WHEREAS, the Brushy Creek Regional Utility Authority, Inc. ("BCRUA") has previously
entered into a Contract for Engineering Services ("Contract") with Walker Partners/Freese and Nichols
Joint Venture for the BCRUA Phase 2 Raw Water Delivery System Project, and
WHEREAS, Walker Partners[Freese and Nichols Joint Venture has submitted Supplemental
Contract No. 7 to the Contract to modify the provisions for the scope of services and to increase the
compensation, and
WHEREAS, the BCRUA desires to enter into said Supplemental Contract No. 7, Now
Therefore
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BRUSHY CREEK
REGIONAL UTILITY AUTHORITY:
That the Board President is hereby authorized and directed to execute on behalf of the BCRUA
Supplemental Contract No. 7 with Walker Partners/Freese and Nichols Joint Venture, a copy of same
being attached hereto as Exhibit "A" and incorporated herein for all purposes.
The Board of Directors hereby finds and declares that written notice of the date, hour, place and
subject of the meeting at which this Resolution was adopted was posted and that such meeting was
open to the public as required by law at all times during which this Resolution and the Subject matter
hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act,
Chapter 551, Texas Government Code, as amended.

This Supplemental Contract No. 7 to Contract for Engineering Services is made by and between
the BRUSHY CREEK REGIONAL UTILITY AUTHORITY, INC., hereinafter called
"BCRUA" and Walker Partners//Freese and Nichols Joint Venture, hereinafter called the
"Engineer".
WHEREAS, BCRUA and Engineer executed a Contract for Engineering Services, hereinafter
called the "Contract', on the 28th day of November, 2018 for the BCRUA Phase 2 Raw Water
Delivery System Project in the lump sum amount of $12,518,037.00 for Engineering Services
excluding Task 5.3.1 .. Geotechnical Investigation; and
WHEREAS, BCRUA and Engineer executed Supplemental Contract No. 1 on April 24, 2019 to
amend the scope of services, specifically, Task 6.0, and to increase the compensation by
$75,496.00 to a total lump sum amount of $12,593,533.00 for a total project amount of
$13,697,291.00; and
WHEREAS,BCRUA and Engineer executed Supplemental Contract No. 2 on August 7, 2019 to
amend the scope of services, specifically, Task 5.0 - Special Services, and to increase the
compensation by $42,348.00 to a total lump sum amount of $12,635,881.00 for a total project
amount of$13,739,639.00; and
WHEREAS, BCRUA and Engineer executed Supplemental Contract No. 3 on March 5, 2020 to
amend the scope of services, specifically, Task 6.0 - Agency and Stakeholder Coordination, and
to increase the compensation by $47,000.00 to a total lump sum amount of$12,682,881.00 for a
total project amount of$13,786,639.00; and
WHEREAS, BCRUA and Engineer executed Supplemental Contract No. 4 on March 20, 2020
to amend the scope of services, specifically, Task 6.0 - Agency and Stakeholder Coordination,
and to increase the compensation by $18,155.00 to a total lump sum amount of$12,701,036.00
for a total project amount of$13,804,794.00; and

WHEREAS, BCRUA and Engineer executed Supplemental Contract No. 5 on May 28, 2020 to
amend the scope of services, specifically, Task 5.3.1 - Geotechnical Investigation, by reducing
the compensation by $256,761.00 and adjusting the total Time and Materials amount to
$846,997.00; and to reallocate $256,761.00 to Task 5.0 - Special Services and Task 6.0 -
Agency and Stakeholder Coordination, and to modify the provisions for the scope of services for
Task 5.0 by increasing the compensation by $24,212.00 to a total lump sum amount of
$12,982,009.00 for a total project amount of$13,829,006.00; and
WHEREAS, BCRUA and Engineer executed Supplemental Contract No. 6 on October 22, 2020
to amend the scope of services, specifically, Task 5.0 - Special Services, and to increase the
compensation by $27,985.00 to a total lump sum amount of $13,009,994.00 for a total project
amount of$13,856,991.00; and
WHEREAS, it has become necessary to amend the Contract to modify the provisions for the
scope of services, specifically, Task 5.0 Special Services, and to increase the compensation by
$137,201.00 to a total lump sum of$13,147,195.00 for a total project amount of$13,994,192.00;
NOW THEREFORE, premises considered, BCRUA and the Engineer agree that said Contract
is amended as follows:

Article 2, Engineering Services and Exhibit B, Engineering Services shall be amended as set
forth in the attached Addendum To Exhibit B. Exhibit C. Work Schedule shall be amended as
set forth in the attached Addendum To Exhibit C.
II.
Article 4, Compensation (1) Lump Sum and Exhibit D, Fee Schedule shall be amended by
increasing by $137,201.00 the lump sum amount payable under the Contract for Engineering
Services, specifically, Task 5.0- Special Services to a total lump sum amount of$13,147,195.00
for a total Project amount of$13,994,192.00, as shown by the attached Addendum_to.Exhibit D.

BASIC SCOPE OF SERVICES
Task 5.0-Special Services
Insert Task 5.14 as follows:
5.14 Re-Design of Jackson Street Extension and other Associated Improvements.Through
negotiations with the Village of Volente (Village), as part of the Interlocal Agreement, the
current design of the Jackson Street Extension will be re-designed to incorporate specific
decisions and guidance from the Village. The Village prefers the Jackson Street Extension
not be fully connected to Bernard Street and Terrell Street, but instead be a stub-out from
the Bernard Street cul-de-sac. This decision will provide for Bernard Street to be the
primary approach route for the proposed Maintenance Building, opposed to the currently
designed connecting Jackson Street. Other design accommodations, such as improvements
to widening corners at intersections along Bernard Street/Sherman Street and Sherman
Street/Lime Creek Road, will be required to allow longer trucks to maneuver and approach
along Bernard/Sherman Streets.
5.14.1 Conceptual Project Coordination
5.14.1.1 Attend a Project (re)Kick-Off Meeting to develop and provide an
updated typical section and project overview exhibit to be approved by
the Village. Village has requested a typical section and plan view layout
that does not adhere strictly to City of Austin or Texas Department of
Transportation (TxDOT) standards.
5.14.1.2 Development of TM 5-15, Jackson Street Extension Re-Design Variances.
5.14.1.3 Development of conceptual exhibits of typical section, plan view, and
Autoturn exhibits for Village coordination and approval.
5.14.1.4 Participation in weekly internal coordination meetings for coordination
and progress review to obtain Owner and VOV approval of revised plan
and typical section.
5.14.2 Project Coordination and Management. Provide project oversight and the daily
management of the project. Frequent and appropriate communications will be
maintained between the Engineer and Owner to expedite completion.
5.14.3 Project Design. The Project design criteria will be as follows:
5.14.3.1 The design standards to be used will include but not be limited to the
City of Austin Transportation Design Criteria Manual, TxDOT Roadway
Design Manual, TxDOT Bridge Design Manual— LRFD,TxDOT Hydraulic
Design Manual, Highway Capacity Manual,the American Association of
State Highway and Transportation Officials (AASHTO) A Policy on
Geometric Design of Highways and Streets (Green Book), AASHTO LRFD
Bridge Design Specifications, Texas Manual on Uniform Traffic Control

5.14.3.2 Project specification and Standard Details will be developed using the
latest Texas Department of Transportation Standard Specifications for
Construction and Maintenance of Highways, Streets, and Bridge, the
City of Austin Transportation Design Criteria Manual, and the City of
Austin Drainage Criteria Manual.
5.14.3.3 Traffic Control Plan Services. Prepare a Traffic Control Plan (TCP)
including Advanced Warning Signs, a Detour Plan if required and a
Sequence of Work Narrative.The Traffic Control Plan will be developed
in accordance with the most recent version of the Texas Manual of
Uniform Traffic Control devices (TMUTCD).
5.14.3.4 Roadway Design Services.
5.14.3.4.1 Design with the approved roadway typical section and plan view
utilizing the vertical profile from the previous submission,
5.14.3.4.2 Use the pavement section as specified in the Village Code of
Ordinances.
5.14.3.4.3 Prepare Project Layout Sheets that clearly indicate the limits of
the entire project and include the horizontal alignment data.
5.14.3.4.4 Revise the Proposed Typical Section Sheets.The proposed
typical sections will include all pertinent information for the
proposed roadway construction.
5.14.3.4.5 Revise the Roadway Plan and Profile Sheets with the revised
horizontal geometry and typical section.
5.14.3.4.6 Develop Intersection Layout Sheets with spot elevations and
proposed grading for the intersections of Jackson Street and
Bernard Street of Lime Creek Road at Sherman Street.
5.14.3.4.7 Prepare cross-sections at 25-intervals to be included in the pian
set.
5.14.3.5 Dry Stack Rock Wall Design Services.
5.14.3.5.1 Prepare dry stack rock wall Plan and Profile sheets as specified
by the City of Austin including the following information:
5.14.3.5.1.1 Beginning and ending wall points by station, offset, and
roadway alignment.
5.14.3.5.1.2 Additional points as necessary to describe relationship of
wall alignment to roadway alignment(s).
5.14.3.5.1.3 Typical Wall section depicting wall control points.
5.14.3.5.1.4 Beginning and ending of top/bottom wall points by
station and elevation.

5.14.3.7 Signing and Pavement Markings Services. Prepare proposed signing
layouts, and proposed pavement marking and delineation layouts for
the Jackson Street Extension. The layouts will identify the various types
of proposed signing, striping, and delineation. Signing and striping will
be in accordance with the latest version of the TMUTCD or applicable
TOOT standards.
5.14.3.8 Environmental and Storm Water Management Plan Services. Prepare
SW3P Layouts to include the necessary controls to minimize the runoff
of sediment during construction. The layouts will include information
presented in the WPAP and include permanent storm water features as
appropriate. The SW3P control measures will be prepared and
designed in accordance with the proposed phasing of construction.
5.14.4 Submittal Requirements.
5.14.4.1 Submit a 90% quality control plan set and address comments.
5.14.4.2 Provide 100% plans including the standard specifications from COA or
TXDOT as applicable.
5.14.4.3 Submittal and Review Meetings: Attend an internal 90 percent
submittal review meeting. Comments and revisions will be
incorporated into the deliverables for the next submittal.
5.14.4.4 90 Percent Submittal:
5.14.4.4.1 Provide digital copies of plan sheets and cross-sections. The
plan sheets and cross sections must be prepared and
submitted in 11"x17"tabloid paper format.

5.16 Design of New Water Quality Related Structures and Retaining Walls per City of Austin.
Provided structural design and the preparation of contract drawings for the implementation
of two new water quality related structures at the RWPS property, as required by the City of
Austin. Structures are inclusive of the Water Quality Basin and Detention Basin. These new
structures were designed as cast-in-place concrete structures. Additionally, the City of
Austin required design details on the site retaining walls. Structural design and the
preparation of design drawings for the retaining walls were developed and provided to the
City of Austin.

5.14.3 Project Design. The Project design criteria will be as follows:

5.14.3.2 Project specification and Standard Details will be developed using the
latest Texas Department of Transportation Standard Specifications for
Construction and Maintenance of Highways, Streets, and Bridge, the

5.14.3.3 Traffic Control Plan Services. Prepare a Traffic Control Plan (TCP)
including Advanced Warning Signs, a Detour Plan if required and a
Sequence of Work Narrative.The Traffic Control Plan will be developed
in accordance with the most recent version of the Texas Manual of
Uniform Traffic Control devices (TMUTCD).
5.14.3.4 Roadway Design Services.
5.14.3.4.1 Design with the approved roadway typical section and plan view
utilizing the vertical profile from the previous submission,
5.14.3.4.2 Use the pavement section as specified in the Village Code of
Ordinances.
5.14.3.4.3 Prepare Project Layout Sheets that clearly indicate the limits of
the entire project and include the horizontal alignment data.
5.14.3.4.4 Revise the Proposed Typical Section Sheets. The proposed
typical sections will include all pertinent information for the
proposed roadway construction.
5.14.3.4.5 Revise the Roadway Plan and Profile Sheets with the revised
horizontal geometry and typical section.
5.14.3.4.6 Develop Intersection Layout Sheets with spot elevations and
proposed grading for the intersections of Jackson Street and
Bernard Street of Lime Creek Road at Sherman Street.
5.14.3.4.7 Prepare cross-sections at 25-intervals to be included in the plan
set.
5.14.3.5 Dry Stack Rock Wall Design Services.
5.14.3.5.1 Prepare dry stack rock wall Plan and Profile sheets as specified
by the City of Austin including the following information:
5.14.3.5.1.1 Beginning and ending wall points by station, offset, and
roadway alignment.
5.14.3.5.1.2 Additional points as necessary to describe relationship of

of proposed signing, striping, and delineation. Signing and striping will
be in accordance with the latest version of the TMUTCD or applicable
TxDOT standards.
5.14.3.8 Environmental and Storm Water Management Plan Services. Prepare
SW3P Layouts to include the necessary controls to minimize the runoff
of sediment during construction. The layouts will include information
presented in the WPAP and include permanent storm water features as
appropriate. The SW3P control measures will be prepared and
designed in accordance with the proposed phasing of construction.
5.14.4 Submittal Requirements.
5.14.4.1 Submit a 90% quality control plan set and address comments.
5.14.4.2 Provide 100% plans including the standard specifications from COA or
TXDOT as applicable.
5.14.4.3 Submittal and Review Meetings: Attend an internal 90 percent
submittal review meeting. Comments and revisions will be
incorporated into the deliverables for the next submittal.
5.14.4.4 90 Percent Submittal:

structures were designed as cast-in-place concrete structures. Additionally, the City of

ITEM: 6B. Consider a resolution authorizing the President to execute Supplemental
Contract No. 7 with Walker Partners/Freese & Nichols Inc. Joint Venture for
BCRUA Phase 2 Raw Water Delivery System.

BACKGROUND:
The initial contract for the design of the Phase 2 Raw Water Delivery System Project, in the amount of
$12,518,037, was awarded to Walker Partners/Freese and Nichols Joint Venture on November 28, 2018.
Since that time six supplemental agreements have been awarded that increased the compensation to
$13,856,991.
Supplemental Agreement No. 7 includes engineering services for design modifications to enhance
protection again freeze damage, modifications to address permitting requirements, and analysis of
backup power. An access road was redesigned due to a Village of Volente request to change the primary
approach road for the proposed Maintenance Building.The City of Austin required two new water quality
related structures for the pump station site. A technical memorandum was developed identifying the
availability, capacity, timing, and source of back-up power for the pump station at initial and ultimate
build-out. Finally,additional design modifications were made to enhance protection again freeze damage.
FUNDING:
The total compensation for Supplemental Amendment No. 7 will not exceed $137,201 and will increase
the total compensation for Lump Sum tasks to $13,994,192. Funding for this Supplemental Agreement
for the City of Round Rock's portion will use Phase 1A project savings.The City of Leander's and the City
of Cedar Park's portions will use BCRUA's 2018 SWIFT Loan bond funds.
Staff and the Operations Committee (OC) have reviewed the attached amendment and exhibits and
recommend approval. Staff and representatives of Walker Partners/Freese& Nichols Joint Venture will
be present at the Board meeting and will be available to respond to any questions.
