4 29, 44-31, 44-32, 44-33, AND 44-34, AND ARTICLE XI, SECTION 44-344,
5 CODE OF ORDINANCES (2018 EDITION), CITY OF ROUND ROCK,
6 TEXAS, REGARDING UTILITY RATES; AND PROVIDING FOR A
7 SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES
8 AND RESOLUTIONS.

10 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK,
11 TEXAS:
12 I.
13 That Chapter 44, Article II, Section 44-29, Code of Ordinances (2018 Edition),
14 City of Round Texas, is hereby amended to read as follows:
15 Sec. 44-29. Definitions.
16 Definitions.The following words, terms and phrases, when used in this Article II, shall have the meanings
17 ascribed to them in this section, except where the context clearly indicates a different meaning:
18 Billing period means a period of approximately 30 days between meter readings for which water
19 consumption is determined. There are four billing periods per month. Each customer's billing
20 period for water consumption will be used for all other utilities. The chief financial officer will
21 determine the billing periods for various categories of customers.
22 Bulk customer means a customer who takes water through a fire hydrant meter.
23 Commercial customer means a non-residential utility customer, including multifamily uses and
24 schools.
25 Commercial water use means water used by a commercial customer.
26 Irrigation water means water measured by a separate meter and used exclusively to irrigate
27 landscaping.
28 Irrigation water customer means any water customer who uses irrigation water.
29 Multifamily means a residential dwelling structure: (i) with more than four units, and (ii) which
30 units are not individually metered.
31 Rate block means the water volume blocks for water and irrigation water, as described in Sec.
32 44-32, subsections (a)(4) and (7).
33 Residential customer means a utility customer in any residential structure other than a
34 multifamily structure.
35 Reuse water means water used by a reuse water customer.
36 Reuse water customer means a customer of the reuse water utility.

1 Service charge means a utility base charge for each billing period.
2 Service unit is a Living Unit Equivalent as defined in accordance with Development Code,
3 Chapter 1, Article II, §150.
4 II.
5 That Chapter 44, Article 11, Section 44-31, Code of Ordinances (2018 Edition),
6 City of Round Texas, is hereby amended to read as follows:
7 Sec. 44-31. - Deposits.
8 (a) Definitions. For the purposes of this subsection, the following terms are defined as follow:
9 (1) Residential customers shall mean those customers that are zoned SF-R, SF-1, SF-2, MH, TF, or
10 TH.
11 (2) Nonresidential customers shall mean those customers that are zoned for uses other than SF-R,
12 SF-1, SF-2, MH, TF, or TH.
13 (b) Deposits for water and other utility services.
14 (1) Residential customers.
15 a. Water customer deposit. Upon making application for water or reuse water service, a
16 residential customer shall pay a water services deposit in the amount of $100.00 per
17 residential dwelling unit. This deposit will also cover sewer and/or garbage services.
18 b. Non-water customer deposit. Upon making application for sewer and/or garbage service, but
19 not water service, a residential customer not receiving water service shall pay a deposit in
20 the amount of$25.00 for sewer service and/or a deposit in the amount of$25.00 for garbage
21 service.
22 c. Deposit waiver. Deposits shall be waived for the following residential customers:
23 1. An existing customer making a new application for services who in the twelve (12)
24 months preceding the date of the new application for services:
25 i. Has not had more than one (1) late payment for services;
26 ii. Has not had services disconnected for nonpayment;
27 iii. Has not been issued more than one (1) insufficient funds notice from the city; and
28 iv. Has not engaged in meter tampering.
29 2. A new customer making an application for services who provides a letter of credit from
30 another utility, or a document the director deems comparable to a letter of credit, stating
31 that in the twelve (12) months preceding the date of application for services the
32 customer:
33 i. Has not had more than one (1) late payment for services;
34 ii. Has not had services disconnected for nonpayment; and
35 iii. Has not been issued more than one (1) insufficient funds notice from the utility.
36 3. An existing customer making a new application for services sixty-five (65) years of age
37 or older who does not have an existing past due balance at the time of application for
38 services.

1 4. A new or existing customer making an application for services who is military personnel
2 returning from deployment and presents U.S. military orders confirming deployment
3 within the last twelve (12) months.
4 d. Refund. The above deposit(s) shall be refunded to the customer when:
5 1. Service is cancelled; provided, however,that any unpaid charges shall first be deducted
6 from the deposit; or
7 2. The customer shall have 12 consecutive months of satisfactory payment history; or
8 3. The customer has completed twelve (12) consecutive months of automatic payments
9 using credit, debit, or bank draft with no more than one (1) late payment and no more
10 than one (1) insufficient funds notice issued by the city.
11 e. Additional deposit. If the city has refunded the customer's deposit for "satisfactory payment
12 history" under subsection (c) above, and thereafter the customer's service has been
13 discontinued for nonpayment or meter tampering, then the customer shall pay additional
14 deposit(s) in the same amounts as set forth above. In that event, the customer shall
15 thereafter be entitled to a satisfactory payment history deposit refund upon completion of the
16 required 12 consecutive months of satisfactory payment history, as computed from the date
17 of reconnect.

20 That Chapter 44, Article II, Section 44-32, Code of Ordinances (2018 Edition),
21 City of Round Texas, is hereby amended to read as follows:
22 Sec. 44-32. - Water rates.
23 (a) Water rates for retail customers.
24 (1) Definitions. See Sec. 44-29 for definitions.
25 (2) Determination of service units.
26 a. Conversion table. The number of service units for water service is determined by the size
27 and type of the water meter purchased for and/or providing service to the property in
28 accordance with the following schedule:

2 b. No adjustment. No adjustment in service units shall be made for water use or fire demand
3 that falls between standard meter sizes.
4 c. Adjustment for fire flows meters and multiple meters. In the event that a customer has either:
5 (i) a meter that is oversized because of fire flow requirements; or (ii) more than one meter,
6 such as where a fire flow meter is utilized in combination with a standard usage meter, the
7 director of public works shall determine the number of service units for the customer in
8 accordance with generally accepted engineering and/or planning standards and assign an
9 equivalent meter size for billing purposes.
10 (3) Revision of service unit determination. The city may revise the service unit determination of a
11 specific customer or customer class in accordance with generally accepted engineering or
12 planning standards and based on applicable historical data and trends.
13 (4) Rate blocks for residential customers by service units.

2 a. Medicaid exemption discontinued after October 1, 2005. Except as provided in subsection
3 (a)(9)b of this section, on and after October 1, 2005, the monthly water service charge
4 exemption for head of household residents eligible for Medicaid benefits will be discontinued.
5 b. Exemption for current recipients. For residential service located within the corporate city
6 limits where the head of the household is eligible for Medicaid benefits, and if said resident
7 head of household was receiving the Medicaid exemption from the monthly water service
8 charge prior to October 1, 2005, and if said resident head of household re-applies for said
9 exemption between October 1 and October 30 of each year,then the exemption from paying
10 the monthly water service charge shall continue until the head of the household is no longer
11 eligible for Medicaid benefits, as determined by federal guidelines and as administered by
12 the state.
13 c. Unlawful acceptance of exemption or discount. It shall be unlawful for any person to apply
14 for and/or receive a water rate discount or exemption from the monthly water service charge
15 if such person is not eligible to receive said discount or exemption.
16 (10) Outside city limits. The above water rates and service charges apply to all customers located
17 within the corporate limits of the city. All customers located outside of the corporate limits of
18 the city shall pay double the applicable rates charged customers within the corporate limits
19 of the city, unless a different rate is approved by the council pursuant to a contractual
20 agreement.
21 (11) Age 65 years and older.
22 a. Discounts discontinued after June 10, 1993. Except as provided below, on and after June
23 10, 1993, the water rate discount for head of household residents 65 years of age and older
24 will be discontinued. All head of household residents 65 years of age and older actually
25 receiving said discounts prior to June 10, 1993, shall continue to receive said discounts as
26 stated in this section, so long as they re-apply for said discounts before October 30 of each
27 year.
28 b. Discounts for current recipients. For residential service located within the corporate city limits
29 where the head of the household has attained the age of 65, and if said resident head of
30 household was receiving water rate discounts prior to June 10, 1993, and if said resident
31 head of household re-applies for said discounts between October 1 and October 30 of each
32 year, then the following schedule of monthly rates or charges for services furnished by the
33 city's water system shall be and such is hereby adopted and established as follows:

2 (3) Billing period service charge for single-family residential. Single-family residential homes with city
3 water service that have reuse water meters shall pay 50 percent of the billing period service
4 charges for reuse meters.
5 (4) Outside city limits. The above reuse water rates and service charges apply to all customers
6 located within the corporate limits of the city. All customers located outside of the corporate limits
7 of the city shall pay double the applicable rates charged customers within the corporate limits of
8 the city, unless a different rate is approved by the council pursuant to a contractual agreement.

1 (b) Sewer rates for retail customers outside city limits.
2 All customers located outside the corporate limits of the city shall pay double the applicable rates
3 charged to customers within the corporate limits of the city, unless a different rate is approved by the
4 council pursuant to a contractual agreement.
5 (c) Consumption of sanitary sewer service for retail customers.
6 (1) Application of volume rate. The volume rate established in (a)(1) above shall be applied to the
7 sanitary sewer service consumed by a customer.
8 (2) Winter average. Except as provided in (c)(3) and (4) below, the sanitary sewer service
9 consumed by a customer shall be based upon either the actual billing period consumption of
10 water, or upon the average of three consecutive winter billing periods beginning with the
11 customer's first billing period after November 1 of each calendar year,whichever amount is less.
12 (3) Metering system. In situations where a customer has installed, or intends to install, a metering
13 system that will accurately meter the volume of wastewater introduced into the city's sanitary
14 sewer system, the customer may make application to the city to have the customer's volume
15 rate be based on the customer's actual volume as measured by the metering system, in lieu of
16 the winter average in (c)(2) above.
17 (4) No winter average. In situations where the monthly winter average of water of water
18 consumption is not available, such as a new customer, or a customer that is not on the city's
19 water system, such customer shall be deemed to consume sanitary sewer services based on
20 the latest city-wide winter average consumption of water per living unit equivalent.
21 (d) Discounts for age 65 and older. Discounts for new customers age 65 and older have previously
22 been discontinued. However, those customers who were receiving the discount prior to June 10, 1993
23 are eligible to continue to receive the discount provided below, so long as they re-apply for said
24 discount before October 30 of each year. The discounted rate is as follows:
25
(1) Rate: ..... $1.20 per 1,000 gallons of water used; and
(2) Monthly charge: $5.50 per month regardless of the amount of water used
26
27 (e) Rates for sewer service to wholesale customers. The monthly volumetric charge for sewer service
28 to all wholesale customers, per 1,000 gallons of water used in accordance with each entity's respective
29 contractual obligation, is as follows:

33 That Chapter 44, Article XI, Section 344 Code of Ordinances (2018 Edition), City
34 of Round Texas, is hereby amended to read as follows:
35 Sec. 44-344. - Levy of drainage utility charges.
36 (a) Establishment and levy of drainage utility charges.The city does hereby establish drainage utility
37 charges as set forth herein. Drainage utility charges shall be levied against all benefitted properties
38 within the utility service area unless exempt by statute and/or ordinance.

1 (b) Fee calculation.
2 (1) Drainage utility charges calculation. Drainage utility charges shall be calculated based on the
3 total stormwater runoff potential for benefitted properties for all customers within the utility service
4 area. The total stormwater runoff potential shall be measured as impervious areas in square feet
5 (SF).
6 (2) Drainage utility charges. The total stormwater runoff potential for the service area shall be
7 allocated between the customer classes based on the relative amount of impervious area in each
8 class established by ordinance.
9 a. Residential property class. Drainage utility charges for the residential property class of
10 customers shall be as follows:
11 1. A monthly, flat-rate fee per an equivalent residential unit (ERU); or
12 2. One flat-rate ERU fee per dwelling unit on a residential parcel.
13 3. The flat-rate fee is established in the fee schedule listed herein in subsection (b)(3)a. of this
14 section.
15 4. The monthly drainage utility charge is based on the average impervious area for an ERU,which
16 is 2,900 square feet.
17 b. Nonresidential property class. A monthly drainage utility charge for each improved nonresidential
18 property or allocated portion of an improved nonresidential property shall be calculated by dividing
19 the number of square feet of the impervious area by 2,900,and multiplying the result by the monthly
20 drainage charge set forth in subsection b.(3) b.
21 (3) Schedule of monthly charge. The monthly drainage utility charge shall be as follows:
22 a. Residential units. The monthly drainage utility charge for each residential dwelling unit or ERU shall
23 be as follows:

30 (c) Applicability. This section shall be applicable to any owner or user of a benefitted property, within
31 the utility service area, to which stormwater drainage service is provided either directly or indirectly.

1 (d) Revision of rates. The city council reserves the right to review the drainage utility charges at any
2 time and may, by ordinance, increase or decrease the drainage utility charges within the schedule
3 upon a determination that the increase or decrease is warranted.

5 VII.
6 This ordinance shall be effective as of November 1, 2024.
7 VIII.
s A. All ordinances, parts of ordinances, or resolutions in conflict herewith are
9 expressly repealed.
10 B. The invalidity of any section or provision of this ordinance shall not
11 invalidate other sections or provisions thereof.
12 C. The City Council hereby finds and declares that written notice of the date,
13 hour, place and subject of the meeting at which this Ordinance was adopted was posted
14 and that such meeting was open to the public as required by law at all times during which
15 this Ordinance and the subject matter hereof were discussed, considered and formally
16 acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government
17 Code, as amended. '
