BCRUA_R-18-04-18-6C RESOLUTION NO. R-18-04-18-6C WHEREAS, the Brushy Creek Regional Utility Authority, Inc. ("BCRUA") has previously entered into a Contract for Engineering Services ("Contract") with Walker Partners for the BCRUA Phase IC Water Treatment Plant Expansion and Phase 2 Land Rights and Stakeholder Coordination Project, and WHEREAS, Walker Partners has submitted Supplemental Contract No. 3 to the Contract to modify the provisions for the scope of services, and WHEREAS, the BCRUA desires to enter into said Supplemental Contract No. 3, Now Therefore BE IT RESOLVED BY THE BRUSHY CREEK REGIONAL UTILITY AUTHORITY, That the Board President is hereby authorized and directed to execute on behalf of the BCRUA Supplemental Contract No. 3 with Walker Partners, a copy of same being attached hereto as Exhibit "A" and incorporated herein for all purposes. The Board hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. WHEREAS, BCRUA and Engineer executed a Contract for Engineering Services, hereinafter called the"Contract",on the 19th day of April,2017 for the BCRUA Phase 1 C Water Treatment Plant Expansion in the lump sum amount of 51,763,900.00 and Phase 2 Land Rights and Stakeholder Coordination Project in the maximum amount of$2,012,600.00 for a total Project compensation of$3,776,500.00;and WHEREAS, BCRUA and Engineer executed Supplemental Contract No. I on July 19, 2017 to amend the scope of services and to increase the compensation by S 14,100.00 for Phase 1 C Water Treatment Plant Expansion to a total of$1,778,000.00 and by $212,000.00 for Phase 2 Land Rights and Stakeholder Coordination Project to a total of $2,224,600.00 for a total Project compensation of 54,002,600.00;and WHEREAS, BCRUA and Engineer executed Supplemental Contract No. 2 on November 20, 2017 to amend the scope of services and to increase the compensation by$19,600,00 for Phase 1 C Water Treatment Plant Expansion to a total of S 1,797,600.00 for a total Project compensation of$4,022,200.00;and WHEREAS, it has become necessary to amend the Contract to modify the provisions for the scope of services and to increase the compensation by 5105,200.00 for Phase 2 Land Rights and Stakeholder Coordination Project to a total of 52,329,800.00 for a total Project compensation of $4,127,400.00;and NOW THEREFORE,premises considered, BCRUA and the Engineer agree that said Contract is amended as follows: Supplemental Contract Rev.03J201 l 0140-4634-40-,003M73 213829 �c?-LUdL- P,- 19.04. 19 LG 1. The work was requested by and will be shared with PLC. i • Evaluate the feasibllity and planning-level costs of an alternative alignment near the North Rim subdivision The evaluation includes planning level technical and environmental constraints reviews. • Perform an environmental constraints review of the"rebuild"portion of the PEC Improvements recommended by M&S and approved by PEC ■ Review the 2009 Phase 1 Environmental Assessment(EA)and the Phase 2 EA and re- coordinate with regulatory agencies that performed reviews of these documents. Submit copies of re-coordination documents to the Texas Water Development Board(TWDB). • Prepare a supplement to the 2012 Phase Environmental Assessment to address the additional environmental constraints and commitments Identified as part of the PEC electrical upgrades. The supplement will be submitted to the TWD8. • Prepare a supplement to the 2012 Engineering feasibility Report to document the design of the PEC electrical upgrades required far the Phase 2 project. The supplement will be submitted to the T WDB. BASIC SCOPE OF SERVICES Task 2.0-Phase 2 Land Rights and Stakeholder Coordination Insert Task 2.2.3.3 under Task 2.2.3 Nameless Substation Expansion Evaluation as follows: I 2.2.3.3 Nameless Substation Design Alternatives Review. Review three preliminary substation expansion plans. Evaluate feasibility,develop planning-level cost estimates,and evaluate site/civil design requirements for the two expansfon plans developed by PEC. Coordinate evaluation with PEC. Prepare a Technical Memorandum documenting the evaluation. Address OWNER and PEC comments and finalize the TM. Insert Task 2.2.8.3 under Task 2.2.8 Upgrades to Existing Overhead Electric Service Evaluation as i follows: E 2.2.8.3 Environmental Constraints Review. Perform an environmental review of the "rebuild" portions of the recommended rebuild alignment easements. Prepare and present an Environmental Constraints Report. Address OWNER comments and Finalize the report. 2.2.8.3.1 Waters of the U.S. and Endangered Songbird Field Reconnaissance. Conduct a jurisdictional waters of the United States assessment and a habitat assessment for golden-cheeked warbler (GCWA) and black-capped vireo (BCVI). Identify the location and extent of potential waters of the United States In accordance with Section 404 of the Clean Water Act (CWA). Utilize the most current aerial photographs, topographic maps, National Wetlands Inventory (NWI) database, National Hydrography Dataset (NHD), and soil surveys, to conduct the appropriate field work necessary to identify the location and extent of U.S. Army Corps of Engineers (USACE) jurisdictional waters and potential wetlands within the rebuild easement. Potential habitat for the federally listed GCWA and BCVI within the rebuild easement will be identified and noted during the site Investigation. 2.2.8.3.2 Cultural Resources Investigations. Prepare a Texas Historical Commission (THC) permit application to perform a cultural resources study. The work includes a pedestrian survey, shovel testing, site photography, site recording, preliminary archival research, National Register eligibility assessment, data analysis,and report preparing and curatlon in accordance with THC and the Council of Texas Archaeologists standards. . 2.2.8.3.3 Hazardous Materials Review. Conduct a desktop screen of currently known hazardous materials located near the rebuild easement. Insert Task 2.2.9 North Rim Overhead Electric Alternative Alignment Evaluation as follows: 2.2.9 North Rim Overhead Electric Altemative Alignment Evaluation. 2.2.9.1 Technical Memorandum,Evaluate and compare three alternative alignments through the North Rim subdivision along North Rim Drive. Candidate alignments Include:1)new build from Big Sandy Creek to the west end of North Rim Drive and rebuild along the length of North Rim Drive;2)new build adjacent to Big Sandy Creek and rebuild along an existing overhead line following a private unimproved road paralleling to the south of North Rim Drive and thence rebuild of existing lines along Lost Ridge Circle and North Rim Drive;3)new build adjacent to Big Sandy Creek and rebuild along an existing overhead line following a private unimproved road paralleling to the south of North Rim Drive and thence new build cross country from the end of Lost Ridge Circle to ; Trails End Road. Complete planning-level routing and cost estimates of the alternative alignments and perform a desktop environmental study 3/2012018a dllCf , cis engineers• surveyors I of the alignments. The desktop environmental study shall Include an assessment of potential effects to waters of the U.S.,federally listed species,and cultural resources. Insert Task 2.3.4 under Task 2.3 Agency and Stakeholder Coordination as follows: 2.3.4 Texas Water Development Board(TWDB). 2.3.4.1 Re-coordinate with agencies that reviewed the 2009 Phase 1 EA and 2012 Phase 2 EA.
