WHEREAS, BCRUA and Engineer executed a Contract for Engineering Services, hereinafter called the"Contract," on the 28th day of September, 2022 for the Emergency Repair of the Phase IA, Contract 2 Raw Water Pipeline Project in the amount of$75,200.00; and WHEREAS, BCRUA and Engineer executed Supplemental Contract No. 1 on January 12, 2023 to modify the provisions for scope of services and to increase the compensation by $48,200.00 to a total of$123,400.00; and WHEREAS, it has become necessary to amend the Contract to modify the provisions for the scope of services and to increase the compensation by $49,050.00 to a total of$172,450.00; NOW THEREFORE, premises considered, BCRUA and the Engineer agree that said Contract is amended as follows: 1. Article 2 Enizineering Services and Exhibit B, Engineering Services shall be amended as set forth in the attached Addendum To Exhibit B. Exhibit C, Work Schedule shall be amended as set forth in the attached Addendum To Exhibit C. II. Article 4, Compensation and Exhibit D, Fee Schedule shall be amended by increasing by $49,050.00 the maximum amount payable under the Contract for a total of $172,450.00, as shown by the attached Addendum to Exhibit D. By; at,,ti Karen Bondy, Genera anager 3/14/2023 Date APPROVE A TO F0104 By: —4;zld) Stephan L Sheets, BCRUA Attorney ADDENDUM TO EXHIBIT B Engineering Services GENERAL The purpose of Supplemental Amendment No. 2 is to assist Owner with repairing a failure to the raw water line and investigate modifications to the raw water pump variable frequency drives and reduced voltage soft starters to reduce pressure variations during starting and stopping of pumps. BASIC SCOPE OF SERVICES Task 3—Support for Repair of Raw Water Line and Electrical Evaluations 2.1 Project Administration and Meetings. Manage and coordinate staff resources and project planning and prepare monthly invoices. Conduct coordination meetings with Owner as needed. 2.2 Support for Raw Water Like Repair 2.2.1 Support Owner and its legal counsel in negotiating and preparing Contractor agreement forms and general conditions. Since time is of the essence and the repair of the pipeline is exempt from competitive bidding requirements, bid documents including drawings and specifications are not being prepared. 2.2.2 Review inspection photographs and video to develop repair plan with Contractor. 2.2.3 Provie information and assistance as needed to indicate the scope and extent of the Work to be performed and furnished by the Contractor. The repair plan will incorporate the use of materials on hand or that are readily available to the Contractor to the extent possible to minimize schedule impacts. 2.2.4 Consult with Owner and act as Owner's representative as provided in the General Conditions. 2.2.5 Make visits to the Site as the Engineer deems necessary to observe the progress of Contractor's work as an experienced and qualified design professional. 2.2.5 Provide construction sequencing requirements to the Contractor as needed. 2.2.7 Receive, review and determine the acceptability of schedules that the Contractor submits. Coordinate with Owner to develop schedule for shutdown and startup activities. 2.2.8 Review Contractor applications for payment and supporting documentation. 2.2.9 Coordinate with Owner and Contractor to operationally test the pipeline after repairs are complete and place the line in service. 2.2.10 Engineer shall not be required to sign any documents, no matter by whom requested, that would result in the Engineer having to certify, guarantee,or 3/10/2023 01-51 ,Fenalker Partners gineers + surveyors warrant the existence of conditions whose existence the Engineer cannot ascertain. Owner agrees not to make resolution of any dispute with the Engineer or payment of any amount due to the Engineer in any way contingent upon the Engineer signing any such documents. 2.2.11 It is recognized that neither Engineer nor the Owner has control over the cost of labor, materials or equipment; over the Contractor's methods of determining bid prices; or over competitive bidding, market or negotiating conditions. Accordingly, Engineer cannot and does not warrant or represent that bids or negotiated prices will not vary from the Owner's Project budget or from any opinion of construction cost or evaluation prepared or agreed to by Engineer. 2.2.12 Engineer shall not be responsible for the acts of omissions of the Contractor, or of any subcontractors, suppliers, or other individuals or entities performing or furnishing any of the Work. Engineer shall not be responsible for the failure of any Contractor to perform or furnish the Work. 2.3 Pump Motor and Control Evaluation 2.3.1 Record drawing investigation. Review record drawings of one line diagrams, pumps, motors, VFD, and reduced voltage soft starters to develop recommended VFD and soft starter settings. 2.3.2 On-Site Optimization. 2.3.2.1 Subcontract Five Star Electric to assist with the Benshaw soft starter and Siemens VFD programming. 2.3.2.2 Implement and tune recommended settings to achieved reduced pressures during pump start and stop. 2.3.2.3 Up to 4 on-site trips have been accounted for as this process is unlikely to be completed in a single day or single trip. 2.3.3 Design Power Down System. 2.3.3.1 Determine feasibility of adding backup power to the existing system to enhance utility disturbance ride through and to allow controlled pump stop in a complete power failure scenario. 2.3.3.2 If feasible, provide drawings and specifications for backup power. 3/10/2023 (DWaler Partners engineers + surveys +s ADDENDUM TO EXHIBIT C Work Schedule It is anticipated that Basic Services will be required for a duration of approximately two months. 3/10/2023 QWAer Partners engineers * surveyors ADDENDUM TO EXHIBIT D Fee Schedule Total compensation for services under Supplemental Amendment No. 2 is estimated to be$49,050.
