WHEREAS, through Resolution No. R-2023-391, the City Council of the City of Round Rock
previously approved the submittal of an application for grant assistance from the Bureau of
Reclamation (the "Bureau") for the WaterSMART Title XVI Congressionally Authorized Water
Reclamation and Reuse Projects for the Fiscal Years 2023 and 2024 grant program(the "Grant"); and
WHEREAS, prior to the acceptance of any funds available from the Bureau related to the
Grant, an applicant's governing body must adopt a resolution identifying the official with legal
authority to commit the applicant to the financial and legal obligations associated with the receipt of
any financial assistance award under the Grant; and
WHEREAS, the City of Round Rock identifies and designates the City Manager as the City of
Round Rock's authorized official to accept and enter into any related agreement(s) for available funds
awarded pursuant to the Grant; and
WHEREAS, the City Manager has reviewed the application for the Grant submitted and the
City Manager and the City Council support the application for the Grant previously submitted; and
WHEREAS, the City of Round Rock agrees it will work with the Bureau to meet any
established guidelines for entering into any grant or cooperative agreement required by the Bureau to
accept any Grant funds awarded, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,TEXAS,
That the City of Round Rock identifies and designates the City Manager as the City of Round
Rock's authorized official for the purpose of accepting any funds awarded by the Bureau of
Reclamation for the WaterSMART Title XVI Congressionally Authorized Water Reclamation and
Reuse Projects for the Fiscal Years 2023 and 2024 grant program and entering into any related
agreement(s).
That the City Council and the City Manager have reviewed the grant application submitted and
support the application as submitted.

That the City of Round Rock will work with the Bureau of Reclamation to successfully meet
any established guidelines for entering into any grant or cooperative agreements associated with the
receipt of funds.
The City Council hereby finds and declares that written notice of the date, hour, place and
subject of the meeting at which this Resolution was adopted was posted and that such meeting was
open to the public as required by law at all times during which this Resolution and the subject matter
hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act,
Chapter 551, Texas Government Code, as amended.

Dear Mr. Levy:
The Bureau of Reclamation(Reclamation)is pleased to inform you that your application, submitted by
the first application due date of December 7, 2023,for the WaterSMART: Congressionally Authorized
Title XVI Water Reclamation and Reuse Projects Funding Opportunity was among those receiving the
highest ratings and is now being considered for award of a financial assistance agreement. Reclamation
anticipates awarding Federal funds in the amount of$4,223,469 for your project.
In working with you to develop your financial assistance agreement, Reclamation will closely review
the activities outlined in your proposal to ensure that activities eligible for funding are identified and that
the proposed costs are allowable under financial assistance regulations and the Notice of Funding
Opportunity(NOFO). If some costs or activities are determined to be ineligible or unallowable,
Reclamation will work with you to refine the scope of work and budget for the project. In addition,
Reclamation must have sufficient evidence prior to award that non-Federal cost share will be available.
The final funding amount may be adjusted if necessary. Please note that a small portion of this amount
may be set aside for Reclamation to ensure the project's Federal regulatory and statutory compliance,
and to otherwise oversee the implementation of the project.
All new financial assistance awards for infrastructure projects must meet Buy America requirements.
Office of Management and Budget(OMB)implementing guidance states that the Buy America
provisions apply to projects carried out through Bipartisan Infrastructure Law(BIL)funding and annual
appropriations. See OMB Memorandum M-22-11 for further details. Please note that Reclamation's
WaterSMART program received final approval for a waiver for the Build America,Buy America
requirements on February 15,2024. This waiver allows for conditional and time-limited purchase of
non-domestic products used in water infrastructure projects funded under WaterSMART programs.
All projects being considered for award of funding are required to comply with all Federal
environmental and cultural resource requirements, including the National Environmental Policy
Act,Endangered Species Act,Clean Water Act, and the National Historic Preservation Act.
If project activities that require environmental and cultural compliance approval begin prior to receipt of
a written notice from Reclamation that all such clearances have been obtained,the costs of such
activities will not be eligible for reimbursement or application as non-Federal cost share.
In addition, funding for construction activities will not be released until Reclamation makes a
determination of financial capability for the project.
