A RESOLUTION OF THE BRUSHY CREEK REGIONAL UTILITY
AUTHORITY, INC. AUTHORIZING THE FILING OF LAWSUITS
RELATED TO THE DESIGN AND CONSTRUCTION OF THE THIRTY-
SIX INCH (36") PIPELINE; AND PROVIDING FOR RELATED
MATTERS
Whereas, the Board of Directors of the Brushy Creek Regional Utility Authority, Inc. (the
"BCRUA") consulted with legal counsel regarding the repair of the BCRUA 36-inch underwater pipeline
and potential claims related to design and construction of said pipeline (the "Pipeline");
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
BRUSHY CREEK REGIONAL UTILITY AUTHORITY, INC. THAT:
SECTION 1. The BCRUA Board hereby authorizes and directs the law firm of Knolle, Holcomb,
Callahan &Taylor, P.C. to file one or more lawsuits and to undertake any and all such other actions as are
reasonable and necessary to pursue claims against the entities involved in the design and construction of
the Pipeline.
SECTION 2. This resolution shall be effective immediately upon adoption.
SECTION 3. It is hereby officially found and determined that the meeting at which this resolution
is passed was open to the public as required and that public notice of the time, place, and purpose of said
meeting was given as required by the Open Meetings Act, Chapt. 551, Tex. Gov't. Code.
