O-2024-266 - 9/26/2024 ORDINANCE NO. 0-2024-266 AN ORDINANCE AMENDING CHAPTERS 2, 34, 42, AND 44, CODE OF ORDINANCES (2018 EDITION) AND ZONING AND DEVELOPMENT CODE, CHAPTERS 1, 2, 4, 6, 8, AND 10, CODE OF ORDINANCES (2018 EDITION), REGARDING THE COMBINING OF THE TRANSPORTATION DEPARTMENT AND THE UTILITIES AND ENVIRONMENTAL SERVICES DEPARTMENT INTO A SINGLE PUBLIC WORKS DEPARTMENT AND PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS. WHEREAS, the City of Round Rock, Texas ("City), desires to combine the Transportation Department and the Utilities and Environmental Services Department into a single Public Works Department, and WHEREAS, the City desires to now amend the text of the Code of Ordinances and the Zoning and Development Code to reflect said combination of departments, and WHEREAS, the Planning and Zoning Commission held a public hearing concerning the proposed amendments on the 18th day of September, 2024, following lawful publication of the notice of said public hearing, and WHEREAS, after considering public testimony received at such hearing, the Planning and Zoning Commission has recommended the Zoning and Development Code be amended as set forth herein, and WHEREAS, on the 26th day of September, 2024, after proper notification, the City held a public hearing on the proposed amendments, and WHEREAS, the City Council determines that the amendments provided for herein promote the health, safety, morals and protects and preserves the general welfare of the community, and 0112.20242;4893-0803-5554 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That Chapter 2, Article III, Division 2, Sections 2.84-2.90, Code of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended as follows: Sec. 2-84. -Public works department. (a) Establishment of public works department. (1) The public works department of the city is hereby created. (2) The head of the department shall be the director of public works, who shall be appointed by the city manager. (b) Powers and duties of the director of public works. (1) The director of public works shall plan, direct, and review the functions of the department, including but not limited to the following: Water and wastewater line maintenance and repair, plant operations, inflow and infiltration section, utility support section, solid waste services, drainage utility, laboratory services, industrial pre-treatment, household hazardous waste services, transportation engineering, traffic operations, street maintenance and repair, the city shop, and development of short and long range plans and implementation of department goals and objectives. (2) The director of public works shall have supervision and control of the department, subject to the direction of the city manager. (3) The director of public works shall organize the department. (4) The director of public works shall promulgate policies, procedures, rules, directives, and orders for the administration of the department, including but not limited to discipline within the department. (5) Subject to the approval of the city manager, the director of public works shall appoint an individual to hold the position of the city engineer. The city engineer shall be a registered professional engineer in the State of Texas. Sec. 2-85. -General services department. (a) Establishment of general services department. (1) The general services department of the city is hereby created. (2) The head of the department shall be the director of general services department who shall be appointed by the city manager. (b) Powers and duties of the director of general services. (1) The director of general services shall plan, direct, and review all functions and operations of the department, including facilities management operations and future planning of city facilities, establishing procedures for maintenance, repair and/or replacement of facilities and grounds, administer the development of fleet administration standards and vehicle operating policies and directing the maintenance, repair replacement and disposal of vehicles and equipment. (2) The director of general services department shall have supervision and control of the department, subject to the direction of the city manager. 2 (3) The director of general services department shall organize the department. (4) The director of general services department shall promulgate policies, procedures, rules, directives, and orders for the administration of the department, including, but not limited to, discipline within the department. Sec. 2-86. -Information technology department. (a) Establishment of information technology department. (1) The information technology department of the city is hereby created. (2) The head of the department shall be the director of information technology department who shall be appointed by the city manager. (b) Powers and duties of the director of information technology. (1) The director of the information technology department shall plan, direct, and review all functions and operations of the department, including the acquisition, planning, operation, maintenance and inventory of all technology and communications equipment owned, leased or operated by the city. (2) The director of information technology shall have supervision and control of the department, subject to the direction of the city manager. (3) The director of information technology shall organize the department. (4) The director of information technology shall promulgate policies, procedures, rules, directives, and orders for the administration of the department, including, but not limited to, discipline within the department. 3 1 Sec. 2-87. -Communications and marketing department. 2 (a) Establishment of communications and marketing department. 3 (1) The communications and marketing department of the city is hereby created. 4 (2) The head of the department shall be the director of communications and marketing department 5 who shall be appointed by the city manager. 6 (b) Powers and duties of the director of communications and marketing department. 7 (1) The director of the communications and marketing department shall plan, direct, and review all 8 functions and operations of the department, including the content management of city websites, 9 city social media channels, video production and operation of government access channel(s), 10 media relations, citizen participation initiatives, city arts and culture activities, branding and 11 marketing of downtown, including events, special event permitting, and promotion and marketing 12 of the benefits of shopping locally. 13 (2) The director of communications and marketing shall have supervision and control of the 14 department, subject to the direction of the city manager. 15 (3) The director of communications and marketing shall organize the department. 16 (4) The director of communications and marketing shall promulgate policies, procedures, rules, 17 directives, and orders for the administration of the department, including, but not limited to, 18 discipline within the department. 19 Sec. 2-88. -Sports management and tourism department. 20 (a) Establishment of sports management and tourism department. 21 (1) The sports management and tourism department of the city is hereby created. 22 (2) The head of the department shall be the director of sports management and tourism department 23 who shall be appointed by the city manager. 24 (b) Powers and duties of the director of the sports management and tourism department. 25 (1) The director of the sports management and tourism department shall plan, direct, and review all 26 functions and operations of the department, including the facility management operations for the 27 sports tourism facilities owned by the city, the organization of the convention and visitors bureau, 28 and the promotion and scheduling of sports tourism events and conventions. 29 (2) The director of sports management and tourism shall have supervision and control of the 30 department, subject to the direction of the city manager. 31 (3) The director of sports management and tourism department shall organize the department. 32 (4) The director of sports management and tourism department shall promulgate policies, 33 procedures, rules, directives, and orders for the administration of the department, including, but 34 not limited to, discipline within the department. 35 Sec. 2-89. -Community and neighborhood services department. 36 (a) Establishment of the community and neighborhood services department. 37 (1) The community and neighborhood services department of the city is hereby created. 38 (2) The head of the department shall be the director of community and neighborhood services 39 department who shall be appointed by the city manager. 40 (b) Powers and duties of the director of the community and neighborhood services department. 41 (1) The director of the community and neighborhood services department shall plan, direct, and 42 review all functions and operations of the department, including the neighborhood services, code 4 1 enforcement, community development block grant (CDBG) program administration, and other 2 special projects deemed beneficial. 3 (2) The director of community and neighborhood services shall have supervision and control of the 4 department, subject to the direction of the city manager. 5 (3) The director of community and neighborhood services department shall organize the department. 6 (4) The director of community and neighborhood services department shall promulgate policies, 7 procedures, rules, directives, and orders for the administration of the department, including, but 8 not limited to, discipline within the department. 9 Secs. 2-90-2-115. - Reserved. 10 11 II. 12 That Chapter 34, Article II, Section 34-25(b)(1), Code of Ordinances (2018 13 Edition), City of Round Rock, Texas, is hereby amended as follows: 14 Sec. 34-25. - Denial or revocation. 15 (b) A special event permit shall be revoked upon the following conditions: 16 (1) In the event that the police chief, fire chief, director of public works, other city officials or their 17 designated representatives find that any of the provisions of this section, another city ordinance, 18 or state law is being violated,they shall immediately notify the city manager,and the special event 19 permit issued hereunder shall be revoked; 20 21 III. 22 That Chapter 34, Article II, Section 34-37, Code of Ordinances (2018 Edition), City 23 of Round Rock, Texas, is hereby amended as follows: 24 Sec. 34-37. -Water usage and disposal of wastewater. 25 (a) Any special event or related activity desiring use of water from the city water system must coordinate 26 with the public works department to obtain a temporary meter. Deposit for the meter and payment for 27 water used shall be in accordance with ordinances of the city. 28 (b) An applicant shall submit a plan for the disposal of wastewater and the plan shall be approved by the 29 public works department. 30 31 IV. 32 That Chapter 34, Article IV, Section 34-106, Code of Ordinances (2018 Edition), 33 City of Round Rock, Texas, is hereby amended as follows: 34 Sec. 34-106. -Water usage and disposal of wastewater. 5 1 (a) Any parade or related activity desiring use of water from the city water system must coordinate with 2 the public works department to obtain a temporary meter. Deposit for the meter and payment for water 3 used shall be in accordance with ordinances of the city. 4 (b) An applicant shall submit a plan for the disposal of wastewater and the plan shall be approved by the 5 public works department. 6 7 V. 8 That Chapter 34, Article V, Section 34-141(1), Code of Ordinances (2018 Edition), 9 City of Round Rock, Texas, is hereby amended as follows: 10 Sec. 34-141. -Revocation of a film industry production permit. 11 A film industry production permit shall be revoked upon any of the following conditions: 12 (1) In the event that the police chief, fire chief, director of public works, other city officials or their 13 designated representatives find that any of the provisions of this article, another city ordinance, 14 or state law is being violated, they shall immediately notify the city manager, and the film industry 15 production permit issued hereunder shall be revoked; 16 17 VI. 18 That Chapter 42, Article II, Division 2, Code of Ordinances (2018 Edition), City of 19 Round Rock, Texas, is hereby amended as follows: 20 DIVISION 2.-TRAFFIC ADMINISTRATION 21 22 Sec.42-42. -Duty of traffic division. 23 It shall be the duty of the traffic division, with such aid as may be rendered by other members of the 24 police department, to enforce the street traffic regulations of this city and all of the state vehicle laws; to 25 make arrests for traffic violations; to investigate accidents and to cooperate with the public works director 26 and other officers of the city in the administration of the traffic laws and in developing ways and means to 27 improve traffic conditions; and to carry out those duties specially imposed upon said division by this 28 chapter and the traffic ordinances of this city. 29 30 Sec.42-43. -Traffic division to investigate accidents. 31 It shall be the duty of the traffic division, assisted by other police officers of the department, to 32 investigate traffic accidents, and to arrest and to assist in the prosecution of those persons charged with 33 violations of law causing or contributing to such accidents. 34 Sec. 42-44.—Traffic accident studies. 35 Whenever the accidents at any particular location become numerous, the traffic division shall 36 cooperate with the public works director in conducting studies of such accidents and determining remedial 37 measures. 38 6 1 Sec. 42-45. -Traffic accident reports. 2 The traffic division shall maintain a suitable system of filing traffic accident reports. Accident reports 3 or cards referring to them shall be filed alphabetically by location. Such reports shall be available for the 4 use and information of the public works director. 5 Sec.42-46. -Emergency and experimental regulations. 6 (a) The chief of police, by and with the approval of the public works director, is hereby empowered to 7 make regulations necessary to make effective the provisions of the traffic ordinances of this city and 8 to make and enforce temporary or experimental regulations to cover emergencies or special 9 conditions. No such temporary or experimental regulation shall remain in effect for more than 90 days. 10 (b) The public works director may test traffic control devices under actual conditions of traffic. 11 Secs.42-47-42-65. -Reserved. 12 13 VII. 14 That Chapter 42, Article II, Division 4, Section 42-101 , Code of Ordinances (2018 15 Edition), City of Round Rock, Texas, is hereby amended as follows: 16 Sec. 42-101. -Authority to install traffic control devices. 17 The public works director shall place and maintain official pavement markings, traffic control signs, 18 signals, and devices when and as required under the traffic ordinances of this city to make effective the 19 provisions of said ordinances, and may place and maintain such additional official traffic control devices 20 as he may deem necessary to regulate, warn, or guide traffic under the traffic ordinances of this city or 21 the state traffic laws. 22 23 Vlll. 24 That Chapter 42, Article II, Division 6, Sections 42-157 and 42-158, Code of 25 Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended as follows: 26 Sec. 42-157. -Authority to place devices altering normal course of turns. 27 The public works director is authorized to place official traffic control devices within or adjacent to 28 intersections indicating the course to be traveled by vehicles turning at such intersections, and such 29 course to be traveled as so indicated may conform to or be other than as prescribed by law. 30 Sec. 42-158. -Authority to place restricted turn signs. 31 The public works director is hereby authorized to determine those intersections at which drivers of 32 vehicles shall not make a right, left, or U-turn, and shall place proper signs at such intersections. The 33 making of such turns may be prohibited between certain hours of any day and permitted at other hours, in 34 which event the same shall be plainly indicated on the signs. 35 36 IX. 7 1 That Chapter 42, Article 11, Division 7, Section 42-191 , Code of Ordinances (2018 2 Edition), City of Round Rock, Texas, is hereby amended as follows: 3 Sec.42-191. -Authority to sign one-way streets and alleys. 4 Whenever any ordinance of this city designates any one-way street or alley, the public works director 5 shall place and maintain signs giving notice thereof, and no such regulation shall be effective unless such 6 signs are in place. Signs indicating the direction of lawful traffic movement shall be placed at every 7 intersection where movement of traffic in the opposite direction is prohibited. 8 9 X. 10 That Chapter 42, Article 11, Division 8, Sections 42-223, 42-224, and 42-225, Code 11 of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended as follows: 12 Sec. 42-223. -Stop and yield intersections. 13 The city council may by ordinance designate any street intersection as a stop intersection and 14 designate the streets upon which vehicles shall stop before entering such intersections. In addition, the 15 city council may designate that traffic on any street shall yield to traffic on an intersecting street. 16 Whenever any intersection has been so designated, the public works director shall supervise the erection 17 and maintenance of stop signs or yield signs as specified by the city council and maintain an inventory of 18 such signs. Ordinances designating stop and yield intersections have not been included in this Code and 19 are on file in the office of the city clerk. 20 Sec.42-224. -Traffic signal controlled intersections. 21 The city council may designate, by ordinance or agreement with the state department of highways 22 and public transportation, intersections at which traffic shall be controlled by electronic traffic control lights 23 or signals. Whenever any intersection has been so designated, the public works director shall supervise 24 the erection and maintenance of traffic control signals or lights as specified by the state or city council and 25 maintain an inventory of such signs. Ordinances and agreements designating traffic signal controlled 26 intersections have not been included in this Code and are on file in the office of the city clerk. 27 Sec.42-225. -Crosswalks, safety zones, and traffic lanes. 28 The public works director is hereby authorized to supervise the designation and maintenance, by 29 appropriate devices, markings or lines upon the surface of the roadway, of crosswalks at any intersection 30 where, in his opinion, there is particular danger to pedestrians crossing the roadway, and at such other 31 places as he may deem necessary; to supervise the establishment of safety zones of such kind and 32 character and at such places as he may deem necessary for the protection of pedestrians; and to 33 supervise the marking of lanes for traffic on the street pavement at such places as he may deem 34 advisable, consistent with this chapter and state law. 35 8 1 XI. 2 That Chapter 42, Article 11, Division 11, Section 42-315, Code of Ordinances (2018 3 Edition), City of Round Rock, Texas, is hereby amended as follows: 4 Sec. 42-315. -Parking near hazardous or congested places. 5 (a) The public works director is hereby authorized to determine and designate by proper signs, places 6 not exceeding 1,000 feet in length in which the stopping, standing, or parking of vehicles would create 7 an especially hazardous condition or would cause unusual delay to traffic. 8 (b) When official signs are erected at hazardous or congested places as authorized herein, no person 9 shall stop, stand, or park a vehicle in any such designated place. 10 11 XII. 12 That Chapter 42, Article V, Section 42-506(e), Code of Ordinances (2018 Edition), 13 City of Round Rock, Texas, is hereby amended as follows: 14 Sec. 42-506. -Assessment of roadway impact fees. 15 (e) The director of public works shall compute the assessment of roadway impact fees for new 16 development by first determining whether the new development is eligible for offsets calculated in 17 accordance with section 42-508, which would further reduce roadway impact fees otherwise due in 18 whole or in part. 19 20 XIII. 21 That Chapter 42, Article V, Section 42-511(d)(3), Code of Ordinances (2018 22 Edition), City of Round Rock, Texas, is hereby amended as follows: 23 Sec. 42-511. Appeals. 24 25 (d) Along with the notice of appeal, an applicant may request an alternative service unit 26 computation for land uses not contained within the latest edition of the ITE Trip Generation 27 Manual by submitting a trip generation study demonstrating the appropriateness of the trip 28 generation rates for the proposed development. An applicant may also include an alternative 29 Service Unit calculation. 30 31 (3) Any exceptions to the requirements set forth in subsections (1) or (2) above must be 32 approved by the director of public works. 33 9 I XIV. 2 That Chapter 44, Article I, Section 44-5, Code of Ordinances (2018 Edition), City 3 of Round Rock, Texas, is hereby amended to amend the definition of director to read as 4 follows: 5 Sec.44-5. -Definitions. 6 The following words, terms and phrases, when used in this chapter, shall have the meanings 7 ascribed to them in this section, except where the context clearly indicates a different meaning: 8 Director means the public works director or his designee. 9 10 XV. 11 That Chapter 44, Article II, Section 44-32(a)(2)c., Code of Ordinances (2018 12 Edition), City of Round Rock, Texas, is hereby amended as follows: 13 Sec.44-32. -Water rates. 14 (a) Water rates for retail customers. 15 (2) Determination of service units. 16 c. Adjustment for fire flows meters and multiple meters. In the event that a customer has either: 17 (i) a meter that is oversized because of fire flow requirements; or (ii) more than one meter, 18 such as where a fire flow meter is utilized in combination with a standard usage meter, the 19 director of public works shall determine the number of service units for the customer in 20 accordance with generally accepted engineering and/or planning standards and assign an 21 equivalent meter size for billing purposes. 22 23 XVI. 24 That Chapter 44, Article VII, Section 44-174, Code of Ordinances (2018 Edition), 25 City of Round Rock, Texas, is hereby amended to amend the definition of directorto read as 26 follows: 27 Sec.44-174. -Definitions. 28 For the purpose of this article, the following definitions shall apply unless the context clearly indicates 29 or requires a different meaning. If a word used in this article is not contained in the following list, it shall 30 have the definition listed in section 44-5 or in the most recent edition of the Manual of Cross Connection 31 Control published by the Foundation for Cross-Connection Control and Hydraulic Research, University of 32 Southern California. The following definitions shall apply to this article: 33 Director means director of public works, or his designee. 10 1 2 XVII. 3 That Chapter 44, Article VII, Section 44-177(a)(10), Code of Ordinances (2018 4 Edition), City of Round Rock, Texas, is hereby amended as follows: 5 Sec.44-177. -Protection required; installation. 6 (a) The assembly protection which is required under this article shall be any of the duly authorized 7 assemblies listed in the Uniform Plumbing Code, or as determined by the director. Each assembly 8 must be approved in writing by the director in conjunction with the chief building inspector of the city 9 prior to installation. Failure to obtain such written approval prior to installation of the assembly may 10 result in the assembly failing to meet final approval by the director. The director shall determine the 11 type and location of assembly to be installed within the area served by the city. An assembly shall be 12 required in each of the following circumstances, but the director is not limited to requiring the 13 installation of an assembly only in the following circumstances: 14 (10) An appropriate cross connection survey report form has not been filed with the public works 15 department of the city after a request by the city. 16 XVIII. 17 That Chapter 44, Article IX, Section 44-272 Code of Ordinances (2018 Edition), 18 City of Round Rock, Texas, is hereby amended to amend the definition of directorto read as 19 follows: 20 Sec. 44-272. -Definitions. 21 For the purposes of this article, the following words, terms and phrases, shall have the meaning 22 ascribed to them except where the context clearly indicates a different meaning: 23 Director shall mean the public works director or his designee. 24 25 XIX. 26 That Chapter 44, Article XIII, Section 44-435(e), Code of Ordinances (2018 27 Edition), City of Round Rock, Texas, is hereby amended as follows: 28 Sec. 44-435. -Network nodes in the public right-of-way; maximum height; other requirements. 29 (e) Installation in municipal parks and residential areas. A network provider may not install a new node 30 support pole in a public right-of-way without the city's discretionary, nondiscriminatory, written consent 31 of the public works director if the public right-of-way is located in a municipal park or is adjacent to a 32 street or thoroughfare that is: 1) not more than 50 feet wide; and 2)adjacent to single-family residential 33 lots or other multifamily residences or undeveloped land that is designated for residential use by zoning 34 or deed restrictions. A network provider shall comply with private deed restrictions and other private 35 restrictions when installing network nodes in parks and residential areas. 11 1 2 XX. 3 That Zoning and Development Code, Chapter 1 , Article 111, Section 1-50, Code of 4 Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended to amend or 5 repeal definitions to be placed in their proper alphabetical order in said section: 6 CHAPTER 1. INTRODUCTORY PROVISIONS 7 Sec. 1-50. - Definitions. 8 The purpose of this section is to define words, terms and phrases contained within this code, unless 9 otherwise specifically defined elsewhere herein. Definitions for words not defined below may be defined 10 elsewhere in the City of Round Rock Code of Ordinances or found in Webster's Dictionary of the English 11 language, unabridged, subject to interpretation by the PDS director. 12 Term Definition Public Works The director of the public works department of the city, or an authorized director representative 13 14 XXI. 15 That Zoning and Development Code, Chapter 2, Article VI, Section 2-71(d)(2), 16 Code of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended as 17 follows: 18 Sec. 2-71. - MU-1 (Mixed-Use Historic Commercial Core) district. 19 (d) Supplementary development standards. In addition to the applicable standards found in Chapter 8 of 20 this code, the following regulations apply to the MU-1 district: 21 (2) Traffic impact and parking generation studies. 22 a. A traffic impact analysis (TIA) shall not be required for any development in the MU-1 district. 23 b. A parking generation study shall be required for any new development, conversion, or 24 change of use within a building that has a gross floor area of greater than 10,000 square 25 feet, and for an assembly use of any size, such as an event center. The parking generation 26 study shall include the following: 27 1. A demand analysis of parking need based on industry standards; and 28 2. Characteristics of those using parking, including turnover rate. 12 1 c. In instances where a required parking generation study determines that a use will utilize ten 2 or more on-street parking spaces at a turnover rate of greater than every two hours, the use 3 shall be required to identify alternative parking solutions. Alternative solutions may include a 4 shared parking agreement as described in Sec. 8-47, on-site parking, or other solution as 5 approved by the public works director. 6 7 XXII. 8 That Zoning and Development Code, Chapter 2, Article VI, Section 2-72(d)(1)b.1 ., 9 Code of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended as 10 follows: 11 Sec. 2-72. - MU-2 (Mixed-Use Downtown Medium Density)district. 12 (d) Supplementary development standards. In addition to the applicable standards found in Chapter 8 of 13 this code, the following regulations apply to the MU-2 district: 14 (1) Parking. In accordance with the downtown master plan, the following standards are meant to 15 encourage a pedestrian-friendly environment by minimizing curb cuts and the presence of on-site 16 parking. Where on-site parking is incorporated, it shall be placed in an unobtrusive location that 17 minimizes impacts to pedestrian circulation. 18 b. On-site parking may consist of surface-level or structured parking. 19 1. On-site parking is not required for nonresidential establishments, with the following 20 exceptions: 21 i. Overnight accommodations at the ratio provided in Sec. 8-46. 22 ii. The residential portion of a live/work unit. 23 iii. Parking determined to be required as a result of a parking generation study 24 performed in accordance with subsection (2) below. Alternative solutions may 25 include a shared parking agreement as described in Sec. 8-47, on-site parking, or 26 other solution as approved by the public works director. 27 28 XXIII. 29 That Zoning and Development Code, Chapter 2, Article VI, Section 2-72(d)(2)b., 30 Code of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended as 31 follows: 32 Sec. 2-72. -MU-2(Mixed-Use Downtown Medium Density)district. 33 (d) Supplementary development standards. In addition to the applicable standards found in Chapter 8 of 34 this code, the following regulations apply to the MU-2 district: 35 (2) Traffic impact and parking generation studies. 36 b. A parking generation study for nonresidential uses shall be required for any new 37 development, conversion, or change of use within a building that has a gross floor area of 13 1 greater than 10,000 square feet, and for an assembly use of any size, such as an event 2 center. 3 1. The parking generation study shall include the following criteria: 4 i. A demand analysis of parking need based on industry standards. 5 ii. Characteristics of those using parking, including turnover rate. 6 2. In instances where a required parking generation study determines that a use will utilize 7 ten or more on-street parking spaces at a turnover rate of greater than every two hours, 8 the use shall be required to identify alternative parking solutions. Alternative solutions 9 may include a shared parking agreement as described in subsection Sec. 8-47, on-site 10 parking, or other solution as approved by the public works director. 11 12 XXIV. 13 That Zoning and Development Code, Chapter 2, Article VI, Section 2-73(d)(1)i., 14 Code of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended as 15 follows: 16 Sec. 2-73.-MU-L(Mixed-Use Limited)district. 17 (d) Supplementary development standards. In addition to the applicable standards found in Chapter 8 of 18 this code, the following regulations apply to the MU-L district: 19 (1) Parking. In accordance with the downtown master plan, the following standards are meant to 20 encourage a pedestrian-friendly environment by minimizing curb cuts and the visual presence of 21 on-site parking. 22 i. On-street parking requirements. 23 1. Diagonal parking shall be utilized on the following streets: North Lewis Street, North or 24 South Stone Street, North or South Black Street, North Nelson Street, and North 25 College Street. 26 2. Parallel parking shall be utilized on the following streets: East Liberty Avenue, East 27 Bagdad Avenue, East Austin Avenue, Park Way, and Timberwood Drive. 28 3. On-street parking is prohibited on East Main Street without prior written approval from 29 the public works director. 30 4. The materials and design for all on-street parking shall be approved by the public works 31 director. 32 33 XXV. 34 That Zoning and Development Code, Chapter 2, Article VI, Section 2-74(d)(1)a., 35 Code of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended as 36 follows: 37 Sec. 2-74. -MU-R(Mixed-Use Redevelopment and Small Lot)district. 14 1 (d) Supplementary development standards. Residential driveways for 22 double frontage lots and corner lots must be located on the lesser classification street. Driveways 23 serving single-family,two-family or single-lot townhouse residences are prohibited on major collectors 24 or arterial streets unless the public works director determines no other access is possible. 25 (b) Common-lot townhouse, as defined in Sec. 1-50, multifamily, and nonresidential driveways are 26 permitted on all streets; however, the driveways must have a minimum of 200 feet spacing between 27 driveways on arterial streets and from the street centerline at an intersection. 28 (c) The driveway restrictions above do not prohibit driveway access to alleys. Alley driveway access may 29 be permitted upon approval of a TIA by the public works director. 30 (d) Driveway construction shall be in accordance with the Design and Construction Standards. 31 16 1 XXVIII. 2 That Zoning and Development Code, Chapter 4, Article IV, Section 4-56(c)(3), 3 Code of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended as 4 follows: 5 Sec.4-56. -Gated communities. 6 (c) General requirements. All gated community PUDs shall include the following minimum requirements 7 in the PUD ordinance and/or development plan included therein: 8 (3) Any type of gate or controlled access means or mechanism is subject to the approval of the city's 9 fire marshal, and any corrective action shall be the responsibility of the property owners 10 association. The location of any such gate or controlled access means or mechanism and any 11 associated appurtenances shall be subject to the approval of the public works director, and shall 12 not impede necessary sight lines for traffic, nor create vehicular stacking that adversely affects 13 an adjacent street. A turnaround area subject to the approval of the public works director shall be 14 provided on the exterior side of any such gate or controlled access means or mechanism to allow 15 traffic to reverse direction. This reserve fund shall be 28 maintained in a separate account and may not be co-mingled with any other property owners 29 association funds.A portion of the assessments levied by the property owners association will be 30 placed in the street maintenance fund. The portion of the assessments collected from lot owners 31 and placed in the street maintenance fund will be based on the current maintenance and 32 replacement schedule prepared and certified by a licensed engineer or an individual holding an 33 RS ("reserve specialist") designation from the Community Associations Institute. In conjunction 34 with approval of the final plat, the basis and formula for calculating the amount of assessments to 35 be deposited in the street maintenance fund, shall be subject to review and approval by the 36 director of public works and the PDS director. The property owners association shall provide to 37 the city: (i) annually an affidavit setting forth the fund balance and any expenditures therefrom; 38 and (ii) at least once every three years, an updated maintenance and replacement schedule 39 prepared and certified by a licensed engineer or a reserve specialist. No more than once annually, 40 the basis and formula for calculating the amount of assessments to be deposited in the street 17 1 maintenance fund may be amended, subject to the review and approval of the director of public 2 works and the city PDS director. 3 (5) The community covenants shall provide that the streets within the gated community are private, 4 owned and maintained by the property owners association and that the city has no obligation to 5 maintain or reconstruct the private streets, nonpublic storm sewers and drainage facilities. The 6 covenants shall include the following provision: 7 "The property owners association shall be responsible for contacting the City of Round Rock 8 Public Works Department every two years, or as needed, from time of initial completion to 9 schedule an inspection, to include city staff and the property owners association's 10 representative for reviewing the private streets". 11 XXX. 12 That Zoning and Development Code, Chapter 4, Article VI, Sections 4-77(a)(1) and 13 4-78(a), Code of Ordinances (2018 Edition), City of Round Rock, Texas, are hereby 14 amended as follows: 15 Sec. 4-77. -Wastewater system. 16 (a) Sewer service to each lot inside city limits;connection with wastewater system required. 17 (1) Connection to the city's wastewater system shall be required except where the director of public 18 works determines that such connection would require unreasonable expenditure of funds when 19 compared with alternate methods of sewage disposal. Where alternative sewage disposal is 20 permitted, the plans for such system must meet the requirements of the TCEQ and be approved 21 by the county health department, prior to approval of the final plat by the planning and zoning 22 commission. 23 Sec.4-78. -Oversize mains. 24 (a) Size of mains. All water and wastewater mains shall be installed in accordance with the water and 25 wastewater master plan maintained by the public works director.All water and wastewater mains shall 26 be sized to provide necessary service to the tract to be developed.The cost of water mains up to eight 27 inches, or of a size required to serve a tract being developed, whichever is larger, shall be paid in full 28 by the developer. 29 30 XXXI. 31 That Zoning and Development Code, Chapter 4, Article VII, Section 4-86(b)(2), 32 Code of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended as 33 follows: 34 Sec. 4-86. -On-site facilities, regional program, and fees. 35 (b) Regional stormwater management program. 36 (2) Regional storm water management program fees. 18 1 a. The fees are as follows: $ 800.00/acre Single-family $1,600.00/acre Multifamily $2,400.00/acre Commercial/Industrial 2 1. Upon approval of participation, the full fee will be due prior to approval of construction 7 plans for single-family projects and upon building permit approval for multifamily, 8 commercial, and industrial projects. 9 10 XXXII. 11 That Zoning and Development Code, Chapter 4, Article VIII, Section 4-96(c)(3), 12 Code of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended as 13 follOWS: 14 Sec. 4-96. -Construction of public improvements. 15 (c) Sidewalk construction. 16 (3) Deferment of sidewalk construction. Sidewalks shall be installed in accordance with subsections 17 (c)(1) and (2) of this section, except under the following circumstances, as determined by the 18 public works director: 19 a. Where the existing cross section of the street makes immediate construction of a sidewalk 20 impractical; 21 b. Where a nonresidential subdivision abutting an existing street is isolated from any other 22 sidewalk by a distance of twice the frontage of the subdivision; or 23 c. Where construction or reconstruction of the street where a sidewalk is to be placed is 24 imminent and the sidewalk would be destroyed if constructed. 25 d. Where construction of a single-family home within a residential subdivision would potentially 26 damage or destroy a sidewalk immediately adjacent to the lot, the sidewalk shall be 27 constructed prior to issuance of a certificate of occupancy for each individual residence. 28 The city may require a cash payment by the developer in lieu of construction of the sidewalk if 29 the public works director determines that the sidewalk should not be built within the three-year 30 period of the construction plans. The cash payment shall equal the city's estimate of the cost of 31 constructing and installing the sidewalk and associated features, such as but not limited to 32 appurtenances and drainage features, at the time of permit issuance of the public 33 improvements. The developer shall pay the cash payment prior to the issuance of the public 34 improvements permit. 19 1 XXXIII. 2 That Zoning and Development Code, Chapter 6, Article I, Section 6-1(c), Code of 3 Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended as follows: 4 Sec. 6-1.-General policy. 5 (c) Streets shall be provided to the boundary lines of the tract being subdivided, unless the public works 6 director determines that such an extension is neither necessary, nor desirable. 7 XXXIV. 8 That Zoning and Development Code, Chapter 6, Article II, Section 6-11(a)(1) and 9 (g), Code of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended 10 as follows: 11 Sec. 6-11. -Streets. 12 (a) Street classification and characteristics. 13 (1) Local streets. The purpose of a local street is to provide lot street frontage and carry traffic to a 14 higher classification street. Local streets are divided into three subcategories: Local-residential, 15 local-nonresidential or local-rural. Unless approved by the public works director, a local street 16 shall not connect to two separate higher classification streets or connect directly to arterial streets. 17 Local streets may be designated as private streets. 18 (g) Curbing.All streets shall have standard curbing and gutter except for the local-rural street classification 19 where ribbon curb is allowed. All raised medians and islands located within the street pavement shall 20 be bordered by standard curb and gutter, unless otherwise approved by the public works director. All 21 concrete curb and gutter shall be installed and constructed according to the Design and Construction 22 Standards. 23 24 XXXV. 25 That Zoning and Development Code, Chapter 6, Article II, Sections 6-13 and 6-14, 26 Code of Ordinances (2018 Edition), City of Round Rock, Texas, are hereby amended as 27 follows: 28 Sec. 6-13. -Medians and islands. 29 (a) Standards. Medians and islands shall be landscaped with grass turf or constructed of stamped pattern 30 concrete, brick, stone or concrete pavers, or other engraved concrete surfaces approved by PDS 31 director. Grass turf areas shall not be less than six feet in width. All medians and islands shall be 32 bordered by standard curb and gutter, unless otherwise approved by the public works director. 33 (b) Median openings. Median openings on arterial streets shall be in accordance with the Design and 34 Construction Standards. 20 1 Sec. 6-14. -Intersections. 2 (a) Proposed intersections shall be designed to meet the minimum spacing requirements, curb radii, and 3 corner sight distances required in the Design and Construction Standards, and based on the following 4 design specifications: 5 (1) Streets shall intersect at right angles. In the event of physical constraints that prevent right 6 angles, a modification of up to 20 degrees may be permitted by the planning and zoning 7 commission upon recommendation by the public works director. 8 (2) The right-of-way line at street intersections shall be in accordance with the Design and 9 Construction Standards. 10 (3) The centerline of intersecting streets shall be a minimum of 200 feet from other street 11 intersections. This offset shall not apply to streets intersecting a street if a raised median is 12 provided and no median opening is aligned with either of the offset streets. Future median 13 openings are prohibited where two streets offset and intersect an arterial street at a distance of 14 less than 200 feet; provided, however, median openings may be allowed for one-way traffic 15 circulation subject to the approval of the public works director. 16 17 XXXVI. 18 That Zoning and Development Code, Chapter 6, Article II, Section 6-18(a), Code 19 of Ordinances (2018 Edition), City of Round Rock, Texas, are hereby amended as 20 follows: 21 Sec. 6-18. -Signage,striping and signalization. 22 (a) Signage and striping. The developer shall design, install and pay all costs for traffic control signs and 23 pavement striping. Accident reports 3 or cards referring to them shall be filed alphabetically by location. Such reports shall be available for the 4 use and information of the public works director. 5 Sec. 42-46. - Emergency and experimental regulations. 6 (a) The chief of police, by and with the approval of the transpeFtatien public works director, is hereby 7 empowered to make regulations necessary to make effective the provisions of the traffic ordinances 8 of this city and to make and enforce temporary or experimental regulations to cover emergencies or 9 special conditions. No such temporary or experimental regulation shall remain in effect for more than 10 90 days. 11 (b) The ffan6pertation public works director may test traffic control devices under actual conditions of 12 traffic. 13 Secs.42-47-42-65. -Reserved. 14 15 VII. 16 That Chapter 42, Article ll, Division 4, Section 42-101, Code of Ordinances (2018 17 Edition), City of Round Rock, Texas, is hereby amended as follows: 18 Sec.42-101. -Authority to install traffic control devices. 19 The tFaRSpertatien public works director shall place and maintain official pavement markings, traffic 20 control signs, signals, and devices when and as required under the traffic ordinances of this city to make 21 effective the provisions of said ordinances, and may place and maintain such additional official traffic 22 control devices as he may deem necessary to regulate, warn, or guide traffic under the traffic ordinances 23 of this city or the state traffic laws. 24 25 VIII. 26 That Chapter 42, Article II, Division 6, Sections 42-157 and 42-158, Code of 27 Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended as follows: 28 Sec.42-157. -Authority to place devices altering normal course of turns. 29 The tFan6peFtatien public works director is authorized to place official traffic control devices within or 30 adjacent to intersections indicating the course to be traveled by vehicles turning at such intersections, and 31 such course to be traveled as so indicated may conform to or be other than as prescribed by law. 32 Sec. 42-158.-Authority to place restricted turn signs. 33 The tFaRspertation public works director is hereby authorized to determine those intersections at 34 which drivers of vehicles shall not make a right, left, or U-turn, and shall place proper signs at such 35 intersections. The making of such turns may be prohibited between certain hours of any day and 36 permitted at other hours, in which event the same shall be plainly indicated on the signs. 37 7 1 IX. 2 That Chapter 42, Article II, Division 7, Section 42-191, Code of Ordinances (2018 3 Edition), City of Round Rock, Texas, is hereby amended as follows: 4 Sec.42-191. -Authority to sign one-way streets and alleys. 5 Whenever any ordinance of this city designates any one-way street or alley, the transportation public 6 works director shall place and maintain signs giving notice thereof, and no such regulation shall be 7 effective unless such signs are in place. Signs indicating the direction of lawful traffic movement shall be 8 placed at every intersection where movement of traffic in the opposite direction is prohibited. 9 10 X. 11 That Chapter 42, Article II, Division 8, Sections 42-223, 42-224, and 42-225, Code 12 of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended as follows: 13 Sec. 42-223. -Stop and yield intersections. 14 The city council may by ordinance designate any street intersection as a stop intersection and 15 designate the streets upon which vehicles shall stop before entering such intersections. In addition, the 16 city council may designate that traffic on any street shall yield to traffic on an intersecting street. 17 Whenever any intersection has been so designated, the traaspertatiGR public works director shall 18 supervise the erection and maintenance of stop signs or yield signs as specified by the city council and 19 maintain an inventory of such signs. Ordinances designating stop and yield intersections have not been 20 included in this Code and are on file in the office of the city clerk. 21 Sec.42-224.-Traffic signal controlled intersections. 22 The city council may designate, by ordinance or agreement with the state department of highways 23 and public transportation, intersections at which traffic shall be controlled by electronic traffic control lights 24 or signals. Whenever any intersection has been so designated, the transpertatier) public works director 25 shall supervise the erection and maintenance of traffic control signals or lights as specified by the state or 26 city council and maintain an inventory of such signs. Ordinances and agreements designating traffic 27 signal controlled intersections have not been included in this Code and are on file in the office of the city 28 clerk. 29 Sec.42-22S.-Crosswalks, safety zones,and traffic lanes. 30 The transportation public works director is hereby authorized to supervise the designation and 31 maintenance, by appropriate devices, markings or lines upon the surface of the roadway, of crosswalks at 32 any intersection where, in his opinion, there is particular danger to pedestrians crossing the roadway, and 33 at such other places as he may deem necessary; to supervise the establishment of safety zones of such 34 kind and character and at such places as he may deem necessary for the protection of pedestrians; and 35 to supervise the marking of lanes for traffic on the street pavement at such places as he may deem 36 advisable, consistent with this chapter and state law. 37 8 1 XI. 2 That Chapter 42, Article II, Division 11, Section 42-315, Code of Ordinances (2018 3 Edition), City of Round Rock, Texas, is hereby amended as follows: 4 Sec.42-315. -Parking near hazardous or congested places. 5 (a) The transportation public works director is hereby authorized to determine and designate by proper 6 signs, places not exceeding 1,000 feet in length in which the stopping, standing, or parking of vehicles 7 would create an especially hazardous condition or would cause unusual delay to traffic. 8 (b) When official signs are erected at hazardous or congested places as authorized herein, no person 9 shall stop, stand, or park a vehicle in any such designated place. 10 11 XII. 12 That Chapter 42, Article V, Section 42-506(e), Code of Ordinances (2018 Edition), 13 City of Round Rock, Texas, is hereby amended as follows: 14 Sec. 42-506.-Assessment of roadway impact fees. 15 (e) The director of transpertationpublic works shall compute the assessment of roadway impact fees for 16 new development by first determining whether the new development is eligible for offsets calculated 17 in accordance with section 42-508, which would further reduce roadway impact fees otherwise due in 18 whole or in part. 19 20 XIII. 21 That Chapter 42, Article V, Section 42-511(d)(3), Code of Ordinances (2018 22 Edition), City of Round Rock, Texas, is hereby amended as follows: 23 Sec. 42-511. Appeals. 24 25 (d) Along with the notice of appeal, an applicant may request an alternative service unit 26 computation for land uses not contained within the latest edition of the ITE Trip Generation 27 Manual by submitting a trip generation study demonstrating the appropriateness of the trip 28 generation rates for the proposed development. An applicant may also include an alternative 29 Service Unit calculation. 30 31 (3) Any exceptions to the requirements set forth in subsections (1) or (2) above must be 32 approved by the director of traaspertatieepublic works. 33 9 1 XIV. 2 That Chapter 44, Article I, Section 44-5, Code of Ordinances (2018 Edition), City 3 of Round Rock, Texas, is hereby amended to amend the definition of director to read as 4 follows: 5 Sec. 44-5. - Definitions. 6 The following words, terms and phrases, when used in this chapter, shall have the meanings 7 ascribed to them in this section, except where the context clearly indicates a different meaning: 8 Director means the director of utilities for the GityPublic works director or his designee. 9 10 XV. 11 That Chapter 44, Article ll, Section 44-32(a)(2)c., Code of Ordinances (2018 12 Edition), City of Round Rock, Texas, is hereby amended as follows: 13 Sec.44-32. -Water rates. 14 (a) Water rates for retail customers. 15 (2) Determination of service units. 16 c. Adjustment for fire flows meters and multiple meters. In the event that a customer has either: 17 (i) a meter that is oversized because of fire flow requirements; or (ii) more than one meter, 18 such as where a fire flow meter is utilized in combination with a standard usage meter, the 19 director of utilitisspublic works shall determine the number of service units for the customer 20 in accordance with generally accepted engineering and/or planning standards and assign an 21 equivalent meter size for billing purposes. 22 23 XVI. 24 That Chapter 44, Article VII, Section 44-174, Code of Ordinances (2018 Edition), 25 City of Round Rock, Texas, is hereby amended to amend the definition of director to read as 26 follows: 27 Sec.44-174.-Definitions. 28 For the purpose of this article, the following definitions shall apply unless the context clearly indicates 29 or requires a different meaning. If a word used in this article is not contained in the following list, it shall 30 have the definition listed in section 44-5 or in the most recent edition of the Manual of Cross Connection 31 Control published by the Foundation for Cross-Connection Control and Hydraulic Research, University of 32 Southern California. The following definitions shall apply to this article: 33 Director means director of ut l'fies and environmental sew'Gespublic works, or his designee. 10 1 2 XVII. 3 That Chapter 44, Article VII, Section 44-177(a)(10), Code of Ordinances (2018 4 Edition), City of Round Rock, Texas, is hereby amended as follows: 5 Sec. 44-177.- Protection required; installation. 6 (a) The assembly protection which is required under this article shall be any of the duly authorized 7 assemblies listed in the Uniform Plumbing Code, or as determined by the director. Each assembly 8 must be approved in writing by the director in conjunction with the chief building inspector of the city 9 prior to installation. Failure to obtain such written approval prior to installation of the assembly may 10 result in the assembly failing to meet final approval by the director. The director shall determine the 11 type and location of assembly to be installed within the area served by the city. An assembly shall be 12 required in each of the following circumstances, but the director is not limited to requiring the 13 installation of an assembly only in the following circumstances: 14 (10) An appropriate cross connection survey report form has not been filed with the u#4ty-public works 15 department of the city after a request by the city. 16 XVIII. 17 That Chapter 44, Article IX, Section 44-272 Code of Ordinances (2018 Edition), 18 City of Round Rock, Texas, is hereby amended to amend the definition of director to read as 19 follows: 20 Sec. 44-272. - Definitions. 21 For the purposes of this article, the following words, terms and phrases, shall have the meaning 22 ascribed to them except where the context clearly indicates a different meaning: 23 Director shall mean the 24 25 direGtw's des;^^^^public works director or his designee. 26 27 M. 28 That Chapter 44, Article XIII, Section 44-435(e), Code of Ordinances (2018 29 Edition), City of Round Rock, Texas, is hereby amended as follows: 30 Sec. 44-435.-Network nodes in the public right-of-way; maximum height; other requirements. 31 (e) Installation in municipal parks and residential areas. A network provider may not install a new node 32 support pole in a public right-of-way without the city's discretionary, nondiscriminatory, written consent 33 of the utility and 8RV'r^^m^^'_a' -SerViGespublic works director if the public right-of-way is located in a 34 municipal park or is adjacent to a street or thoroughfare that is: 1) not more than 50 feet wide, and 2) 35 adjacent to single-family residential lots or other multifamily residences or undeveloped land that is 36 designated for residential use by zoning or deed restrictions. In addition to the applicable standards found in Chapter 8 of 22 this code, the following regulations apply to the MU-1 district: 23 (2) Traffic impact and parking generation studies. 24 a. A traffic impact analysis (TIA)shall not be required for any development in the MU-1 district. 25 b. A parking generation study shall be required for any new development, conversion, or 26 change of use within a building that has a gross floor area of greater than 10,000 square 12 1 feet, and for an assembly use of any size, such as an event center. The parking generation 2 study shall include the following: 3 1. A demand analysis of parking need based on industry standards, and 4 2. Characteristics of those using parking, including turnover rate. 5 c. In instances where a required parking generation study determines that a use will utilize ten 6 or more on-street parking spaces at a turnover rate of greater than every two hours, the use 7 shall be required to identify alternative parking solutions.Alternative solutions may include a 8 shared parking agreement as described in Sec. 8-47, on-site parking, or other solution as 9 approved by the trans public works director. 10 11 XXII. 12 That Zoning and Development Code, Chapter 2, Article VI, Section 2-72(d)(1)b.1., 13 Code of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended as 14 follows: 15 Sec. 2-72. - MU-2 (Mixed-Use Downtown Medium Density)district. 16 (d) Supplementary development standards. In addition to the applicable standards found in Chapter 8 of 17 this code, the following regulations apply to the MU-2 district: 18 (1) Parking. In accordance with the downtown master plan, the following standards are meant to 19 encourage a pedestrian-friendly environment by minimizing curb cuts and the presence of on-site 20 parking. Where on-site parking is incorporated, it shall be placed in an unobtrusive location that 21 minimizes impacts to pedestrian circulation. 22 b. On-site parking may consist of surface-level or structured parking. 23 1. On-site parking is not required for nonresidential establishments, with the following 24 exceptions: 25 i. Overnight accommodations at the ratio provided in Sec. 8-46. 26 ii. The residential portion of a live/work unit. 27 iii. Parking determined to be required as a result of a parking generation study 28 performed in accordance with subsection (2) below. Alternative solutions may 29 include a shared parking agreement as described in Sec. 8-47, on-site parking, or 30 other solution as approved by the public works director. 31 13 1 XXIII. 2 That Zoning and Development Code, Chapter 2, Article VI, Section 2-72(d)(2)b., 3 Code of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended as 4 follows: 5 Sec. 2-72.-MU-2(Mixed-Use Downtown Medium Density)district. 6 (d) Supplementary development standards. In addition to the applicable standards found in Chapter 8 of 28 this code, the following regulations apply to the MU-L district: 29 (1) Parking. In accordance with the downtown master plan, the following standards are meant to 30 encourage a pedestrian-friendly environment by minimizing curb cuts and the visual presence of 31 on-site parking. 32 i. On-street parking requirements. 33 1. Diagonal parking shall be utilized on the following streets: North Lewis Street, North or 34 South Stone Street, North or South Black Street, North Nelson Street, and North 35 College Street. 36 2. The materials and design for all on-street parking shall be approved by the 4 transpeFtatien-public works director. 5 6 XXV. 7 That Zoning and Development Code, Chapter 2, Article VI, Section 2-74(d)(1)a., 8 Code of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended as 9 follows: 10 Sec. 2-74.- MU-R(Mixed-Use Redevelopment and Small Lot) district. 11 (d) Supplementary development standards. In addition to the applicable standards found in Chapter 8 of 12 this Code, the following regulations apply to the MU-R district: 13 (1) Parking. On-site parking shall be placed in an unobtrusive location that minimizes impacts to 14 pedestrian circulation. 15 a. On-site parking. 16 1. Due to the variable nature of lot sizes and use, a parking generation study shall be 17 provided with each development application for all nonresidential uses. The parking 18 generation study shall include the following criteria: 19 i. A demand analysis of parking need based on industry standards. 20 ii. Characteristics of those using parking, including turnover rate. 21 2. On-site parking shall be required for all residential uses, or residential portions of any 22 building. 23 i. Required residential parking per unit: 24 1 Bedroom: 1 space 25 2 Bedrooms or more: 2 spaces 26 ii. For residential units without defined bedrooms: 27 Under 800 square feet: 1 space 28 800 square feet or more: 2 spaces 29 iii. Tandem parking shall be permitted to accommodate the residential parking 30 requirement. 31 3. Alternative solutions may include a shared parking agreement as described in Sec. 8- 32 47 or other solution as approved by the Transportation Public Works Director. 33 15 1 XXV I. 2 That Zoning and Development Code, Chapter 2, Article VI, Section 2-75(f)(1)a., 3 Code of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended as 4 follows: 5 Sec. 2-75. - MU-G (Mixed-Use Greenfield and Large Lot) district. 6 (f) Baseline supplementary development standards. In addition to the applicable standards found in 7 Chapter 8 of this Code, the following regulations shall provide the baseline for PUD negotiations for 8 the MU-G district: 9 (1) Parking. Alternative solutions may include a shared parking agreement as described in Sec. 8- 29 47 or other solution as approved by the Tran6pertatisR-Public Works Director. 30 31 XXVII. 32 That Zoning and Development Code, Chapter 4, Article III, Section 4-48, Code of 33 Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended as follows: 34 Sec.4-48.-Driveways. 16 1 (a) For single-family, two-family and single-lot townhouse residences, as defined in Sec. 1-50, residential 2 driveways are permitted on local streets and local collector streets only. Residential driveways for 3 double frontage lots and corner lots must be located on the lesser classification street. Driveways 4 serving single-family, two-family or single-lot townhouse residences are prohibited on major collectors 5 or arterial streets unless the transpertatien -publicworks director determines no other access is 6 possible. 7 (b) Common-lot townhouse, as defined in Sec. 1-50, multifamily, and nonresidential driveways are 8 permitted on all streets; however, the driveways must have a minimum of 200 feet spacing between 9 driveways on arterial streets and from the street centerline at an intersection. 10 (c) The driveway restrictions above do not prohibit driveway access to alleys.Alley driveway access may 11 be permitted upon approval of a TIA by the transpeFtatieR public works director. 12 (d) Driveway construction shall be in accordance with the Design and Construction Standards. 13 14 XXVIII. 15 That Zoning and Development Code, Chapter 4, Article IV, Section 4-56(c)(3), 16 Code of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended as 17 follows: 18 Sec.4-56. -Gated communities. 19 (c) General requirements. All gated community PUDs shall include the following minimum requirements 20 in the PUD ordinance and/or development plan included therein: 21 (3) Any type of gate or controlled access means or mechanism is subject to the approval of the city's 22 fire marshal, and any corrective action shall be the responsibility of the property owners 23 association. The location of any such gate or controlled access means or mechanism and any 24 associated appurtenances shall be subject to the approval of the public works 25 director, and shall not impede necessary sight lines for traffic, nor create vehicular stacking that 26 adversely affects an adjacent street. A turnaround area subject to the approval of the 27 transpo0atien-public works director shall be provided on the exterior side of any such gate or 28 controlled access means or mechanism to allow traffic to reverse direction. The city shall bear no 29 responsibility or liability in connection with the removal or destruction of any gate or other 30 controlled access mechanism while engaged in an emergency action. 31 32 XXIX. 33 That Zoning and Development Code, Chapter 4, Article IV, Section 4-56(e)(2) and 34 (5), Code of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended 35 as follows: 36 Sec.4-56. -Gated communities. 37 (e) Property owners associations. 17 1 (2) The community covenants shall provide for a street maintenance reserve fund for the 2 maintenance, repair and reconstruction of private streets, related private storm sewers and 3 drainage facilities, access control structures and equipment. This reserve fund shall be 4 maintained in a separate account and may not be co-mingled with any other property owners 5 association funds.A portion of the assessments levied by the property owners association will be 6 placed in the street maintenance fund. The portion of the assessments collected from lot owners 7 and placed in the street maintenance fund will be based on the current maintenance and 8 replacement schedule prepared and certified by a licensed engineer or an individual holding an 9 RS ("reserve specialist") designation from the Community Associations Institute. In conjunction 10 with approval of the final plat, the basis and formula for calculating the amount of assessments to 11 be deposited in the street maintenance fund, shall be subject to review and approval by the 12 director of transpertatieapublic works and the PDS director.The property owners association shall 13 provide to the city: (i) annually an affidavit setting forth the fund balance and any expenditures 14 therefrom; and (ii) at least once every three years, an updated maintenance and replacement 15 schedule prepared and certified by a licensed engineer or a reserve specialist. No more than 16 once annually, the basis and formula for calculating the amount of assessments to be deposited 17 in the street maintenance fund may be amended, subject to the review and approval of the director 18 of traesportationpublic works and the city PDS director. 19 (5) The community covenants shall provide that the streets within the gated community are private, 20 owned and maintained by the property owners association and that the city has no obligation to 21 maintain or reconstruct the private streets, nonpublic storm sewers and drainage facilities. The 22 covenants shall include the following provision: 23 "The property owners association shall be responsible for contacting the City of Round Rock 24 Traaspertatien-Public Works Department every two years, or as needed, from time of initial 25 completion to schedule an inspection, to include city staff and the property owners association's 26 representative for reviewing the private streets". 27 XXX. 28 That Zoning and Development Code, Chapter 4, Article VI, Sections 4-77(a)(1) and 29 4-78(a), Code of Ordinances (2018 Edition), City of Round Rock, Texas, are hereby 3o amended as follows: 31 Sec.4-77. -Wastewater system. 32 (a) Sewer service to each lot inside city limits;connection with wastewater system required. 33 (1) Connection to the city's wastewater system shall be required except where the director of 34 etilitiespublic works determines that such connection would require unreasonable expenditure of 35 funds when compared with alternate methods of sewage disposal. Where alternative sewage 36 disposal is permitted, the plans for such system must meet the requirements of the TCEQ and be 37 approved by the county health department, prior to approval of the final plat by the planning and 38 zoning commission. 39 Sec.4-78.-Oversize mains. 40 (a) Size of mains. All water and wastewater mains shall be installed in accordance with the water and 41 wastewater master plan maintained by the utility public works director.All water and wastewater mains 42 shall be sized to provide necessary service to the tract to be developed. The cost of water mains up 43 to eight inches, or of a size required to serve a tract being developed, whichever is larger, shall be 44 paid in full by the developer. 18 1 2 XXX I. 3 That Zoning and Development Code, Chapter 4, Article VII, Section 4-86(b)(2), 4 Code of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended as 5 follows: 6 Sec.4-86. -On-site facilities, regional program, and fees. 7 (b) Regional stormwater management program. 8 (2) Regional stormwater management program fees. 9 a. The fees are as follows: $ 800.00/acre Single-family I $1,600.00/acre Multifamily $2,400.00/acre Commercial/Industrial 10 1. Adjustment of these fees may be allowed by the PDS director, in consultation with the 11 --ti"'i public works director, if it is determined that certain impervious coverage 12 restrictions, (e.g., special watershed ordinances), reduce the actual land use. However, 13 the minimum fee shall not be less than $800.00/acre. 14 2. Upon approval of participation, the full fee will be due prior to approval of construction 15 plans for single-family projects and upon building permit approval for multifamily, 16 commercial, and industrial projects. 17 18 XXXII. 19 That Zoning and Development Code, Chapter 4, Article VIII, Section 4-96(c)(3), 20 Code of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended as 21 follows: 22 Sec.4-96. -Construction of public improvements. 23 (c) Sidewalk construction. 24 (3) Deferment of sidewalk construction. Sidewalks shall be installed in accordance with subsections 25 (c)(1) and (2) of this section, except under the following circumstances, as determined by the 26 traa6.pe4atipublic works director: 27 a. Where the existing cross section of the street makes immediate construction of a sidewalk 28 impractical; 19 1 b. Where a nonresidential subdivision abutting an existing street is isolated from any other 2 sidewalk by a distance of twice the frontage of the subdivision; or 3 C. Where construction or reconstruction of the street where a sidewalk is to be placed is 4 imminent and the sidewalk would be destroyed if constructed. 5 d. Where construction of a single-family home within a residential subdivision would potentially 6 damage or destroy a sidewalk immediately adjacent to the lot, the sidewalk shall be 7 constructed prior to issuance of a certificate of occupancy for each individual residence. 8 The city may require a cash payment by the developer in lieu of construction of the sidewalk if 9 the transpertat'en public works director determines that the sidewalk should not be built within 10 the three-year period of the construction plans. The cash payment shall equal the city's estimate 11 of the cost of constructing and installing the sidewalk and associated features, such as but not 12 limited to appurtenances and drainage features, at the time of permit issuance of the public 13 improvements. The developer shall pay the cash payment prior to the issuance of the public 14 improvements permit. 15 XXXIII. 16 That Zoning and Development Code, Chapter 6, Article I, Section 6-1(c), Code of 17 Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended as follows: 18 Sec. 6-1. -General policy. 19 (c) Streets shall be provided to the boundary lines of the tract being subdivided, unless the transpertatien 20 public works director determines that such an extension is neither necessary, nor desirable. 21 XXXIV. 22 That Zoning and Development Code, Chapter 6, Article II, Section 6-11(a)(1) and 23 (g), Code of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended 24 as follows: 25 Sec. 6-11.-Streets. 26 (a) Street classification and characteristics. 27 (1) Local streets. The purpose of a local street is to provide lot street frontage and carry traffic to a 28 higher classification street. Local streets are divided into three subcategories: Local-residential, 29 local-nonresidential or local-rural. Unless approved by the traRsper#alieri-public works director, a 30 local street shall not connect to two separate higher classification streets or connect directly to 31 arterial streets. Local streets may be designated as private streets. 32 (g) Curbing. All streets shall have standard curbing and gutter except for the local-rural street classification 33 where ribbon curb is allowed. All raised medians and islands located within the street pavement shall 34 be bordered by standard curb and gutter, unless otherwise approved by the transpe4at+en public works 35 director. All concrete curb and gutter shall be installed and constructed according to the Design and 36 Construction Standards. 37 20 1 XXXV. 2 That Zoning and Development Code, Chapter 6, Article II, Sections 6-13 and 6-14, 3 Code of Ordinances (2018 Edition), City of Round Rock, Texas, are hereby amended as 4 follows: 5 Sec. 6-13. - Medians and islands. 6 (a) Standards. Medians and islands shall be landscaped with grass turf or constructed of stamped pattern 7 concrete, brick, stone or concrete pavers, or other engraved concrete surfaces approved by PDS 8 director. Grass turf areas shall not be less than six feet in width. All medians and islands shall be 9 bordered by standard curb and gutter, unless otherwise approved by the transpertatieR-public works 10 director. 11 (b) Median openings. Median openings on arterial streets shall be in accordance with the Design and 12 Construction Standards. 13 Sec. 6-14. -Intersections. 14 (a) Proposed intersections shall be designed to meet the minimum spacing requirements, curb radii, and 15 corner sight distances required in the Design and Construction Standards, and based on the following 16 design specifications: 17 (1) Streets shall intersect at right angles. In the event of physical constraints that prevent right 18 angles, a modification of up to 20 degrees may be permitted by the planning and zoning 19 commission upon recommendation by the transportation public works director. 20 (2) The right-of-way line at street intersections shall be in accordance with the Design and 21 Construction Standards. 22 (3) The centerline of intersecting streets shall be a minimum of 200 feet from other street 23 intersections. This offset shall not apply to streets intersecting a street if a raised median is 24 provided and no median opening is aligned with either of the offset streets. Future median 25 openings are prohibited where two streets offset and intersect an arterial street at a distance of 26 less than 200 feet; provided, however, median openings may be allowed for one-way traffic 27 circulation subject to the approval of the tran6pertation public works director. 28 29 XXXVI. 30 That Zoning and Development Code, Chapter 6, Article II, Section 6-18(a), Code 31 of Ordinances (2018 Edition), City of Round Rock, Texas, are hereby amended as 32 follows: 33 Sec. 6-18. -Signage,striping and signalization. 34 (a) Signage and striping. The developer shall design, install and pay all costs for traffic control signs and 35 pavement striping. Traffic control signs and pavement striping shall conform to the accepted 36 construction plans and to the most recent edition of the Texas Manual of Uniform Traffic Control 37 Devices, a copy which is on file with the traaspertatierpublic works director. 21 1 2 XXXVII. 3 That Zoning and Development Code, Chapter 6, Article Il, Section 6-19(e)(2) and 4 (5), Code of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended 5 as follows: 6 Sec. 6-19. -Nonresidential private street development. 7 8 (e) Property owners associations. 9 (2) The property owners association covenants and bylaws shall provide for a street maintenance 10 reserve fund for the maintenance, repair and reconstruction of private streets, related private it storm sewers and drainage facilities, access control structures and equipment. The covenants shall include the 31 following provision: 32 "The property owners association shall be responsible for contacting the City of Round Rock 33 Transportation ServisesPublic Works Department every two years, or as needed, from time of 34 initial completion to schedule an inspection, to include city staff and the property owners 35 association's representative for reviewing the private streets". 36 37 XXXVIII. 38 That Zoning and Development Code, Chapter 8, Article II, Section 8-10(i)(2)i., 39 Code of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended as 40 follows: 41 Sec. 8-10. - Landscaping. 22 1 (i) Irrigation. 2 (2) System requirements. An irrigation system shall comply with the following: 3 i. Irrigation systems must be inspected at least once every three years by an inspector who 4 holds a license in compliance with the below subsection (3) License requirements. The 5 results of the inspection shall be submitted to the Utilities Rd E^.,;FeRFREIRtal Sew'GesPublic 6 Works Director within 30 days following the inspection. This requirement shall not apply to 7 irrigation systems installed on residential properties in the SF-R(Single-Family—Rural); SF- 8 1 (Single-Family—Large Lot); SF-2 (Single-Family—Standard Lot); SF-3 (Single-Family- 9 Mixed Lot); SF-D (Single-Family—Downtown); and TF (Two-Family)zoning districts. 10 11 XXXIX. 12 That Zoning and Development Code, Chapter 8, Article X, Section 8-161(a), Code 13 of Ordinances (2018 Edition), City of Round Rock, Texas, is hereby amended as follows: 14 Sec. 8-161. -Administration. 15 (a) Designation of the floodplain administrator. The director of utilities ^d e^ pan^,^^+;;' sppdpublic 16 works or the director's designee is hereby appointed the floodplain administrator to administer and 17 implement the provisions of this article and other appropriate sections of 44 CFR (National Flood 18 Insurance Program regulations) pertaining to floodplain management. 19 20 XL. 21 That Zoning and Development Code, Chapter 10, Article V, Sections 10-36(a)(2) 22 and 10-37(b)(1) and (2), Code of Ordinances (2018 Edition), City of Round Rock, Texas, 23 are hereby amended as follows: 24 Sec. 10-36. - License agreements. 25 (a) In general. 26 (2) Private construction on public property or right-of-way is prohibited without an executed license 27 agreement in place. Structures and planting shall be located outside of all easements and shall 28 be set back from public utilities as required by the transpsrtatieR public works director and city 29 engineer. 30 Sec. 10-37. - Right-of-way abandonment procedures. 31 (b) Procedure. 32 (1) A pre-application meeting with the transpertatien--public works director, city engineer, or 33 designated representatives is required to look at the site and receive initial guidance through the 34 process. The applicant requesting the abandonment must obtain the following information and 35 forward this information to the City as a complete packet: 36 (2) When the above information has been received by the City, the applicant shall be notified that 37 the file is complete and ready for City Council action. The city engineer or transpeFtat OR public 23 1 works director shall place the abandonment on the City Council agenda, prepare a 2 recommendation, and inform the applicant of the date and time of the council meeting. 3 4 XLI. 5 A. All ordinances, parts of ordinances, or resolutions in conflict herewith are 6 expressly repealed. 7 B. The invalidity of any section or provision of this ordinance shall not s invalidate other sections or provisions thereof. 9 C.
