WHEREAS, in order to promote the public health, safety and welfare, it was
necessary for the BCRUA. to acquire a site for a permanent raw water intake facility and
related appurtenances; and
WHEREAS, the City of Leander, on behalf of the BCRUA, acquired a parcel of land
owned by Gary Gross and Cathy Gross ("Gross"), situated in Travis County, Texas containing
5.217 acres; and
WHEREAS, it is necessary and proper for the City of Leander to transfer the Gross
Property to the BCRUA: Now Therefore
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BRUSHY
CREEK REGIONAL UTILITY AUTHORITY THAT:
The Board hereby authorizes the BCURA President and/or General Manager to accept
the transfer of the Gross Property from the City of Leander to the BCRUA.
The Board hereby finds and declares that written notice of the date, hour, place and
subject of the meeting at which this Resolution was adopted was posted and that such meeting
was open to the public as required by law at all times during which this Resolution and the
subject matter hereof were discussed, considered and formally acted upon, all as required by the
Open Meetings Act, Chapter 551, Texas Government Code, as amended.

SUBJECT: BCRUA Board Meeting—August 28, 2017
ITEM: 6C. Consider a resolution authorizing the President and/or General Manager to accept the
transfer of the Gross Property from City of Leander to BCRUA.

BACKGROUND/JUSTIFICATION:
Purchase of the Gross property, located within the Village of Volente, was a necessary element of our Phase 2
Deep Water Intake and Pump Station Project.The purchase was coordinated by the City of Leander, on BCRUA's
behalf.
Final purchase occurred last year, with BCRUA Board authorization to reimburse the City of Leander for all costs
associated with the acquisition.
Formal authorization to transfer of the property is being completed by the Leander City Council, but it is also
necessary for The BCRUA Board to formally accept the property from the City of Leander.
The Gross property, along with the LCRA property we acquired in 2013, completes the major real property
acquisitions BCRUA will need for Phase 2.There still remain many easements for both electrical service lines, as
well as surface easements above the deep tunneled gravity and pressure raw water mains to acquire over the
next two years.Also, some minor property acquisitions from LCRA, as well as property adjacent to a PEC
substation will be needed.
Staff and the Operations Committee (OC) recommend approval of this resolution.
