O-2024-027 - 5/9/2024 I ORDINANCE NO. 0-2024-027 2 3 AN ORDINANCE AMENDING CHAPTER 20, SECTION 20-1, LIBRARY 4 CARDS AND FEES, CODE OF ORDINANCES (2018 EDITION), CITY 5 OF ROUND ROCK, TEXAS, BY ADDING CARDHOLDER CATEGORIES 6 AND SERVICES; AND PROVIDING FOR A SAVINGS CLAUSE AND 7 REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS. 8 9 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, 1 o TEXAS: 11 I. 12 That Chapter 20, Section 20-1, Code of Ordinances (2018 Edition), City of Round 13 Rock, Texas, is hereby amended as follows: 14 Sec. 20-1 -Library cards and fees. 15 16 (a) Card required. No person shall be allowed to check out any library book unless that person has been 17 issued a valid library card. 18 (b) Cardholder categories. Cardholders shall be classified as one of the following: (1) a resident 19 cardholder; (2) a nonresident cardholder; or(3) a Texshare cardholder. 20 (1) A resident cardholder is a cardholder residing within the corporate boundaries of the city of 21 Round Rock, and: 22 a. shall be issued a library card for a period of two (2)years at no cost to the cardholder; 23 b. shall be classified as a child, individual, or family cardholder when issued a library card,- 24 ard;24 and 25 c. shall have full borrowing privileges as set forth in section (c) below. 26 (2) A nonresident cardholder is a cardholder that does not reside within the corporate boundaries 27 of the city of Round Rock, and: 28 a. Shall be issued a library card for a period of one (1) year at no cost to the cardholder for the 29 limited nonresident library privileges set forth in section (c) below; and 30 b. Shall have the option to purchase a membership for a fee set by the library director subject 31 to the approval of the city manager and shall then have borrowing privileges of an individual 32 resident cardholder as set forth in section (c) below. 33 (3) A Texshare cardholder is a cardholder that has been issued a Texshare card, and: 34 a. Shall not be required to pay a library card membership fee; and 35 b. Fees may be required to be paid by the borrower for failure to return, at the date 3 due, any books or other library materials and equipment which have been loaned to holders of library 4 cards. Any required late fees are as currently established or as hereafter set by the library director 5 and subject to the approval of the city manager. The currently established fees and any changes to 6 the fees approved by the city manager shall be posted at the library. 7 (e) Miscellaneous fees. The miscellaneous library fees charged to the borrower shall be currently 8 established or as hereafter set by the library director subject to the approval of the city manager. The 9 currently established fees and any change to the fees approved by the city manager shall be posted 10 at the library. I 1 (f) Fees for damaged or lost material. 12 (1) Fees for damaged books shall be as currently established or as hereafter set by the library 13 director, subject to the approval of the city manager. The currently established fees and any 14 change to the fees approved by the city manager shall be posted at the library. 15 (2) Lost and damaged book replacements. 16 a. All materials owned by the Round Rock Public Library will be replaced and the customer 17 charged full replacement costs. 18 b. The customer will be charged the replacement cost (including any unique binding or 19 storage units). Annual standard pricing from professional book review material, grouped by 20 subject area and age level and relevant to public libraries, will be used to determine 21 replacement costs for books other than those listed below that are no longer in print or 22 distribution. The pricelist will be updated annually by the library staff. 23 Exceptions to this procedure for print material shall be as currently established or as 24 hereafter set by the library director, subject to approval of the city manager. 25 (3) Interlibrary loan materials will be replaced at the rate required by the sending library. 2 1 2 (g) Equipment and building use fees. 3 (1) The library equipment fees shall be charged as currently established or as hereafter set by the 4 library director subject to the approval of the city manager. The currently established fees and 5 any changes to the fees approved by city manager shall be posted at the library. 6 (2) Meeting room use and fees. 7 a. Nonprofit users. Nonprofit corporations are defined as entities meeting the qualifications of 8 sections 501(c)(3) and 501(c)(4) of the Internal Revenue Code. The organization's legal 9 place of business or a current executive board member must reside within the city limits to 10 receive the nonprofit rate. 11 b. State and county government. The library will waive the fees for state and county 12 government for four hours a month. However, such agencies will pay for kitchen and 13 equipment use at the prevailing rates and will be billed for any damage to the facility. 14 Security deposits are waived for the four free hours a month. 15 C. Cosponsorship of programs. The library will provide cosponsorship of programs with 16 nonprofit corporations that provide similar programs as the library, including but not limited 17 to genealogy training, book sales, and reading programs that expand upon core library 18 services. 19 1. Cosponsorship requires advertising stating that the city public library system or the 20 city is a cosponsoring agency, which will be provided on any advertising done by both 21 parties. Other city departments may cosponsor programs and receive the same 22 benefit. All damage will be paid by the nonprofit corporation using the facility, not the 23 library or other city agencies. However, other cosponsoring city agencies will be 24 responsible for maintaining communication and obtaining such fines or fees from the 25 nonprofit corporation as may be levied for misuse of city property. 26 2. Under no condition will the library cosponsor a program with a for-profit corporation 27 where the sole goal is for the financial benefit of the agency. The library may, 28 however, include for-profit corporations as part of a planned library program where 29 such corporations enhance the library's programming; such programming includes but 30 is not limited to a puppeteer during the Summer Reading Program or a paid trainer for 31 computer training for the aging. 32 d. Setup. Rooms are set up and returned to their original state by the user of the room. 33 Equipment that is leased ahead of time will be set up and operational prior to the reserved 34 time for the room. Equipment that is not leased ahead of time will be leased at a 50 percent 35 surcharge and will be set up and operational at the reserved time for the room. The room 36 rates do not include any form of set up assistance other than that of equipment use. Room 37 rates shall be as currently established or as hereafter set by the library director subject to 38 the approval of the city manager. All ordinances, parts of ordinances, or resolutions in conflict herewith are s expressly repealed. 6 B. The invalidity of any section or provision of this ordinance shall not 7 invalidate other sections or provisions thereof. 8 C.
