WHEREAS, the Brushy Creek Regional Utility Authority, Inc. ("BCRUA") has

BCRUA Phase 2 Raw Water Delivery System Project; and
WHEREAS, the BCRUA now wishes to enter into a -Standard Form of Agreement
bctween Owner and Contractor" with Thalle2'SAK Joint Venture, Now Therefore
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BRUSHY
CREEK REGIONAL UTILITY AUTHORITY:
That, after advertising for and receiving proposals from offerors, the BCRUA hereby
finds that Thalle+'SAK Joint Venture is the offeror which offers the best value for the BCRUA.
BE IT FURTHER RESOLVED
That, subject to the approval of the Participating Cities, the Board President is hereby
authorized and directed to execute on behalf of the BCRI,A a "Standard Form of Agreement
between Owner and Contractor" with Thalle:'SAK Joint Venture for the BCRUA Phase 2 Raw
Water Delivery System Project,
The Board hereby finds and declares that written notice of the date, hour, place and
subject of the meeting at which this Resolution was adopted was posted and that such meeting

ITEM: 6A. Consider a resolution authorizing the President to execute a Construction
Contract with Thalle/SAK Joint Venture (JV) for the Phase 2 Raw Water Delivery
System Project.
PRESENTER: Karen Bondy, General Manager
Proposals were opened for this project on March 22, 2022. Five responsive, competitive sealed
proposals were submitted by Thalle/SAK Joint Venture (Thalle/SAK) of Alvarado,TX, Southland
Contracting, LLC(Southland) of Grapevine,TX, Obayashi/Dragados 1V(Obayashi/Dragados) of
Burlingame, CA, Granite Construction Company(Granite)of Northbrook, IL, and Barnard Construction
Company, Inc. (Barnard) of Bozeman, MT. One Non-Responsive (NR) proposal was submitted by Clark
Construction Group, LLC(Atkinson Clark)of Bethesda, MD.
The proposals were evaluated and ranked based on the following selection criteria: 15%for Proposer
Team Structure and Organizational Information, 20%for Proposer Qualifications and Experience, 15%
for Project Approach and 50%for Cost Proposal.The table below presents a summary of the evaluation
criteria ranking. Total Proposal prices inclusive of Base Proposal,Additive Alternate Proposal and
Alternate Proposal Items range from $224,786,835 to$359,086,209 as recorded in the enclosed
Certified Negotiated Proposal Tabulation.

Based on evaluation of the proposals by Staff and the OC and the recommendation of our design
engineer,Walker Partners/Freese and Nichols 1V,the highest ranked proposer offering the best value as
determined by the selection criteria and ranking assessment is Thalle/SAK.
The total Base Proposal amount including Allowances proposed by Thalle/SAK is$215,499.610.00. The
proposal includes 14 Additive Alternate Proposal Items. After considering these items,Staff and the OC
recommend including the 14 Additive Alternate Proposal Items in the contract.The total amount of the
Additive Alternate Proposal Items is$1,430,225.00.
Each proposal also included two Submersible Turbine Pump and Motor Proposals for review and
evaluation as Alternate Proposal Items. Pump proposals were submitted by Indar of Beasain, Spain, and
KSB of Frankenthal,Germany. Based on evaluation and ranking of the pump proposals by Staff and the
OC, Indar is the highest ranked pump manufacturer and recommended for acceptance as an Alternate
Proposal at a value of$7,857,000.00.
Staff and the OC agree unanimously to recommend award of this Phase 2 Raw Water Delivery System
construction contract to Thalle/SAK JV in the amount of$224,786,835.00 which includes the total Base
Proposal amount of$215,499,610.00,the Additive Alternatives total amount of$1,430,225.00, and the
Alternative Proposal total amount of$7,857,000.00.
FUNDING:
Funding for this contract includes 2021 SWIFT Loan funds from Leander and Cedar Park, approved at the
April 7, 2021 Board meeting and subsequent council meetings, as well as cash from Round Rock.
Since the contract award will exceed the BCRUA's authorized maximum of$500,000, per the Master
Agreement, Board approval of this contract will need to be contingent on approval by all three BCRUA
member city councils.
Staff, OC representatives, and representatives of Walker Partners will be available to answer any Board
questions.
