WHEREAS, the Brushy Creek Regional Utility Authority, Inc. ("BCRUA") has previously
entered into a Contract for Engineering Services ("Contract") with HDR Engineering, Inc. for the
Phase 2 Deep Water Intake Preliminary Design Project, and
WHEREAS, HDR Engineering, Inc. has submitted Supplemental Contract No. 4 to the
Contract to modify the provisions for the scope of services, and
WHEREAS, the BCRUA desires to enter into said Supplemental Contract No. 4, Now
Therefore
BE IT RESOLVED BY THE BRUSHY CREEK REGIONAL UTILITY AUTHORITY,
That the Board President is hereby authorized and directed to execute on behalf of the BCRUA
Supplemental Contract No. 4 with HDR Engineering, Inc., a copy of same being attached hereto as
Exhibit"A" and incorporated herein for all purposes.
The Board hereby finds and declares that written notice of the date, hour, place and subject of
the meeting at which this Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and the subject matter hereof were
discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551,
Texas Government Code, as amended.

PROJECT: Phase 2 Deep Water Intake Preliminary Design
This Supplemental Contract No. 4 to Contract for Engineering Services is made by and between
the BRUSHY CREEK REGIONAL UTILITY AUTHORITY, INC., hereinafter called
"BCRUA" and HDR Engineering, Inc., hereinafter called the"Engineer".
WHEREAS, BCRUA and Engineer executed a Contract for Engineering Services, hereinafter
called the "Contract", on the 19th day of November, 2014 for the Phase 2 Deep Water Intake
Preliminary Design Project in the amount of$5,945,300.00; and
WHEREAS, BCRUA and Engineer executed Supplemental Contract No. 1 on April 15, 2015 to
modify the provisions for the scope of services and to increase the compensation by $21,900.00
to a total of$5,967,200.00; and
WHEREAS, BCRUA and Engineer executed Supplemental Contract No. 2 on July 15, 2015 to
modify the provisions for the scope of services and to increase the compensation by$399,400.00
to a total of$6,366,600.00; and
WHEREAS, BCRUA and Engineer executed Supplemental Contract No. 3 on November 9,
2015 to modify the provisions for the scope of services and to increase the compensation by
$27,000.00 to a total of$6,393,600.00; and
WHEREAS, it has become necessary to amend the Contract to modify the provisions for the
scope of services and to increase the compensation by $29,700.00 to a total of$6,423,300.00;
and
NOW THEREFORE, premises considered, BCRUA and the Engineer agree that said Contract
is amended as follows:
I.
Article 2, Engineering Services and Exhibit B, Engineering Services shall be amended as set
forth in the attached Addendum To Exhibit B. Exhibit C, Work Schedule shall be amended as
set forth in the attached Addendum To Exhibit C.

II.
Article 4. Compensation and Exhibit D. Fee Schedule shall be amended by increasing by
$29,700.00 the lump sum amount payable under the Contract for a total of $6,423,300.00, as
shown by the attached Addendum to Exhibit D.
IN WITNESS WHEREOF, BCRUA and the Engineer have executed this Supplemental
Contract in duplicate.

ADDENDUM TO EXHIBIT B
ENGINEERING SERVICES
GENERAL
The purposes of Supplemental Amendment No. 4 are to perform additional physical
modeling testing and perform an environmental review of the proposed Nameless
substation expansion plan.
BASIC SCOPE OF SERVICES
Task 2.0—Jurisdictional and Environmental Permitting Agency Coordination
Insert Task 2.9 as follows:
2.9 Nameless Substation and Distribution Route Environmental Assessment.
Perform the following evaluations in the area of the proposed expansion of the
PEC Nameless Substation and document the results.
2.9.1 Waters of the U.S. Determination. Identify location and extent of
potential waters of the U.S. in accordance with Section 404 of the Clean
Water Act. Desktop and field investigations will be completed.
2.9.2 Cultural Resources Survey. Conduct a cultural resources survey
including preparation of a Texas Historical Commission Antiquities Code
permit application. The survey shall include shovel testing, pedestrian
survey, site photography, recording and delineation of any newly
discovered archeological resources, assessments of site eligibility for
including on the Nation Register of Historical Places or for listing as
State Antiquities Landmarks, data analysis, and report preparation. No
artifacts will be collected as part of the survey effort. This task does not
include Phase II NRHP archeological testing or the recovery of human
burials.
2.9.3 Phase I Environmental Site Assessment (ESA). Conduct field work and
prepare a Phase 1 ESA report in accordance with ASTM Standards 1527-
13 and All Appropriate Inquiry (AAI). The report will identify the
potential presence and negative impacts of hazardous materials at the
site. SBA certification is not included.
2.9.4 Endangered Species Evaluation. Perform a desktop evaluation for
federally listed species know to occur in Travis County,Texas. Utilize
available habitat modeling, documented observations of endangered
species, mapped vegetation types on-site, current and historical aerial
photography and topography.
2.9.5 Distribution Route Environmental Constraints Review. Review known
archeological and cultural resources, EPA hazardous materials sites

databases, and potential waters of the U.S. for the approximately eight-
mile electrical distribution route from Nameless Substation to the
BCRUA Phase 2 pump station site. Summarize environmental
constraints within the subject area and identify any additional
investigations recommended for the proposed project.
Task 7.0—Pump Station
Modify Task 7.3.5.1 as follows.
7.3.5.1 Complete a physical model study of the selected pump station design
by a specialty lab to evaluate if flow approaching the pumps meets
Hydraulic Institute Intake Design Standards. The study involves building
and operating a scale model of the pump station to evaluate the
hydraulic characteristics of design recommendations. Incorporate
additional testing of the smaller, initial (approximately 15 MGD) pumps
in the individual well shafts to the suction forebay to evaluate the
hydraulic characteristics of the smaller diameter pump and shroud in
the larger diameter pump well.

The total compensation for services under Supplemental Agreement No. 4 is estimated
to be $29,700. Total compensation for the Phase 2 Deep Water Intake Preliminary
Design shall be adjusted to be $6,423,300.
Total compensation for Task 2.0 — Jurisdictional and Environmental Permitting Agency
Coordination shall be increased by an amount of$19,100. Total compensation for Task
2.0 — Jurisdictional and Environmental Permitting Agency Coordination (Paragraph
D1.01.A.2) shall be adjusted to be $318,500.
Total compensation for Task 7.0 — Pump Station shall be increased by an amount of
$10,600. Total compensation for Task 7.0—Pump Station (Paragraph D1.01.A.6) shall be
adjusted to be $1,497,700.
