O-2024-269 - 10/10/2024 1 ORDINANCE NO. 0-2024-269 2 AN ORDINANCE AMENDING CHAPTER 32, ARTICLE II, SECTION 32- 3 33, GARBAGE COLLECTION SERVICE CHARGES, CODE OF 4 ORDINANCES (2018 EDITION), CITY OF ROUND ROCK, TEXAS, 5 REGARDING RESIDENTIAL, DOWNTOWN COMMERCIAL DISTRICT, 6 AND COMMERCIAL CHARGES; AND PROVIDING FOR A SAVINGS 7 CLAUSE AND REPEALING CONFLICTING ORDINANCES AND 8 RESOLUTIONS. 9 10 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, 11 TEXAS: 12 I. 13 That Chapter 32, Article II, Section 32-33, Code of Ordinances (2018 Edition), City 14 of Round Rock, Texas, is hereby amended to read as follows: 15 Sec. 32-33. -Garbage collection service charges. 16 (a) Residential. 17 (1) A sanitation charge for the collection of refuse and for city-wide recycling services shall be made 18 for each occupied residence within the city, whether or not any refuse is deposited for collection 19 for such occupied residence during any month and whether or not the residence utilizes the city- 20 wide recycling services during any month. For multiple housing units, up to and including five 21 units, the sanitation charge shall be applied for each dwelling unit, regardless of the number of 22 water meters. 23 (2) The residential charge for the collection of refuse and for recycling services shall be $21.87 per 24 month. 25 The amended residential charge for refuse and recycling services set forth above shall apply to 26 bills for the collection of refuse and for recycling services issued in December and thereafter. 27 (3) Except as provided below, on and after June 10, 1993, the garbage rate discount for head of 28 household residents 65 years of age and older will be discontinued. All head of household 29 residents 65 years of age and older actually receiving said discounts prior to June 10, 1993, shall 30 continue to receive said discounts as stated in this section, so long as they re-apply for said 31 discounts before October 30 of each year. For residential service located within the corporate 32 limits where the head of household has attained the age of 65, and if said resident head of 33 household was receiving garbage rate discounts prior to June 10, 1993, and if said resident head 34 of household re-applies for said discount between October 1 and October 30 of each year, said 35 head of household shall be entitled to a discount as currently established or as hereafter adopted 36 by resolution of the city council from time to time from the residential sanitation charge. In order 37 to be entitled to said discount, the head of house shall make a sworn application therefor and 38 present proof of age. It shall be a violation of this Code for anyone to make a false statement on 39 such application, or to receive such discount without being eligible therefor. Each month a 40 discount is unlawfully received shall be considered a separate violation. 0112.20242;4894-8225-4819 1 (b) Nonresidential.A sanitation charge for the collection of refuse for all nonresidential customers shall be 2 made by the city's contractor.The charge shall include furnishing containers for refuse.This subsection 3 (b) shall exclude all businesses located within the downtown commercial district described in 4 subsection (c) below. The sanitation charges for nonresidential customers as set forth below. If a new business does not clearly meet one of the business 11 classifications,the director shall assign the most appropriate classification from the classifications 12 set forth in subsection (c)(3) above. If a new or existing business owner disagrees with the 13 assigned classification, the owner shall have the right to file a written request for reconsideration 14 to the director. If the request for reconsideration is denied, the owner shall have the right to file a 15 written appeal to be decided by the city manager. A request for reconsideration or an appeal shall 16 be granted or denied within 30 days of receipt by the director or city manager.The city manager's 17 decision shall be final. 18 (6) For the purposes of this section,the square footage for a business shall be determined by adding 19 the total main area square footage to the total outdoor area square footage. Outdoor area square 20 footage shall include a covered or uncovered patio or any other outdoor space utilized by 21 customers. 22 (7) The city shall provide a common container in a designated area on each block. Each business in 23 the downtown commercial district shall utilize only the common container on its block. All refuse 24 and recycling shall be placed inside the common container. All garbage shall be drained before 25 placing in container. All packing boxes larger than two cubic feet must be flattened before placing 26 in container. No manure, building materials, rocks, dirt or dead animals shall be placed in the 27 container. 28 (d) Outside city limits. The above garbage collection rates shall apply to all users located within the 29 corporate limits of the city. All users located outside the corporate limits of the city shall pay 11/2 times 30 the rate set forth above. 31 32 II. 33 A. All ordinances, parts of ordinances, or resolutions in conflict herewith are 34 expressly repealed. 35 B. The invalidity of any section or provision of this ordinance shall not 36 invalidate other sections or provisions thereof. 5 1 C.
