WHEREAS, the Brushy Creek Regional Utility Authority (`BCRUA") and Thalle/SAK
Joint Venture (the "Contractor"), (collectively referred to as the "Parties") have previously
entered into an Agreement Between Owner and Contractor (the "Agreement") for the
construction of the BCRUA Phase 2 Raw Water Delivery System (the "Project"), said
Agreement being dated the 18th day of June 2022; and
WHEREAS, the BCRUA has a floating barge (the "Barge") on Lake Travis with pumps
to transport raw water from Lake Travis to the BCRUA's water treatment plant; and
WHEREAS, due to the continuing drought and lowering of levels of Lake Travis, it may
become necessary for the BCRUA to decommission and move the Barge to a deeper portion of
Lake Travis; and
WHEREAS, if required, moving the Barge will be necessary to preserve and protect the
public health and safety of the citizens of Cedar Park, Leander, and Round Rock to ensure that
there is adequate water to serve said citizens; and
WHEREAS, Article 11 of the Agreement provides for amending the contract documents
regarding changes to the work for the Project; and
WHEREAS, the Board wishes to issue a Work Change Directive to Thalle Construction
Company regarding the decommissioning of the raw water intake Barge in relation to the Phase
2 Raw Water Delivery System Project, Now Therefore
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BRUSHY
CREEK REGIONAL UTILITY AUTHORITY:
That the Board President is hereby authorized and directed to execute on behalf of the
BCRUA a Work Change Directive, a copy of same being attached hereto as Exhibit "A" and
incorporated herein for all purposes.

The Board of Directors hereby finds and declares that written notice of the date, hour,
place and subject of the meeting at which this Resolution was adopted was posted and that such
meeting was open to the public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted upon, all as required by
the Open Meetings Act,Chapter 551, Texas Government Code, as amended.

You are directed to proceed promptly with the following additions, deletions,or revisions to the Work.
Description of Work under this Work Change Directive:
Do not perform the following tasks until receiving written authorization to commence the Work:
• Supply and construct a pump storage rack at the BCRUA WTP for three vertical turbine raw water pumps.
• De-energize the raw water intake barge and lock out/tag out pumps.
• Disconnect the discharge hoses(6),blind flange the hose ends,and place on the lakebed with a marker buoys.
• Flush the chemical feed system with raw water to clear the HDPE chemical feed lines of sodium permanganate. Disconnect the
6"rubber hose containing chemical feed piping and cut the HDPE chemical feed lines. Secure the ends of the chemical feed
lines outside of the 6"rubber hose. Attach the rubber hose and chemical feed lines to the Cedar Park raw u ater intake barge.
Do not impact operation of the copper sulfate dosing system that treats the Cedar Park raw water intake barge.
• Disconnect power and control cables, seal the cables,and secure to the Cedar Park raw water intake barge with kellum grips.
• Disconnect pump motors(7)and transport to BCRUA WTP.
• Remove instrumentation and insulation on the pomp discharge head.
• Pull the vertical turbine raw water pumps(7)and transport to BCRUA WTP.
• Disconnect the raw water intake anchor cables(8)and mark the anchors(x8x)with buoys.
• Relocate the raw water intake barge to the temporary storage easement at the cove near the end of Old Burnet Road and install
temporary marker lighting.
• Install temporary anchors(8)at the temporary storage location and connect anchor cables.
Reason for Change(s):
This Work Change Directive has been issued due to continuing drought and lowering of die water Icvel of Lake Travis.
Decommissioning of the existing raw water intake barge is necessary to preserve and protect the facility from damage.
Due to a necessity to expedite the Work described herein prior to agreeing to changes on Contract Price and Contract Time.the
Ownerdetermined that the Work shall proceed on the basis of the Cost of the Work.

but is evidence that the Owner expects to issue a Change Order reflecting changes as necessary.
