners
Association.
You may recall we had extended internal discussions about these complex and difficult negotiations which
were required in order to gain access for critical test well boring sites.
Given the cost of$27,000, I'll proceed to authorize this supplemental amendment on my authority, assuming
Steve Sheets has no objections, and assuming the OC concurs.

Supplemental Amendment No. 3 is attached for your consideration. I have owed you SA3 for some time. SA3 is for the
development of easements for monitoring wells placed at LB-1 (Attwood) and L13-7 (TER HOA). It covers additional out-
of-scope work performed by LAN to negotiate and develop the easements as well as additional survey work by SAM to
prepare metes and bounds descriptions for the easements. The survey work to develop the metes and bounds
descriptions is rather difficult despite the small size of the easements because the surveyor will need to tie to property
corners and the Attwood property in particular is very large.
