CM-2024-257 - 10/11/2024STATE OF TEXAS § COUNTY OF WILLIAMSON § SUPPLEMENTAL CONTRACT NO.2 TO CONTRACT FOR ENGINEERING SERVICES FIRM: KIMLEY-HORN AND ASSOCIATES, INC. ("Engineer") ADDRESS: 5301 Southwest Parkway, Building 2, Suite 100, Austin, TX 78735 PROJECT: Kenney Fort 24-inch Reuse Line Extension This Supplemental Contract No. 2 to Contract for Engineering Services is made by and between the City of Round Rock, Texas, hereinafter called the "City" and Kimley-Horn and Associates, Inc., hereinafter called the "Engineer." WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter called the "Contract," on the 27th day of October, 2022 for the Kenney Fort 24-inch Reuse Line Extension Project in the amount of $616,200.00; and WHEREAS, the City and Engineer executed Supplemental Contract No. 1 on August 24, 2023 to amend the scope of services and to increase the compensation by $110,000.00 to a total of $726,200.00; and WHEREAS, it has become necessary to amend the Contract to modify the provisions for the scope of services and to increase the compensation by $35,600.00 to a total of $761,800,00; NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract is amended as follows: 1. Article 2, Engineering Services and Exhibit B, Engineering Services shall be amended as set forth in the attached Addendum to Exhibit B. Exhibit C, Work Schedule shall be amended as set forth in the attached Addendum to Exhibit C. II. Article 4, Compensation and Exhibit D. Fee Schedule shall be amended by increasing by $35,600.00 the maximum amount payable under the Contract for a total of $761,800.00, as shown by the attached Addendum to Exhibit D. Sandre, City Attorney 10/11/2024 Date Supplemental Contract Rev.06/16 0199.202238;4867-7100-5163 84275 ADDENDUM TO EXHIBIT B Engineering Services Based on coordination with City staff, additional environmental services are recommended to include an additional 3,600 linear feet of 24-inch reuse water line, a new clearwell at the WWTP with associated piping, and electrical improvements at the WWTP property. • Kenney Fort Blvd 24-inch Reuse Water Line - Approximately 10,600 linear feet o Proposed 24-inch reuse water line along Kenney Fort Blvd from Forest Creek Drive to the Southernmost access drive into Kalahari, approximately 1,500' southeast of Kalahari Blvd. The reuse line will traverse the tree line on the South side of the Kalahari property and then travel northeast to connect to an existing reuse line at the Brushy Creek East Regional WWTP. • Clearwell Proposed 2 MG reuse water ground storage tank, yard piping, and appurtenances inside the existing footprint of the Brushy Creek East Regional WWTP. • Electrical Improvements - Proposed dual feed electric improvements for the reuse water supply system inside the footprint of the Brushy Creek East Regional WWTP. Task 5 - Easements and Permitting • Permitting o Environmental Services for additional 3,600 LF of proposed reuse water line, 1MG Clearwell at WWTP with associated piping, and electrical improvements within the WWTP property.- (Sub -Consultant - Environmental Research Group, LLC.) ■ Archaeological survey and clearance through the Texas Historical Commission, if needed. ■ Task A: Wetland/water of the US Delineation & Permitting Evaluation • The Consultant will perform site visit to evaluate water features within the project area to assess potential waters of the US in the project area. • The Consultant will determine if the project will meet the conditions for authorization under a Section 404, Nationwide permits and provide a memo summarizing the findings and the permitting evaluation, if needed. • Included for additional 3,600 LF of reuse water line, 1 MG Clearwell with associated piping, and electrical improvements. ■ Task B. Threatened and Endangered Species Habitat Assessment B-1 • In conjunction with site visit for Task A Consultant will assess the likely presence or absence of Threatened and Endangered Species or other species of concern. • Included for additional 3,600 LF of reuse water line, 1 MG Clearwell with associated piping, and electrical improvements. ■ Task C: Archaeological and Historic Resources Desktop Study and Coordination • Consultant will consult relevant available desktop -level datasets to assess the project's potential for impacting significant archaeological resources. • The Consultant will summarize findings and prepare a letter for the Texas Historical Commission for their review under the Antiquities Code of Texas. • Included for additional 3,600 LF of reuse waterline, 1 MG Clearwell with associated piping, and electrical improvements. ■ Task D: Archeological Survey (Optional) This task is optional based on the results of the project coordination with the THC. If a survey is recommended for all or a portion of the project area, the following will occur: c Prior to archaeological survey, Consultant will acquire a Texas Antiquities Permit from the THC and conduct a 100 percent pedestrian survey of the project area in accordance with the published minimum survey standards for Texas (CTA 2020). Tests will be approximately 30cm in diameter and will be dug to 80cm below the surface or to bedrock or pre -cultural deposits, whichever is higher. All excavated soil will be screened, and any artifacts will be recorded and reburied. All sites will be photographed, mapped, fully recorded, and field assessed for NRHP and or/SAL eligibility. o Following field survey, Consultant will prepare a report summarizing results of the investigations, describing, and evaluating any archaeological sites, mapping their locations, and making recommendations. The survey report will be submitted to the THC for review. The Consultant will comply with administrative terms of the permit for project completions. The report and all accompanying B-2 field documentation will be curated at a State approved facility. • Included for entire 10,600 LF of reuse waterline, 1 MG Clearwell with associated piping, and electrical improvements.
