WHEREAS, the Brushy Creek Regional Utility Authority, Inc. ("BCRUA") has duly
advertised for bids for the construction of the Interim Floating Intake Facilities Project, and
WHEREAS, Excel Construction Services, LLC has submitted the lowest responsible
bid, and
WHEREAS, the BCRUA desires to enter into a Construction Contract with Excel
Construction Services, LLC, Now Therefore
BE IT RESOLVED BY THE BRUSHY CREEK REGIONAL UTILITY
AUTHORITY,
That, subject to the approval of the Participating Cities, the Board President is hereby
authorized and directed to execute on behalf of the BCRUA a construction contract with Excel
Construction Services, LLC for the Interim Floating Intake Facilities Project.
The Board hereby finds and declares that written notice of the date, hour, place and
subject of the meeting at which this Resolution was adopted was posted and that such meeting
was open to the public as required by law at all times during which this Resolution and the
subject matter hereof were discussed, considered and formally acted upon, all as required by the
Open Meetings Act, Chapter 551, Texas Government Code, as amended.

Dear Mr. Thuss:
Bids were received for the subject project at Cedar Park City Hall on August 26, 2010 at 2:00 pm. Enclosed is the
bid tabulation form, which shows the five (5) bids that were received. Bidders were allowed to submit on the Base
Bid only (Modify Existing Barge), Alternate Bid only (Furnish New Barge) or both the Base Bid and Alternate Bid.
The low bidder is Excel Construction Services, LLC (Excel Construction) of Leander, Texas, for the Alternate Bid.
Jacobs has reviewed the information submitted by all bidders. It is our opinion that Excel Construction is qualified
to perform the required scope of work. It is also our opinion that the low bid submitted by Excel Construction is a
fair and reasonable amount for the scope of work to be performed, and provides the best value for BCRUA. We
hereby recommend award of the contract to Excel Construction in the amount of $3,807,500.00.
