("BCRUA") has duly advertised for bids for the City of Leander Delivery Improvements Project, and WHEREAS, Whitestone Civil Construction, LLC has submitted the lowest responsible bid, and WHEREAS, the BCRUA wishes to accept the bid of Whitestone Civil Construction, LLC, Now Therefore BE IT RESOLVED BY THE BRUSHY CREEK REGIONAL UTILITY AUTHORITY, That the Board President is hereby authorized and directed to execute on behalf of the BCRUA a contract with Whitestone Civil Construction, LLC for the City of Leander Delivery Improvements Project. The Board hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Main St. Round Rock, TX 78664 RE: City of Leander Delivery Improvements Recommendation to Award Construction Contract Dear Mr. Gallier, On May 8, 2017, Walker Partners assisted the Brushy Creek Regional Utility Authority (BCRUA) in opening competitive sealed proposals for the above referenced project. Five responsive competitive sealed proposals were submitted for the City of Leander Delivery Improvements Project.The proposals were evaluated and ranked based on the following selection criteria:20%Contractor Relevant Experience and References, 10%Responsiveness and Reliability, 50% Cost Proposal and 20% Proposed Schedule. Based on evaluation of the proposals,the table below lists the overall ranking of the five proposers. Firm Rank Whitestone Civil Construction, LLC 1 Austin Engineering Co., Inc. 2 Keystone Construction 3 Blackcastle General Contractor 4 CRU 5 Whitestone Civil Construction, LLC(Whitestone), of Cedar Park,Texas, is the highest ranked proposer offering the best value as determined in by the selection criteria and ranking evaluation. Evaluation of Whitestone's proposal included a review of the technical qualifications and experience of Whitestone and their listed subcontractors. A background check was also performed via telephone poll of reference projects Whitestone listed in their proposal. The overall impression from this investigation and review is that Whitestone provides quality work in a timely and professional manner. Whitestone listed three deviations in their proposal as follows: 1)Extend the Substantial Completion No. 1 milestone from 60 to 98 calendar days and Substantial Completion No, 2 milestone from 100 to 112 calendar days, 2) Extend the Final Completion deadline from 121 to 127 calendar days, and 3) Delete "Supplier" from General Conditions, Article 7.06 H. Discussion with the BCRUA resulted in a decision that the time extension deviations are acceptable, as long as shutdown of the Leander finished water delivery interconnect is limited to a maximum of ten calendar days. Whitestone is amenable to the above shutdown requirement. The contract time deviations and shutdown condition will be added to the Agreement, Section 00500.After discussion with Whitestone, deviation No. 3 will be waived. Based on the information presented and evaluation of the proposals. Walker Partners recommends the BCRUA award a Contract to Whitestone in the amount of$358,524.00.
