This Suppleanenlal Contract No. 2 to Contract for Engineering Seavices is made by and between
Ula BRUSI-IY CREEK REGIONAL UTILITY AUTHORITY, INC_, hereinafter called
"BCRUA"and CDM SMITId INC.,hereinafter called the"Engineer".
WHEREAS, BCRUA and Eaaginecr executed a Contract for Enginccring Services, hereinafter
called the "Contract", on the 18th day of November, 2009 For the BCRUA Water Treatment
Plant — Phase lA Project, Conslraction Phase Engineering Service-s in the amount of
$2,913,038.00;and
WHEREAS,BCRUA and Engineer executed Supplemental Contract No. I on June 19, 2013 to
amend the scope of services and to increase the compensation by $294,531.00 to a total of
$3,207,SG9.00;and
WHEREAS, it bas become necessary to amend the Contmct [o modify tlu: provisions for the
scope of services and to incaease[he coprpensa[ion by$368,796.00 to a total of$3,576,365.00;
NOW THEREFORE, premises considered, BCRUA and the Engiueer agree that said Contazact
is amended as follows:

forth in the attached Addeaadum To Hxhibit B. Exhibit C_ Work Schedule shall be amended as
set foath in the attached Addendum To Exhibit C.

Article 4_ Compensation and Exhibit D. Fee Schedule shall be amended by increasing by
$368,796.00 the lump sum amount payable under the Contract for a total of$3,576,365.00, as
shown by the attached Addendum to Exhibit D_

1. Services und¢r the G¢neral Construction Phase involve consulting with and advising the
AUTHORIf'Y during coxistruction and are limited to those services assodated with performing
as the AUTHORITY'S representative,including:
a. Prepare monthly bill'�g rate time and materials invoice zeporffi including:expenditures to
date,cost to-budget ixiformation,with direct cost backup information submitted for out-oF
town aiffi visits only_
b. Prepare For and participate in a preconstruclion conference on b¢half of the AUTHORITY.
c. Receive,review,and provide written comment on the ad¢quacy of the Contractor's
Schedule of Values,Submittal Schedule and Construction Schedule.
d. Rec¢iv¢,revi¢w,and provide written comment an Contractor-prepared submittals
including shop drawings,samples and OBrM Manuals. For this effort'ENGINEER
antidpates about 1600-1500 submittals however,ENGINEER has only budgeted 1,400
submittals due M budg¢tary constraints. ENGINEHR assumes that AUTHORI"l'Y will
augment ENGIIVEER's budget from Contractor per Articl¢6.2.6 of Supplemental Gez+eral
Conditions,Section OOSOD,for repetitive submittal reviews.
e_ Review laboratory,shop,and mill best reports on materials and equipment
£ Receive,review and provide written response to all Contractor-generated R¢qu¢ats for
Ixtformation(RFI)and Requests for Deviation(RPD). For this effort,ENGINEER
anticipates about 500 RFIa and RFDs will be submitt¢d by the Contractor.
g. Visit the project sit¢as construction proceeds to observe and attend biwe¢kly construction
progress me¢tings-
h Provide construction service-related consultation as necessary to the AUTHORITY Project
Team during the course of coxistruction. Such consultation may inclssd¢,but is not limited
to,the following:
1) Issuing necessary interpretations and clarifications of the Contract Documents and
h¢]ping to resolve interpretation disputes.
2) Assisting in the development of d¢fidency lists as requested by the AUTHORITY,and
making recommendations as to the acceptability of the work.
3) Preparing sketches required to resolve problems due m actual Held conditions
encountered.
4) Reviewing the reasonableness of Contractor-prepared Change Ord¢r Proposals.
i. In conjvncHon with all of the above,prepare Change Order Proposal Requesffi for the
AUTHORITY'S considemtion as necessary bo deliver th¢intent of the Contract Documenffi_
j. Determine amoun[s of progr¢ss paym¢nffi due to Contractor based on degree of
completion of the work determined by AUTHORITY'S inspectors,and recommending

m. Continue coordination with regulatory agencies as requested by AUTHORITY.
n. Monitor scheduling and control systems,process,tools,and resource planning For project
controls. Monitor the flow of information to support project objectives,
o, Review status updates for schedule and costs. Identify potential scheduling conflictr
including utility"shutdown"requirements.
p. Monitor document and records control Foz claims and proper storage at project
completion,Review the contractor's bazeline schedule and cost loaded summary schedule
and any revisions to those schedules, Provide time impact analysis for change orders and
schedule claims analysis.
q. Review contractoz monthly progress schedule updates and compares it to the approved
schedule and makes monthly reports. Analyze and moxtitor coat and schedule trends and
provide an independent assessment of progress and forecast at completion of schedule
and cost.
r_ Provide cost estimates supporting the review and assessment of change requests and value
engineering proposals. Prepare and monitors the operating budget.
s. Additional Onsite Controls(SA7)
1) Provide additional onsite controls as described in Task 1,Items n-r For extended
construction period as requested by the AUTHORITY.
2) Original scope included a maximssm of 4,880 man-hours, A total of 5,867.5 man-hours
have been provided through December 22,2012 totaling 1028.3 additional man-hours
beyond original budget,
3) HNGINEER estimates an additional 320 man-hours will be required to finish the
Project,which brings the total man-hours required to complete the oxlsite controls to
1,348.3 additional man-hours beyond the origizlally contracted amount.
t. Filter Flume/Gullet Slabs Inspection(SAl)
1) As requested in AUTHORITY's letter dated Apri118,2012,ENGINEER provided
ix�spection services zelated to filter gullet/flume slabs for Filters 1 1,while the
Contractor ixvstall¢d a coating system_
2) A Contrac[or dispute exists related bo the constnrction of the filter gullet/flume slabs
for FIIters 1-8. Until that claim is settled,ENGINEER is ozaly requesting compensation
for the AUTHORITY-directed inspection services provided by ENGINEER's
subcoxlaultant.

u. Sodium Permanganate Request for Deviation (SAl)
1) Provide additional engineering design services related to implementing
AUTHORITY-requested design change from Potassium Permanganate to Sodium
Permanganate chemical feed system.
2) Prepare change order documents(e.g.,drawing and spendficafion revisions)for the
Contractor to prepare a proposal.
3) Review and comment on Contractor-prepared change order proposal.
4) Review submittals and shop drawings related to these changes.
v. ' Redesign of Roadways(SAl)
1) Provide additional engineering design services related to redesigning the plan and
profiles of th¢entire roadway systems at the request of the Contractor due to
contractor install valve maxtholes at incorrect elevations.
2) Prepare Field Order documents containing revised roadway plan and profile
drawings and grading drawings.
w. Repetitive Submittal Reviews(SA7)
1) In accordance with Article 6.2.6 of Supplemental General Conditioais,Section 00800,
and Section 01300,Paragraph 1.14,Contractor shall reimburse AUTHORITY for
ENGIIVEER's costs related to repetitive submittal reviews. ENGINPER's cosh to date
include$21,760. In accordance with the Contract Documents as noted above,
ENGINEER recommends deducting this amount from the Contractor's payment
application.

y. Additior�al Onsite Controls(SA2)
1) Provide additional onsite controls as described 3n Task 1,Items n-r for extended 11.6
month construction period as requested by th¢AUTHORITY.
2) Original scope included a maximum of 4,880 man-hours. Supplemental Amendment
No.1 (SAl)includ¢d an additional 1,348.3 man-hours. A total of 7,190 man-hours
have been provided through Ocrober 19,2013 rotating 962 additional man-hours
beyond SAl.
3) ENGINEER estimates an additional 144 man-hours will be required ro finish the
Project which brings the royal man-hours required ro complete the onsite controls to
1,106 additional man-hours beyond the original and SA7 contracted amount
z. Rep¢titive Submittal Reviews(SA2)
1) In accordance with Article 6.2.6 of Supplemental General Conditions,Section 00800,

2. Providing Warranty Services as follows:
a. Receive,review and provide written response to Contractor-generated and submitted

the Wasanty Matrices)to verify compliance with the Contract Documents. Upon receipt
of the submittal,maintain the warranty tracked Matrices document and provide quazterly

b. Receive AUTHORITY input on equipment and material malfunctiot�a or deficiencies,and

requirements of th¢Texas Commission on Environmental Quality(TCEQ).The manual
will serve as a reference for operations and maintenance personnel seeking engineering
d¢sign ixtformation as well as operations and maintenance requirements and guidance.

maintenance information as provided by the general construction contractor.Equipment
descriptions will include an explanation of how individual pieces of provided equipment
serve the systems and processes they are a part of and how the systems and proresses
should be operated ro achieve the engineered intent.
c. The manual will also provide guidance to operations personnel on plant systema

4) Procedures that operations personnel will use ro verify that leaks have not developed
in the common wall between the settled water flume and filtered water gullet in each
ffiter. Procedure must also describe record keeping procedures of all inspections
conducted for the first 3 years of operation.
e. The manual will be slructared ro have the following features:
1) Operations and maintenance text will be displayed in an easy ro read Format.The user
will be able ro use the documents Table of Contents ro locate specific information.
2) ENGINEER will gather information necessary for preparing the 06tH Manual and
developing the format of the manual.ENGINEER will prepare the draft manual ro
incorporate the major aectior.s of the plant Two(2)draft copies of the 08tH manual
will be delivered ro the plant staff for review and comment.
3) ENGINEER will incorporate BCRWTP staff comments and deliver two(2)hard copies
of the final OSTM Manual ro plant staff.
2. Startup Services
a. Assist the General Construction Contractor with the startup and commissioning of new
Plant equipment systems and processes. Assistance will include review and comment on

making recommendations for performa+..w and/or funetiox<ality ffiating to augment that
being proposed by the General Construction Contractor;and documenting the resells of

b. Prepare and submit a revised CT Study For the proposed BCRWTP when consti�uction is
approxin<ately 90% complete with as-built dimensions. ENGEVEHR will submit plan for
TCEQ review and approval.
c. Prepare and aubxnit a Raw Water Monitoring Plan for TCHQ review and approval thaS
meets the requirements of 30 TAC 290.111(b). Plan will be submitted prior to
commencement of operations.
d. Provide additional startup services related to assisting the contractor troubleshoot newly
ix<stalled equipment or additional startup services related to Requests for Deviation from
the AUTHORITY-SAl.
e. Mobilize Wonderware software vendor to troubleshoot Contractor-provided software.
The Wonderware Trip Report revealed that the issues with the software were contractor
related issues. Wonderware submitted an invoice for this work totaling$5797 that was
paid by ENGINEER. by accordax<ce with Section 13302,Paragraph 3.01A-"it is the
responsibility of the Process Control System Supplier(PGSS)to provide a compleffi
operational control system" and all costs Far shall be borne by the Contractor. HNGINEER

3. Record Drawing Services
a. Integrate the general contractor s compiled red-line markings into the electronically
produced conformed drawing docum¢nffi using Autodesk AutoCAD. Annotate the
updated AutoCAD documenffi eleciroxtica3ly to indicate the source of the update(i.e.RFI
No.,Change Ord¢r No-,Contractor's records,Engineer's records,etre_)and highlight the
update using anagreed-to highlight method. Maintain the working electronic record
drawing documenffi and upload such files to an offsite back-up drive on two-week
intervals.
b. Upon receiving and reviewing the general construction contractor's last installment of as-
built construction information and incrorporafing such i..Formafion,along witty other

professional Hngineer or Architect of Record seals(as appropriate)with signatures
and dates.
c. Prepare and submit to the AUTHORITY Project Team a Microsoft Excel-based template for
use in id¢ntifying fixed assets resulting from the work in AUTHORITY'S future asset
management system. Modify template based on receiv¢d comments and populate to
reflect the fixed asseffi r¢sulfing from the work. Submit fiv¢copies of the completed fixed
asset spreadaheeffi to th¢AUTHORITY Project T¢am for record purposes.

a. HMI Daffibase and Coxtfiguration
1) D¢velop the HMI database and th¢coxtfigvration of the Operator Workstations
(OWS).The HMI database defin¢s all I/O interface points between the PLC and HMI
nodes.
2) Develop up to 60 displays,including process and associated pop-ups,to reflect the
equipment and I/O provided under the Phase 1A construction project.
3) Develop a trending scheme that allows the users to coxtfigvre and save user-defined

1) Develop a field I/O list and PLC database list for coordination with other Contractors.

data type(Real,Integer,Boolean,etc J,and the register address to be used for data
transfer by other systems.
2) ENGTNEHR will use the PLC programnti:tg standards and conventions as the basis for
logic developm¢nt and organization on tht project.Hardware and software will be
provided in ENGINEER for it use in development,testing and commtsioxting of the
PLC logic.
3) During coxtatruction,an Early Development System(EDS),as defined in the contract
docum¢nffi,will be shipped to ENGINEER's office by the Process Control System
Supplier(PGSS)For use by ENGINEER throughout the progra+....+ $phaze.
c. Historical Daffibase/Reports
1) Provid¢the progra... :..g and configuration of the historical data management
system.Historical data will be available for trending and report generation
ENGIIVEER has budgeted to provide vp to 10 aingl¢page operational reports For this
construction project.An operational report 3s defined as a single 8'/z X 11 inch page.
The reports development will commence bazed on the approved final reports
submittal.
d. Coordination/Review Meetings
1) ENGINEER will attend up to three one-day coordination meetings with the PCSS.The
primary purpose of these meetings is to allow ENGINFER's programmers the
opportvrdty to coordinate issues with the PCSS throughout their construction effort.
e. Testing and Startup System Support
1) HNGINEER will conduct an un-witnessed Pre-Factory Coxifiguration Development
and Test at HNGIIVEER's stging facility.By utilizing the Early Development System
(EDS)provided by the PCSS,ENGINEER will perform equipment configuration,
develop,install and teat the HMI and PLC application software programs required for
the control system.This test will verify the functionality,performance,and stability of
the HMI and PLC programming software.
2) ENGINHER will conduct an un-witnessed Syat¢m Integration Test at the PCSS'
staging facility.ENGINEER will install the application software onto the control
system.Th¢purpose of tht test will be to verify the functionality,performance,and
stability of the control syst¢m hardware and software as a complete integrated system.
The objective of this teat is to confirm the control system is ready For demonstration to
the AUTHORITY.This teat will include a complete point-by-point test ENGINEER's
scope assumes that the PCSS will assist in the teat and will correct any deficiettciea
with the equipment and control pan¢la th a lim¢ly manner.
3) ENGINEER will conduct a Witnessed Factory Test at the PCSS system staging facility.
HNGINEFtz will demonstrate to the AUTHORITY representative that the control
system operates as designed.The teat will demortatrat¢the system I/O functionality,

graphics,trends,alarms,reports,and process control strategy startup_ENGINEER'S
scope assumes that the PCSS will asaisi in the Held testing and startup and will corr¢et
any deficiencies in the installation and equipment operation in a timely-^��++�r.Once
a Facility is started up and is operating,ENGINEER w$d¢monatrate to th¢
AUTHORITY representative that the control system application software performs as
d¢aigned.The system application engineering services shall be considered
substantially complete for this construction project when the system has met the

c System Administrator Training
1) ENGINEER will provide training m System Administrator staff as it relates to
mortitoring and controlling process operation for this project.ENGINEER will provide
one,Hve-day session For up to 5 students.The primary purpose of this traixdxtg will be
to review the specific programming dev¢loped by ENGINEER.ENGINEER will
coordinate scheduling to meet the needs of the AUTHORITY persormel.

1) ENGINHHR will assemble final documentation generated from the previously defined
activities for this project The final documentation will consist of the Heal control loop
narratives(Hard and soft copy),the final Proc¢ss Graphic Displays(Hard and soH

applicatior�s(Soft copy only).The soft copies of the documents generated will be
provided in the Adobe PDF format and in the native programming language,where
