BCRUA_R-21-03-24-6A RESOLUTION NO. R-21-03-24-6A
WHEREAS, the Brushy Creek Regional Utility Authority, Inc. ("BCRUA") has previously
entered into a contract ("Contract") with Excel Construction Services, LLC for the BCRUA Phase
I C Water Treatment Plant Expansion Plant Project; and
WHEREAS, the BCRUA has determined that it is necessary to make changes to the
quantity of work to be performed or materials, equipment, or supplies to be provided, and
WHEREAS, it has been determined that it is necessary to change said Contract in
accordance with the attached Contract Change Order No. 5, Now Therefore
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BRUSHY CREEK
REGIONAL UTILITY AUTHORITY,
That the Board President is hereby authorized and directed to execute on behalf of the
BCRUA, Change Order No. 5 to the Contract with Excel Construction Services, LLC, a copy of
same being attached hereto as Exhibit "A" and incorporated herein for all purposes.
The Board hereby finds and declares that written notice of the date, hour, place and subject
of the meeting at which this Resolution was adopted was posted and that such meeting was open to
the public as required by law at all times during which this Resolution and the subject matter hereof
were discussed, considered and formally acted upon, all as required by the Open Meetings Act,
Chapter 551, Texas Government Code, as amended.

Excel Construction is offering pricing of$101,187.00 to repair the work as outlined in
your email dated March H, 2021. The attached proposal includes pricing for repairing
the Phase IC water line, repairing insulation on the existing Phase 1A hydrant station,
and repairing damaged concrete on the exterior of the Phase 1 A filter control box.
Scope of Work per March 11,2021 email.
Item #1 - Redo 6" scum -No price offered. Corrected by BCRUA.
Item #2 - Replace all compromised flange gaskets on Phase I C 4" PTW piping basin
(MA-3). Repairs are required from where the 4" PTW turns up in the Phase 1C settled
water channel (MA-2) to the Phase I C 4" gate valve on the south end of the
sedimentation basin (AIO/MA-13). Redo the 4" PTW wall penetration referenced on
AIO/MA-13. Repair Phase I C hydrant stations and taps (MA-3). Prepare and repaint
piping as necessary. Repair insulation as necessary. Pressure test Phase 1C 4" PTW
after repairs are complete.
Item #3 - Repair insulation on eight Phase I A filter hydrant stations as requested by
BCRUA.
Item #4 - Repair damaged concrete on the exterior of Phase I A filter control box per
the procedure provided previously. Tnemec Enviro-Crete to match.
Attached is Excel's pricing breakdown. The pricing is based on the basin being empty
during the duration of the repair. Excel is not including the cost for any new or reworked
pipe supports. Please review and let me know if you have any questions. Attached is the
punch list from Excel Construction and Walker Partner.

Item #2 - Replace all compromised flange gaskets on Phase I C 4" PTW piping basin
(MA-3). Repairs are required from where the 4" PTW turns up in the Phase 1C settled
water channel (MA-2) to the Phase 1 C 4"gate valve on the south end of the
sedimentation basin (Al 0/MA-13). Redo the 4" PTW wall penetration referenced on
AI OIMA-l3. Repair Phase I hydrant stations and taps (MA-3). Prepare and repaint
piping as necessary. Repair insulation as necessary. Pressure test Phase l C 4" PTW
after repairs are complete.
Item #3 - Repair insulation on eight Phase 1A filter hydrant stations as requested by
BCRUA.
Item #4 - Repair damaged concrete on the exterior of Phase I A filter control box per
the procedure provided previously. Tnemec Enviro-Crete to match.
Attached is Excel's pricing breakdown. The pricing is based on the basin being empty
during the duration of the repair. Excel is not including the cost for any new or reworked
pipe supports. Please review and let me know if you have any questions. Attached is the
punch list from Excel Construction and Walker Partner.
