WHEREAS, the Brushy Creek Regional Utility Authority, Inc. ("BCRUA") has
previously entered into a contract ("Contract") with Excel Construction Services, LLC for the
BCRUA Interim Floating Intake Facilities Project, and
WHEREAS, the BCRUA has determined that it is necessary to make
adjustments/changes to the quantity of work to be performed or materials, equipment, or supplies
to be provided, and
WHEREAS, it has been determined that it is necessary to adjust/change the quantities in
said Contract in accordance with the attached Quantity Adjustment/Change Order No.4, Now
Therefore
BE IT RESOLVED BY THE BRUSHY CREEK REGIONAL UTILITY
AUTHORITY,
That the Board President is hereby authorized and directed to execute on behalf of the
BCRUA, Quantity Adjustment/Change Order No.4 to the Contract with Excel Construction
Services, LLC for the BCRUA Interim Floating Intake Facilities Project, a copy of same being
attached hereto as Exhibit "A" and incorporated herein for all purposes.
The Board hereby finds and declares that written notice of the date, hour, place and
subject of the meeting at which this Resolution was adopted was posted and that s?ch meeting
was open to the public as required by law at all times during which this Resolution and the
subject matter hereof were discussed, considered and formally acted upon, all as required by the
Open Meetings Act, Chapter 551, Texas Government Code, as amended.

This quotation includes the following services and materials:
• Conduits with associated fittings, mounting hardware as required.
• Wiring and tenninations for power and control.
• Subcontractor services for instrumentation procurement and installation (see attached).

• Equipment costs for high work (ladders, scaffolds, platform lift, snorkel 11ft, bucket truck).

This quotation does not include any of the following:
• Concrete base for the tower at the Cedar Park WTP site.
• Geotech studies I bores to determine existing soil conditions at tower location.
• Concrete pad for the solar power equipment at the standpipe site (need 6ft x 6ft).
This quotation is qualified upon the following assumptions:
• Our quote for the tower states that any increase in metals cost between the time of quotation
and the point of release will be passed onto the Contractor, in the event we experience an

which extends above ground from the old Twin Creeks barge. Pipe shall be
removed at the sleeve where it transitions from above ground installation to buried
installation. Note: Abandonment in place of buried portion is included in
original scope of work (see note on Sheet 1C02).

Justification:
This change order is required to transition the entire BCRUA Raw Water Telecommunications System to a
4.9 GHz frequency. This will also alleviate any interference with other telecommunication systems in the
area. This change order also upgrades the lumber banding for the new barge to composite wood
banding, as well as removing and disposing of 200 LF of existing 16"ductile iron pipe that was originally
to be abandoned in place at the request of City of Cedar Park.
Funding:
This change order is for an additional $207/768.00/ revising the total contract amount to $4/139/090.82.
Funding for this change order is from the project's contingency.

Morales Company is pleased to provide change pricing in response to the engineers CPR-9:
This quotation includes the fol.lowing services and materials:
• Conduits with associated fittings, mounting hardware as reqUired.
• Wiringand terminations for powerand control.
• Subcontractor services for instrumentation procurement and installation (see attached).
• Equipment costsfor smalltools (benders,drills,saws).
• Equipment costsfor highwork (ladders,scaffolds,platformlift,snorkel lift,bucket truck).
• The quote below includes the credit amountto changethe antenna conduits at the WTP site
as discussed in the meeting from (2) 2-conduits to (1) 1"conduit (valued at <$2,850».
This quotation does not includeany ofthe following:
• Concrete base for the tower at the CedarParkWTP site.
• Geotech studies I boresto detennine existing soil conditions at tower location.
• Concrete pad for the solar power equipment at the standpipe site (need 6ft x 6ft).
This quotation is qualified upon the following assumptions:
• Our quote for the tower states that any increase in metals cost between the time of quotation
and the point of release will be passed onto the Contractor, in the event we experience an
increase in the metals cost for the tower, we reserve the right to pass that expense onto the
Owner.
• Note clarification on Neltronics proposal in regard to the sizing of the Solar equipment.
We reviewed the scope in detail between TMC, Neltronics, and JTS and were able to identify some
overlapping costs. Total cost for the additional work associated with this change is $177,117.00.

Enclosed is the response from Excel Construction Services, LLC (Excel), dated September 2,2011, to
CPR #13. Jacobs Engineering Group, Inc. has reviewed the cost information submitted by Excel. It
is our opinion that the total cost for the added scope of work is fair and reasonable. IfBCRUA
accepts this cost proposal, a total of $3,113.00 will be incorporated into the next change order. Excel
also states that 2 calendar days will be required for the added scope of work. However, the additional
days will not be included in the change order, and the substantial completion date for the overall
project will not change.
