WHEREAS, the City of Round Rock ("City") desires to retain construction services for the
repair of the Brushy Creek Regional Wastewater System—84-inch Tunnel; and
WHEREAS, said tunnel is critical to the daily operations of the Brushy Creek Regional
Wastewater System; and
WHEREAS, the repair needed for the 84-inch tunnel is the result of unforeseen damage to the
sewer line by a utility company; and
WHEREAS, the City is under no statutory obligation to advertise for bids for the purchase of
repairs necessary because of unforeseen damage to public machinery, equipment, or other property, as
such falls under the general exemption to competitive bidding requirements cited in the Texas Local
Government Code Section 252.022(a)(3); and
WHEREAS, this procurement is made in accordance with Section 252.022(a)(3) of the Texas
Local Government as an Unforeseen Damage to Public Machinery exemption; and
WHEREAS, the City now wishes to enter into a "Standard Form of Agreement Between
Owner and Contractor" with Lewis Concrete Restoration for the repair of the Brushy Creek Regional
Wastewater System—84-inch Tunnel, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,TEXAS,
That the City Council finds that the repair of the Brushy Creek Regional Wastewater System —
84-inch Tunnel is the result of unforeseen damage to public machinery, equipment, or other property,
and such purchase falls under the general exemptions to competitive bidding requirements in Section
252.022(a)(3).
That the Mayor is hereby authorized and directed to execute on behalf of the City a "Standard
Form of Agreement Between Owner and Contractor" with Lewis Concrete Restoration.

The City Council hereby finds and declares that written notice of the date, hour, place and
subject of the meeting at which this Resolution was adopted was posted and that such meeting was
open to the public as required by law at all times during which this Resolution and the subject matter
hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act,
Chapter 551,Texas Government Code, as amended.

2. Justification: Describe in detail below why an exemption according to Section 252.022 of the Local
Government Code is being submitted for this purchase. (Attach additional pages if needed)
In 2022, Round Rock conducted thorough inspections of our wastewater lines due to increased
flow rates at our wastewater treatment plant (WWTP). During this process, we discovered that a
dry utility company had inadvertently drilled through the regional 84-inch wastewater interceptor
near Brushy Creek and 1-35. After engaging with multiple companies, we identified it as an MCI
(Version) line. Working closely with Michael Bennett, City ownership was confirmed.
The affected section of wastewater pipe lies 28 feet deep within rock and was originally installed
using tunneling techniques. Unfortunately, open excavation is not feasible for accessing this
location. Instead, we must utilize a manhole situated 960 feet away. Given that this project is not a
standard repair, Round Rock cannot complete this repair in house. The repair warrants specialized
methods that involves live entry into the wastewater main to cut and seal the damaged pipe.
3. Attach and submit the following documentation that supports this justification as applicable.

• If sole source a Manufacturer's letter declaring the purchase is sole source and why. The letter
should be no older than 6 months old and signed by an authorized representative on company
letterhead.
4. Because the above facts and supporting documentation the City of Round Rock exempts this
procurement from LGC Chapter 252 and intends to contract with:

We are pleased to submit our proposal for the internal patch repair of the existing 84" Sanitary Sewer Tunnel for
the above referenced project.
Scope of Work:
• Mobilization
• Set-up and Operation of Two (2) EA 9,000 CFM air handlers. Air handlers will operate concurrently and
one will placed at upstream Manhole to blow air, and one will be placed at downstream Manhole to pull
air
• Third Party Safety Manager will be onsite at all times.
• Site Specific Confined space and entry/evacuation program.
• Air Monitoring of pipe for a period of no less than 48 hours before entry, to ensure a safe working
environment is available.
• Safety protocols set in place prior to man entry for three-man entry team and four-man top-side
support.
• Pre/Post Photos
• Cut and Remove existing Conduit
• Chemical Grout injection to stop active infiltration.
• Internal Patch repair with Hyperform
• Coating of repairs with Raven 405 Epoxy
• Holliday Testing of coated areas
• Estimated 3 days set up—2 days monitoring and 4 days for repairs during accessible working
flows/times
• All work to be performed while pipe is under flow, only during periods monitored to be low flow
(3 AM thru 8 AM expected entry time)

Lewis Concrete Restoration (LCR)will provide:
All labor, material, equipment, pre-approved insurance, scaffolding, safety plan and necessary safety equipment, and
supervision necessary to complete the scope of work. All material will be applied to specifications. Bypass pumping is not
included, as this work is proposed to be executed under active flow. LCR warrants workmanship (non-bonded) of scope of
work performed for 1 years. Owner or Contractor is responsible for defects and/or changes in substrate caused by owner or
acts by nature.
Client to provide: Payment Bond information required prior to mobilization.
No bypass pumping supplied by LCR. Uninterrupted access to jobsite, suitable water source for waterblasting,Any
and all traffic control. A contract or purchase order is required before any work commences. LCR job information
form,and Sales Tax Exempt/Resale certificate. All change orders require signed contract or PO prior to
commencement of work. Contractor to provide actual field measurements and timely notice within 30 days of
LCR's invoice date of discrepancies found.
